THE LAW
of 30 November 1967
on elections to the National Assembly
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
Basic provisions
The working people elect their representatives, politically and professionally advanced citizens, to be members of the National Assembly, capable of securing the tasks of the National Assembly, and to organise and unify the creative forces of the workers in their efforts to fully develop socialist society.
Elections to the National Assembly shall be held on the basis of the general, equal and direct voting rights by secret ballot.
(1) All citizens of the Czechoslovak Socialist Republic have the right to vote, who reached the age of 18 on the day of the election, regardless of nationality, gender, religion, employment, residence, social origin, property conditions and past activities.
(2) However, citizens who have been legally deprived of legal capacity for mental illness or whose legal capacity has been restricted for such a failure are not entitled to vote. *)
(3) Citizens who are in jail or in custody do not vote.
Any citizen of the Czechoslovak Socialist Republic who has the right to vote may be elected to the National Assembly and reached the age of 21 on the day of the election.
Voting lists
Entry into the electoral list
(1) All citizens of the Czechoslovak Socialist Republic who have the right to vote are included in the electoral list according to their place of residence.
(2) Citizens who, after drawing up a list of voters, acquire or lose their voting rights shall be added to or withdraw from the list of voters.
(3) Each voter can only be entered in one voter list.
Establishment of electoral lists
(1) The electoral lists are drawn up by the local (urban) national committee according to the constituencies.
(2) The electoral lists of members of the armed forces and the armed corps who are housed in the group shall be drawn up by their master.
Unloading of electoral lists
(1) No later than 30 days before the election date, the local (urban) national committee shall list the voters so that citizens can see them in the official rooms. The local (urban) national committee shall inform the citizens of the disembarkation of the electoral lists in the usual manner.
(2) In municipalities with more than 5000 persons on the electoral lists, the local (urban) national committee will arrange for a list of voters living in the house to be included in each house. The local (urban) national committee may also take such measures in municipalities with fewer than 5000 persons on electoral lists.
Opposition procedure
(1) Any citizen may, orally or in writing, draw the local (urban) national committee's attention to errors and irregularities in the electoral list and propose a correction. The local (urban) national committee shall decide on the alert within 3 days and either make the appropriate correction in the electoral list or inform the complainant in writing of the reasons why the correction cannot be made.
(2) If the application is rejected, the citizen may submit it to the district court responsible under the constituency. The provisions of the Civil Code on review of decisions of other institutions shall apply to proceedings. According to the court's decision, the local (urban) national committee will make a correction to the electoral list. Proceedings before a court shall not be subject to a judicial fee.
Election card
For serious reasons, voters who move from their voting lists to the election date to those who cannot vote in the constituency in whose electoral list they are registered shall issue a local (urban) national committee, at their request, and remove them from the electoral list. The Voting Card authorises the entry on the list of voters in another constituency. The registration is carried out by the local (city) national committee of the new residence (place of residence), on the day of the election by the District Election Commission. When writing, the voter card is removed and added to the voter list.
Election circuits
General provisions
(1) Elections to the National Assembly are held according to the constituencies.
(2) As a general rule, 4-8 Members are elected in the constituency.
Number of Members of the National Assembly
(1) 300 Members are elected to the National Assembly.
(2) The number of Members in the constituency must be defined in such a way that each Member of the National Assembly accounts for approximately the same number of voters.
Creating constituencies
(1) The Bureau of the National Assembly shall determine the constituencies and publish their list no later than 60 days before the election date.
(2) Election circuits are made up of whole counties, so they don't cross the border.
Election districts
(1) Election districts are created in the municipalities to receive ballots and count votes.
(2) Electoral districts and electoral rooms for each district shall be determined by the Council of the local (urban) national committee no later than 30 days before the election date.
(3) As a general rule, the electoral district is created to include around 1000 voters. For remote parts of the village, separate electoral districts can be created if there are at least 50 voters.
(4) Special electoral districts can be created in hospitals, births, sanitariums, welfare institutions, similar institutions and facilities, or parts thereof, but only if there are at least 50 voters.
(5) The forces of the armed forces and armed corps form special electoral districts, if they have at least 50 voters.
(6) Special electoral districts can also be created on Czechoslovak representative offices and ships.
Election Commission
General provisions
(1) The National Assembly elections are managed by the Central Election Commission of the National Front. The organisation of the Central Election Commission of the National Front in Slovakia is the Slovak Election Commission of the National Front.
(2) The election to the National Assembly is managed by the National Front Regional Election Commission in the capital of Prague and in the capital of Slovakia by the Bratislava City Election Commission of the National Front, which in their activities are subordinate to the Central Election Commission of the National Front. The provisions of this Law on Regional Elections Commissions apply mutatis mutandis to these City Electoral Commission National fronts.
(3) Elections in individual districts are governed by the Circular Election Commission.
