of 24 April 1997
amending and supplementing the Act of the Czech National Council No. 13 / 1993 Coll., Customs Act, as amended by the Act of the Czech National Council No. 35 / 1993 Coll., Act No. 54 / 1956 Coll., on sickness insurance of workers, as amended, Act No. 32 / 1957 Coll., on sickness care in the armed forces, as amended, Act No. 88 / 1968 Coll., on the extension of maternity leave, on maternity benefits and on allowances for children from sickness insurance, as amended, and the Act of the Czech National Council No. 589 / 1992 Coll., on social security insurance premiums and the contribution to state employment policy, as amended
Parliament has decided on this law of the Czech Republic:
Act of the Czech National Council No. 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended by Act of the Czech National Council No. 10 / 1993 Coll., Act No. 160 / 1993 Coll., Act No. 307 / 1993 Coll., Act No. 42 / 1994 Coll., Act No. 241 / 1994 Coll., Act No. 59 / 1995 Coll., Act No. 118 / 1995 Coll., Act No. 149 / 1995 Coll. and Act No. 160 / 1995 Coll., is amended as follows:
1. In the first sentence of Paragraph 20 (3), in the part of the sentence in front of the semicolon, the words "following the date on which such district social security administration received the application from the payer for the authorisation of instalments' are replaced by" the maturity of the first instalment of debt '.
2. In the first sentence of Article 20 (3), the part of the sentence after the semicolon is worded as follows: "where a premium payer who has been authorised to pay the premiums due in instalments does not pay in time or at the correct amount any payment of the debt or insurance payable in the period after the maturity of the first instalment of the debt and the district social security administration has, for that reason, cancelled the authorisation, he shall be obliged to pay an additional penalty of 0,075% of the amount due for each calendar day on which his debt is outstanding from the date of maturity of the first instalment of the debt."
3. The first sentence of Paragraph 20a (1) reads: "At the written request of the policy payer referred to in Article 3 (1) (a) and (b), the competent district social security administration may authorise the payment of premiums and periodic penalty payments due in instalments up to the amount owed by that payer on the date of the decision authorising the instalments. '
4. In the first sentence of Paragraph 20a (2), the word "permit 'is replaced by" may authorise' and the words "if the debt on that supplement and periodic penalty payment is at least twice the amount of the debt in question (paragraph 3) '.
5. Paragraph 20a becomes paragraph 3 and paragraph 3 becomes paragraph 4.
6. In Paragraph 20a (5), the word "third 'and the words" unless the premium payer has requested that the date be fixed for an earlier calendar month' are deleted.
7. In Paragraph 20a (8), the word "cancelled 'is replaced by" may be deleted'.
8. Paragraph 20a (9) shall be deleted. Paragraph 10 shall become paragraph 9.
9. In Paragraph 25, the following paragraph 3 is inserted after paragraph 2:
"(3) Paragraph 2 to 24 shall also apply to members of the Customs Administration of the Czech Republic with the following derogations:
(a) where under these provisions the Czech Social Security Administration has jurisdiction, this means the Ministry of Finance;
(b) where such provisions refer to an organisation and a small organisation, this shall be understood as being the competent customs authority. ";
Paragraph 3 shall become paragraph 4.
4. Where the term regional customs office is used in the legislation, this shall be understood as the Customs Directorate. Where the concept of Central Customs Administration is used in legislation, this shall be understood as a Ministry.
5. The rights and obligations of the regional customs offices shall be transferred to the customs office in whose territorial area the offices of those regional customs offices had their registered office at the date of application of this Act. The rights and obligations of the customs offices which have been cancelled shall be transferred to the customs offices in whose territory the offices of the customs offices have their registered office at the date of application of this Act.
6. The provisions in force before that date shall apply to proceedings initiated before the entry into force of this Act.
7. They shall be deleted:
(a) Government Decree No. 225 / 1994 Coll., laying down the customs crossing points at which the customs authorities check the travel documents.
b) Decree of the Ministry of Finance No. 135 / 1995 Coll., on the inclusion of office functions in the armed office in the customs administration.
The President of the Chamber of Deputies of the Parliament of the Czech Republic is hereby authorised to declare in the Collection of Laws the full text of the Act of the Czech National Council No. 13 / 1993 Coll., Customs Act, as amended by the Act No. 35 / 1993 Coll., as follows from the amendments and additions made by this Act.
This Law shall take effect on 1 July 1997.
