Slovak National Council
of 14 July 1960
on the Rules of Procedure and Conditions of Employment of the Slovak National Council
The Slovak National Council decided on this law:
Preliminary provisions
(1) The Slovak National Council is a national body of state authority and administration in Slovakia. It helps, under the leadership of the Communist Party of Czechoslovakia, to ensure the universal development of the economy and culture in Slovakia within the framework of the uniform exercise of state power and administration.
(2) The Slovak National Council exercises its powers to the extent determined by the Constitution to be an effective tool for the working people in securing political, economic and cultural tasks in Slovakia.
The authorities of the Slovak National Council are the Bureau of the Slovak National Council, the President of the Slovak National Council and the Commission of the Slovak National Council.
Slovak National Council
Scope of the Slovak National Council
The responsibility of the Slovak National Council shall include:
(a) to act in accordance with national law in the Slovak National Council in matters of a national or regional nature where special arrangements are required to ensure the universal economic and cultural development of Slovakia;
(b) to decide on the laws of the Slovak National Council in cases where the National Assembly empowers it by law;
(c) participate in the preparation of the State Plan for the Development of the National Economy and, within the framework of the State Plan, to discuss collectively the issues of the development of the National Economy and Culture in Slovakia;
(d) discuss and approve the budget of the Slovak National Council, its bodies and directly managed institutions in Slovakia;
(e) submit draft laws to the National Assembly;
(f) exercise control within the limits of its own competence;
(g) ensure, in a spirit of equality, favourable conditions for the universal development of the lives of citizens of Hungarian and Ukrainian nationality;
h) elect the Bureau of the Slovak National Council, the Commission of the Slovak National Council, the Chairman of the Slovak Planning Commission and the delegate of the Slovak National Council;
(ch) discuss the reports of the Bureau, the commissions and delegates of the Slovak National Council.
Meeting of the Slovak National Council
(1) The meeting of the Slovak National Council is convened by the Slovak National Council and declared to be concluded by the Presidency of the Slovak National Council. The Bureau of the Slovak National Council shall convene meetings of the Slovak National Council at least twice a year.
(2) If at a time when the Slovak National Council does not sit, at least one third of the members of the Slovak National Council request that the Slovak National Council be convened, the Presidency of the Slovak National Council shall be required to convene a meeting of the Slovak National Council so that the Slovak National Council shall meet within 14 days of the date on which the request was submitted.
(3) At the time of the meeting of the Slovak National Council, the President of the Slovak National Council calls the Slovak National Council for individual meetings.
Meetings of the Slovak National Council
The Slovak National Council, on a proposal from the Bureau of the Slovak National Council, approves the agenda and the way in which the individual items of the programme are discussed.
Speakers are generally given the floor in the order they applied for the floor. Every speaker has the right to speak in his mother tongue.
(1) The Slovak National Council is eligible for a resolution if an absolute majority of all Members are present. The consent of an absolute majority of Members present shall be required for the validity of the resolution.
(2) As a general rule, the vote is to be taken by hand, first voting on amendments.
(1) The Slovak national family meetings are essentially public.
(2) The Slovak National Council may decide, on a proposal from its President or the delegate of the Slovak National Council, that the meeting is not public.
Each meeting of the Slovak National Council will be prepared with a registration and a stenographic report. The minutes shall be verified by the Chairman of the Slovak National Council and the recorder.
Records shall be responsible for the accuracy and completeness of the minutes of the Slovak National Council meetings and shall assist in determining the results of the vote.
Bureau of the Slovak National Council
(1) The Presidency of the Slovak National Council is the executive body of the Slovak National Council within its competence.
(2) The Bureau of the Slovak National Council has 16 members. It shall be composed of the President of the Slovak National Council, its Vice-Presidents and other members of the Bureau.
(3) The Presidency of the Slovak National Council is elected by the Slovak National Council from among its members for the entire term. The Bureau shall remain in office after its term of office until the newly elected Slovak National Council elects its Bureau.