(4) The votes in the various constituencies are managed by the District Electoral Commission.
(5) The Election Commission will be formed from representatives of the Communist Party of Czechoslovakia, other political parties and other social organisations of the National Front. The draft representatives shall be submitted by the competent authority of the National Front.
(1) Election commissions may be quorum if an absolute majority of members are present.
(2) The Election Commission shall act by an absolute majority; in the event of a tie, the chairman's vote shall be taken.
National Front Central Election Commission
(1) The National Front Central Election Commission shall be elected by the Bureau of the National Assembly no later than 55 days before the election date.
(2) The Central Election Commission of the National Front consists of the President, Vice-Presidents, Secretary and the necessary number of other members.
(1) Central Electoral Commission of the National Front, which manages elections to the National Assembly
(a) oversees the precise compliance with the rules on elections to the National Assembly;
(b) lay down the formula for voting tickets, the registration of the District Electoral Commission on the registration of candidates, the registration of the District Electoral Commission on the vote, the registration of the District Electoral Commission on the census of votes and the election certificate by a Member or an alternate;
c) focuses the proposals of the National Front Regional Election Commission on candidates for elections to the National Assembly;
d) announces the candidates of the National Front in the order they have set up to register with the District Election Commission;
(e) decide definitively on complaints concerning the maladministration of the electoral commission;
(f) ascertains the outcome of elections from all constituencies,
(g) forward the electoral files to the National Assembly Mandate Committee.
(2) The Central Election Commission of the National Front is managed by the District Election Commission for the National Assembly through the Regional Election Commission of the National Front.
Slovak Election Commission National Front
(1) The Slovak Election Commission of the National Front shall be elected by the Bureau of the Slovak National Council no later than 55 days before the date of election. She oversees the precise observance of the rules on elections in Slovakia and performs other tasks entrusted to her by the Central Election Commission of the National Front.
(2) The Slovak Election Commission of the National Front consists of the President, Vice-Presidents, Secretary and the necessary number of other members.
Regional Election Commission National Front
(1) The Regional Election Commission of the National Front, which manages the region of election to the National Assembly, is elected by the Regional National Committee no later than 55 days before the election date. It shall be elected by the National Committee at its plenary session, with the participation of representatives of the National Front and citizens.
(2) The Commission shall consist of the President, the Vice-President, the Secretary and the necessary number of other members.
Regional Election Commission National Front
(a) oversees the precise compliance with the rules on elections to the National Assembly;
(b) concentrate proposals on candidates in the region;
(c) discuss proposals for candidates at electoral meetings;
(d) decide on appeals against the decisions of the District Election Committees.
(1) The Regional Election Commission of the National Front decides on complaints about the incorrect procedure of the Circular Election Committees in the elections.
(2) An appeal may be lodged against the decision of the Regional Election Commission of the National Front with the Central Election Commission of the National Front.
Circular Election Commission
(1) The Council of the Regional National Committee, the Council of the National Committee of the Capital City of Prague and the Council of the National Committee of the Capital of Slovakia Bratislava shall set up an electoral commission no later than 50 days before the election date for each constituency.
(2) The Circular Electoral Commission consists of the President, Vice-President, Secretary and the necessary number of other members.
Circular Election Commission
(a) oversees the precise compliance with the rules on elections to the National Assembly;
(b) register candidates from the National Front;
(c) provide the district election committees with election ballots;
d) keeps an eye on the course of the elections, sums up the votes and finds out the other results of the election in the constituency,
(e) submit a report to the Regional Election Commission of the National Front on the outcome of the election in the constituency;
(f) issue an election certificate to the elected candidate;
(g) submit the electoral files to the Regional National Committee;
(h) decide on complaints about the misconduct of the district electoral commission. It is possible to appeal to the Regional Election Commission of the National Front against its decision.
Regional Electoral Commission
(1) For each electoral district, the council of the local (urban) national committee shall set up a district election committee no later than 30 days before the election date.
(2) The Commission is composed of the President, Vice-President, Secretary and between 4 and 8 other members. In constituencies with less than 300 voters, the District Electoral Commission has other members alongside the President and Secretary 2 or 3.
Regional Electoral Commission
(a) oversees the proper surrender of ballots and watches over the keeping of order in the voting room;
(b) establish the number of ballots on which all candidates have not been crossed out;
(c) to add the votes cast for each candidate of the National Front,
(d) write a minutes on the course of the election and count the votes, which it shall submit to the Circular Election Commission without delay;
(e) submit files of elections to the Regional National Committee.
Candidates
(1) Candidates for elections to the National Assembly are candidates for the National Front.
(2) The candidates are proposed by the Communist Party of Czechoslovakia, other political parties and other social organisations of the National Front. The proposals are submitted to the Regional Election Commission of the National Front, which will refer them to the Central Election Commission of the National Front.
