Decree of the Ministry of Agriculture and Nutrition of the Czech Socialist Republic, governing the granting of aid and refunds in relation to the control of diseases and other animal diseases and determining free professional veterinary activities

Ministry of Agriculture and Nutrition of the Czech Socialist Republic

providing for the granting of aid and compensation for the control of diseases and other animal diseases and determining free professional veterinary activities
The Ministry of Agriculture and Nutrition of the Czech Socialist Republic, in agreement with the Federal Ministry of Agriculture and Nutrition pursuant to § 32 (3) of Act No. 87 / 1987 Coll., on Veterinary Care, and § 2 (2), § 8 (2) of Act No. 108 / 1987 Coll., on the jurisdiction of veterinary care bodies of the Czech Socialist Republic, provides:

ČÁST I

AID AND REFUNDS
§ 1
Provision of aid
Aid may be granted to farmers for the payment or reduction of damage or, where appropriate, the costs incurred in carrying out protection and control measures against diseases and other animal diseases, (1) as well as the damage caused by the death of animals as a result of the disease or other animal diseases,
(a) socialist agricultural organisations and citizens keeping cattle, pigs, sheep, goats, hoard and water poultry, solipeds, rabbits, pigeons, fur animals, fish and bees;
(b) forestry organisations keeping horses;
(c) game hunting users in breeding establishments;
(d) in justified cases, also to the breeder of another animal, where the animal with special training or otherwise is valuable and has been ordered to be killed under protection and control measures against diseases and other animal mass diseases.
§ 2
Amount and use of aid
(1) Aid may be granted up to the amount of actual damage or costs incurred.
(2) The actual damage shall be determined on the basis of the purchase prices of the animals and, if the purchase price is not established in accordance with the price regulation, on the basis of the prices of the animals determined by estimates; it shall be deducted what has been provided to the breeder for the necessarily slaughtered animal and for reasons of insurance or otherwise provided by the State to the breeder for the same purpose.
§ 3
Circumstances excluding aid
No aid shall be granted if the breeder has infringed an important obligation imposed on him by veterinary legislation to prevent the creation, to prevent the spread and to combat diseases and other animal mass diseases, in particular:
(a) it has not carried out, or has not allowed, planned or ordered veterinary preventive, prophylactic and diagnostic operations;
(b) it has not carried out, made it possible to carry out or fail to comply with the protection and enforcement measures laid down.
§ 4
Granting of compensation
(1) Persons staying in a municipality or, where appropriate, in premises where a closure has been ordered under veterinary legislation for which they have not been able to carry on temporary work as a result of their employment or as a member of a cooperative, or to carry on other work or to a limited extent, shall be entitled to compensation for lost earnings, provided that such compensation is not attributable to the organisation to which they are working or to a member.
(2) Persons who have been forced to stay outside their residence for the reason referred to in paragraph 1 are entitled to compensation for the increased costs of temporary accommodation and meals.
(3) The refund referred to in paragraph 2 shall be granted mutatis mutandis to work or transfer to a place of work outside the municipality of regular residence for a fixed period of time under the rules on travel refunds. 2)
§ 5
Procedure for granting aid or compensation
(1) An application for aid or refund shall be submitted no later than three months after the date on which the disease or other animal disease is declared to have been overcome or, where appropriate, from the date on which the suspicion is excluded. It shall be submitted to the district national committee in whose district protection against diseases and other animal diseases has been ordered or, where appropriate, in whose district an event is justified.
(2) Before deciding on the application referred to in paragraph 1, the District National Committee shall request:
(a) the opinion of the relevant local (urban) national committee;
(b) the opinion of the competent district (urban) veterinary administration and, if the request is made by a socialist agricultural organisation or forestry organisation, also by its superior body.
(3) At the same time, the decision to grant aid to a socialist agricultural organisation or forestry organisation may determine the purpose of the aid and the period within which that purpose is to be achieved.

ČÁST II

SPECIFIC VETERINARY ACTIVITIES
§ 6
Professional veterinary activities shall be carried out free of charge if:
(a) veterinary surveillance operations under the Veterinary Care Act (including inspection of animals for slaughter and meat and veterinary examination of other animal products);
(b) the veterinary authorities of the planned bulk examinations and vaccination (including used vaccines, sera and other biopreparations) against very dangerous and dangerous animal diseases;
(c) investigating animals if suspected
1. from the disease of animals and professional veterinary practices to combat that disease,
2. from other animal diseases;
(d) the veterinary authorities of the planned preventive survey of livestock health and diagnostic operations linked thereto;
(e) investigation and treatment
1. animals of budgetary organisations, school goods of universities and in school veterinary districts designated by the State Veterinary Administration of the Czech Socialist Republic for the teaching and further training of veterinary staff,
2. animals of zoos and zookouks;
3rd blind dog.

ČÁST III

COMMON, TRANSITIONAL AND FINAL PROVISIONS
§ 7
The district veterinary administration in Liberec shall also exercise its jurisdiction in the district of Jablonec nad Nisou.
§ 8
The examination of an application for aid or a refund submitted before the date of application of this Order shall be carried out in accordance with this Order.
§ 9
Efficacy
This Decree shall take effect on 1 January 1988.