The Bureau of the Slovak National Council shall, in particular:
(a) ensure the implementation of laws and, in particular, ensure that the tasks of the State Plan in Slovakia are carried out evenly and in full compliance with the plan;
(b) discuss and comment on proposals for plans for the development of the economy and culture of individual regions in Slovakia, on proposals for regional budgets and on investment tasks exceeding the framework of the region;
(c) submit, on the basis of a proposal from the Financial and Budget Commission of the Slovak National Council, to the Slovak Planning Commission. The Slovak National Council draft budget of the Slovak National Council, its bodies and directly managed institutions in Slovakia and a resolution on the right of reference:
(d) discuss and address cultural policy issues in Slovakia in accordance with national interests; discuss and address issues of cultural activity by nationalities in Slovakia;
e) comment on the agricultural production sector on plans of central management organisations in Slovakia and on the draft plan for the scientific and research tasks of the Czechoslovak Academy of Agricultural Sciences;
(f) to discuss and submit draft laws to the Slovak National Council, either directly or after consulting the Commission of the Slovak National Council with its opinion of the Slovak National Council;
(g) to issue resolutions and regulations under the laws of the Slovak National Council and for their implementation;
h) submit draft laws to the Slovak National Council for consideration for the National Assembly;
(ch) manage and unify the work of the Slovak National Council commissions and delegates and discuss their reports and prepare proposals for the Slovak National Council meetings;
(i) check the work of the Slovak National Council commissions and delegates of the Slovak National Council and organise their control activities;
(j) manage and unify the activities of the Slovak National Council and assist in the work of regional associations of Members in the performance of their tasks;
(k) appoint and propose state officials in Slovakia to the extent determined by the Government;
(l) submit to the Slovak National Council a draft agenda for the meeting of the Slovak National Council and propose a programme and the duration of its meetings;
m) announce and secure supplementary elections to the Slovak National Council;
n) to decide on the permissible Members of the Slovak National Council;
o) modify the internal organisation and principles of the work of the Slovak National Council apparatus.
Meeting of the Bureau of the Slovak National Council
(1) The Bureau of the Slovak National Council shall meet at least once a month.
(2) The meetings of the Bureau of the Slovak National Council are private.
(3) The Bureau of the Slovak National Council shall be eligible for a resolution if an absolute majority of its members are present. A majority of the members of the Presidency of the Slovak National Council shall be required to adopt the resolution.
(4) Minutes of each meeting of the Slovak National Council Bureau shall be drawn up.
Chairman of the Slovak National Council
The functions of the President of the Slovak National Council include in particular:
(a) to convene and manage meetings of the Slovak National Council on the basis of a resolution of the Bureau of the Slovak National Council;
(b) to convene and manage meetings of the Slovak National Council Bureau and to propose a programme for their deliberations:
c) to represent the Slovak National Council on External Affairs;
d) sign the laws and resolutions of the Slovak National Council,
(e) report to the Slovak National Council on the activities of the Bureau of the Slovak National Council.
Commission of the Slovak National Council
(1) The Slovak National Council establishes the Commission of the Slovak National Council for each section of its activities.
(2) The Commission of the Slovak National Council is the initiative, control and executive bodies of the Slovak National Council.
(1) The Slovak National Council establishes the following Commission of the Slovak National Council:
Slovak Planning Commission,
the Financial and Budgetary Commission of the Slovak National Council,
Commission of the Slovak National Agriculture Council,
Commission of the Slovak National Construction Council,
Commission of the Slovak National Council for Education and Culture,
Commission of the Slovak National Health Council,
the legal commission of the Slovak National Council; and
the mandate committee of the Slovak National Council.
(2) To discuss certain issues, the Slovak National Council may set up a temporary commission of the Slovak National Council.
(1) The Slovak National Council determines the number of members of the individual commissions of the Slovak National Council and elects the chairmen of the commissions and their members.
(2) The Slovak National Council elects the members of the Commission of the Slovak National Council for the entire term and may at any time withdraw them.
