GOVERNMENT REGULATION
of 26 March 2008
amending Government Regulation No 75 / 2007 Coll., on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and Natura 2000 areas on agricultural land
The Government hereby orders, pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., (hereinafter referred to as "the Act '), to implement § 2c (2) (a) of the Act and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Decree No 75 / 2007 Coll., on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and Natura 2000 areas on agricultural land, is amended as follows:
1. in § 5 (2) (b), § 5 (4) and (5), § 6 (1) (a), § 6 (1) (b) (2), § 6 (6) (b) (1) and (2), § 7, § 8 (4), § 8 (4) (a), § 8 (4) (b) (4), § 9 (3) and (4), § 11 (3) and (4) and § 12 (4) and (5), the words "pursuant to § 3" shall be inserted after ";
2. In Paragraph 8 (4) (b) (4), "the quantity of nutrients delivered 'is replaced by" the quantity of nitrogen delivered'.
3. In Article 8, paragraphs 5 and 6 are added:
"(5) If the applicant makes payments in a less favourable area or Natura 2000 area as referred to in Article 3, the erosion in accordance with Article 3i (b) of the Act (" renewal ') on the soil block or part thereof, with the crop culture, shall ensure that, by 31 August of the calendar year at the latest, there is a continuous grassland on the relevant soil block or part thereof, and
(a) the first cleavage along with the removal of biomass has been carried out; or
(b) a crop intended to protect the growing grassland has been harvested, if sown.
(6) Where this Regulation or Government Regulation No 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, the date of implementation of the first cleavage before 31 August of the calendar year, in the case of renewal as referred to in paragraph 5, the implementation of the first cleavage of biomass or crop harvesting to protect the growing grassland by 31 August of the calendar year shall be considered to comply with this condition. ';
4. Paragraph 12 (3), including footnote 21, is deleted.
Paragraphs 4 to 8 shall be renumbered paragraphs 3 to 7.
5. In Article 12 (3), the words "or the presentation of such a register from which it is not possible to identify the required information 'shall be added at the end of the text in point (c).
6. Paragraph 12 (5) is deleted.
Paragraphs 6 and 7 shall become paragraphs 5 and 6.
7. In Article 12 (5) and (6), "1 and 4 'is replaced by" 1 and 3';
8. In Annex 1, after the text:

Efficacy
This Regulation shall enter into force on 15 April 2008.