(3) Candidates are designed for individual constituencies. More candidates can be proposed in each constituency than Members are to be elected.
(4) The Regional Election Commission of the National Front, which controls elections to the National Assembly, will introduce voters at meetings with proposals for candidates. They will also be presented with the proposal of candidates from citizens politically and professionally advanced, able to organise and unify the creative forces of workers that the National Front Central Electoral Commission intends to register. It shall ensure that the number of candidates proposed is, as a rule, one third to one half higher than the number of Members to be elected in the constituency. At the meetings, voters shall comment on the candidates proposed and shall also participate in their selection. On the basis of this discussion, the Central Electoral Commission will then draw up a proposal for candidates and their ranking.
Login of candidates of the National Front for registration
(1) The candidates of the National Front are registered by the Central Election Commission of the National Front. Applications shall be submitted to the relevant Election Commission no later than 30 days before the election date.
(2) National Front candidates are registered by constituency. No one can stand for election to the National Assembly in more than one constituency.
(3) The application shall state the order of the candidate and include his or her statement that he or she agrees to his or her candidacy. The application shall be accompanied by a report on the meeting of the organisation or assembly of voters where the candidate was proposed.
Registration of candidates National Front
The District Electoral Commission is required to register all duly applied candidates of the National Front in the order in which the Central Electoral Commission of the National Front has been registered.
Announcement
The District Electoral Commission shall publish the names, surnames, age, employment and residence of all registered candidates and their ranking no later than 25 days before the date of election to the National Assembly.
Voting lists
(1) All registered candidates must be listed on voting lists in the order in which they were registered.
(2) The ballot must state how many of the elected candidates will become Members in the constituency.
(3) The ballots must be in a specified form and be reproduced in sufficient quantities.
Membership of candidates in election committees
Candidates may not be members of district or district electoral committees where they are candidates.
Announcement of elections
Election Day
(1) The National Assembly election date shall be determined by the Bureau of the National Assembly no later than 60 days in advance.
(2) The elections to the National Assembly are held on the same day on the territory of the entire State. The elections take place on a day of work.
(3) The elections are held on a specified day from 7 a.m. to 16 p.m.. In the capital city of Prague, the cities which are the seats of regional and regional national committees, as well as in all municipalities with at least 10 000 inhabitants, elections take place on a specified day from 7 a.m. to 20 p.m. If local needs so require, the start of the elections may be set for an earlier hour.
Informing voters
(1) The Regional Electoral Commission shall inform voters in the last 15 days before the election date of the time and place of the election.
(2) In municipalities with more than 5000 persons on the electoral list, the District Electoral Commission will ensure that a legitimate ballot is drawn up for each voter showing the necessary voting data. At the same time, he will arrange for the legitimate ticket to be delivered to the electorate. The local (urban) national committee may provide that the same procedure shall apply to municipalities with fewer than 5000 registered voters.
Voting procedure
Preparations in the Election Room
The President of the District Electoral Commission shall check the ballot box and seal it before the election starts in the presence of the members of the Commission. It will also check whether a list of voters and ballots is ready. Then the vote will be taken.
Voting ballot boxes
Special spaces shall be designated in the ballot rooms in order to ensure the secrecy of the vote. No one must be present in these spaces at the same time as the voter or the electoral commission.
Voting time
(1) Each voter shall vote in person. Representation is not admissible.
(2) The voter who has arrived in the election room will submit a legitimate ticket and will receive a ballot after the entry in the electoral list. If the voter does not have a legitimate ticket and if he is not known to the District Electoral Commission, the Commission will ask him to prove his identity.
(3) A voter who has arrived in an election room with an electoral pass will be put on the electoral list by the District Election Commission. The record shall be signed by the President and the Secretary of the District Electoral Commission; Voting cards shall be connected.
Modification of ballots
(1) If the voter votes for the candidate, the ballot will leave his name and surname on the ballot. If he does not vote for the candidate, his name and surname will be crossed out. They put the ballot in the ballot box.
(2) A voter who is unable to adjust the ballot for a physical defect himself or because he cannot read and write, has the right to take with him a ballot space designed to modify another voter's ballots in order to modify the ballots for him as instructed.
Order in the Election Room
The President of the District Electoral Commission shall be responsible for the order of the election room. His instructions to maintain order in the polling room are binding on all present.
End of election
As soon as the hour set for the end of the vote has passed, the polling room shall be closed, but before that, all those who are in or before the voting room will be inferred. Then the President of the District Electoral Commission shall declare the vote closed and proceed to the opening of the ballot box.
Detection of election results
Who can be present at the count of votes in the District Election Commission
The members of the National Front Election Commission or the District Election Commission shall be present in the room where the votes are counted. Furthermore, citizens and representatives of the press and other mass information resources may be present, authorised by the National Front Election Commission.
