of 4 December 1962
on State technical supervision of machinery used in agriculture and on safety and health at work with such machinery
The Ministry of Agriculture, Forestry and Water Management, in agreement with the participating ministries and the Central Committee of the Union of Workers of Agriculture and Forestry, provides, pursuant to Article 18 (2) of Act No. 27 / 1949 Coll., on the Mechanisation of Agriculture, Section 27 (1) of Act No. 65 / 1961 Coll., on Safety and Health at Work, and on the implementation of the principles of Government Resolution No. 53 / 1962, on measures to improve the operation of machinery and tractor stations and on the management of the development and use of agricultural technology:
(1) State expert supervision of the technical condition of agricultural machinery and equipment (hereinafter referred to as "machinery"), their proper maintenance, care and proper use in single agricultural cooperatives and on state goods (hereinafter referred to as "agricultural plants") are provided by regional agricultural engineering undertakings.
(2) The directors of regional agricultural engineering undertakings shall, following the opinion of the Regional Association of Agricultural and Forestry Workers' Association, entrust the performance of the supervision referred to in paragraph 1 to professional staff of machinery and tractor stations (hereinafter referred to as the "State Technical Supervision Authorities in Agriculture"); they shall issue written certificates specifying the scope of their duties.
(3) State professional supervision bodies in agriculture (paragraph 2) also carry out state professional supervision of safety and health at work with machinery in agricultural establishments.
For the purposes of the uniform and professional supervision provided for in Article 1 (1) by regional agricultural engineering undertakings and for the purposes of the uniform implementation of such supervision as referred to in Article 1 (3), regional agricultural technology undertakings shall follow the guidelines approved by the Ministry of Agriculture, Forestry and Water in agreement with the Central Board of Trade Unions after consultation with the Central Committee of the Union of Workers of Agriculture and Forestry.
The Director of the Central Agricultural Engineering Enterprise, after a statement from the Central Committee of the Union of Agriculture and Forestry Workers' Association, shall entrust the professional personnel of the holding with the control of the activities of the regional agricultural engineering undertakings as well as of the state professional supervision bodies in agriculture under this Decree; issue written certificates for delegation.
(1) In particular, the authorities of state professional supervision in agriculture shall carry out the following tasks under Article 1:
(a) keep an eye on
- processing of the repair plan and technical maintenance of machinery,
- proper storage and treatment of machines outside the working season,
- timely revision of pressure equipment, hoists and electrical equipment in accordance with special regulations, *), both on machinery and separately incorporated equipment,
- the proper management and proper storage of fuels and lubricants,
- proper recording and storage of spare parts,
- timely and proper processing of the seasonal deployment and use plans and their implementation,
- equipment for new and used machinery in terms of safety, health and safety of fire,
- technical preparedness of machinery before the start of seasonal work,
- timely and proper implementation of technical maintenance and repair of machinery,
- proper keeping of prescribed records of the use, maintenance and condition of machines;
(b) implement:
- technical supervision when taking over new machinery by farm,
- a systematic check of professional qualifications, fitness and reliability of drivers of motor vehicles and persons operating complex machinery;
(c) carry out assessments on the technical state of the machines designed for decommissioning as a result of accidents; ensure that machines that can still be used are not disabled;
(d) participate in the investigation of the causes of fatal, severe, mass or recurrent accidents and other serious accidents occurring in the work of machines and the consideration of measures to prevent them;
(e) they shall ensure that the competent authorities appoint experts at the farm for the occupational safety and health section.
(2) The authorities of state professional supervision in agriculture ensure that in all agricultural establishments the care of health and safety at work is continuously deepened and improved in accordance with the national plan for the development of the national economy and the latest knowledge of science and technology. They shall also supervise compliance with all safety regulations when working with machinery and with all prescribed safety technical measures as well as with relevant national technical standards.
In the performance of their tasks, the authorities of state professional supervision in agriculture shall be entitled in particular to:
(a) require workers and the management of agricultural establishments (boards of single agricultural cooperatives) to explain and submit documents (e.g. authorisation and approval decisions, records of technical tests of machinery, revision records) where this is strictly necessary for the performance of their tasks;
(b) prohibit the operation of machinery which does not comply with the rules on safety and health at work and hygiene, or on which technical maintenance is to be carried out or where the principles of good use have been grossly infringed; where motor vehicles and their trailers are involved, they may retain and retain a certificate of the technical licence at the workplace of agricultural factories until the defects have been remedied;
(c) to remove the machine-operated qualification card from personnel authorised to operate it, in violation of the rules of technical use, safety and health at work or in constant negligence on the maintenance of machinery;
(d) the head of agricultural establishments (directors of single agricultural cooperatives) to notify identified defects at work with machines, to impose their removal within a reasonable period of time, to monitor the removal of defects, or, where appropriate, to propose the reassignment of workers who are consistently negligently carrying out their tasks at work with machines or who are negligent of the principles of safety and health at work with machines;
(e) to notify national committees for further management of more serious cases of non-compliance with and uneconomical and, where appropriate, improper treatment of the rules on safety and health and hygiene at work.
Agricultural establishments shall be obliged to allow the authorities of state professional supervision in agriculture as well as the persons responsible for the control referred to in Article 3 to carry out their activities and provide them with the necessary assistance.
The provisions on the supervision of the authorities of the Revolutionary Trade Union Movement, on state technical supervision, on the tasks of national committees and on the responsibilities of the competent authorities under the rules on safety and health at work are not affected by this decree.
(1) In carrying out the tasks referred to in this Decree, the authorities of the State's professional agriculture supervision shall cooperate with the authorities of the Institute of Technical Supervision, the surveillance of the Revolutionary Trade Union Movement, sanitary and anti-epidemic services, Public Security and Fire Protection.
(2) In response to a request from the national committees, the authorities of state professional supervision in agriculture are required to report on the performance of the tasks laid down in this Decree.
(3) State professional supervision bodies in agriculture must not be entrusted with tasks which are unrelated to their activities under this Decree.
The provisions of this decree do not apply to state agricultural plants within the scope of the ministries of national defence, interior and fuel and energy.
This decree shall take effect on the day of its publication.