(3) Members of the Commission of the Slovak National Council are members of the Slovak National Council and political, economic, cultural and other workers, usually two thirds of the members of the Slovak National Council commissions are members of the Slovak National Council.
(4) Only Members of the Slovak National Council may be members of the mandate committee.
(1) The Slovak National Council usually elects the delegates of the Slovak National Council as chairman of the Commission of the Slovak National Council.
(2) The Chairman of the Slovak Planning Commission is the Vice-President of the Slovak National Council.
The responsibility of the Slovak National Council commissions shall include in particular:
(a) monitor and act on the performance of the tasks arising from the economic and cultural development of Slovakia, help them to secure and present their resolutions and proposals to the Slovak National Council and its Bureau;
(b) participate in the drafting and examination of proposals submitted to the Slovak National Council and its Bureau;
(c) monitor and monitor compliance with the resolutions of the Party and the Government and the resolutions and measures of the Slovak National Council and its Bureau;
(d) discuss and comment on their sections to implement national economic and cultural development plans in Slovakia, to mobilise workers to carry out the tasks of the plan and to propose measures to address deficiencies;
(e) discuss the tasks assigned to them by the Slovak National Council, the resolution of the Slovak National Council and its Bureau, as well as the issues addressed within the scope of the Slovak National Council on its own initiative;
(f) to take decisions in respect of institutions directly governed by the Slovak National Council, unless such decisions are attributable to the Slovak National Council or its Bureau.
In their activities, the Slovak National Council commissions rely on cooperation with workers and their organisations, working closely with the Revolutionary Trade Union Movement in particular, taking advantage of experience, comments and incentives working for their work.
Slovak Planning Commission
(1) The Slovak Planning Commission is the body of the Slovak National Council and the regional body of the State Planning Commission.
(2) The Slovak Planning Commission is responsible for:
(a) draw up, on the basis of the guidelines of the Communist Party of Czechoslovakia and the Government, in accordance with the guidelines of the State Planning Commission in cooperation with it and with the ministries, the Regional National Committees in Slovakia, proposals for the overall development of the national economy in Slovakia in the framework of long-term, five-year and annual plans for the development of the national economy and submit them to the Slovak National Council and the State Planning Commission;
(b) submit to the State Planning Commission proposals, analyses and supporting documents concerning the overall development of the economy, the development of individual production sectors, the growth of the material and cultural level of the population, the deployment of production forces and the development of individual areas in Slovakia.
(3) The government will determine the activity and organisational structure of the Slovak Planning Commission by a special statute.
Mandate Commission of the Slovak National Council
The Mandate Commission of the Slovak National Council prepares and presents proposals to the Slovak National Council to validate the election of the Slovak National Council.
Meetings of the Slovak National Council commissions
(1) The opening and other meetings of the Commission of the Slovak National Council are convened and chaired by the Chairman of the Commission of the Slovak National Council.
(2) The Commission of the Slovak National Council meets in accordance with the approved work plan and as appropriate.
(3) At the opening meeting, the Commission of the Slovak National Council will elect a Vice-Chairman and Receiver from the Slovak National Council.
The Commission of the Slovak National Council is competent to decide if an absolute majority of its members are present. The agreement of an absolute majority of the members present shall be required for the validity of the resolution.
(1) The meetings of the Slovak National Council commissions are private. On a proposal from the President of the Slovak National Council or the Chairman of the Commission of the Slovak National Council, the meeting of the Commission of the Slovak National Council may be declared secret.
(2) In such a case they may be present in addition to the members of the Commission of the Slovak National Council and the members of the Bureau of the Slovak National Council of other persons only with the agreement of the President of the Slovak National Council or the chairman of the relevant Commission of the Slovak National Council.
The Commission of the Slovak National Council may create subcommittees to prepare certain questions. The composition of the subcommittee shall be determined by the Commission of the Slovak National Council in order to ensure a comprehensive assessment of the relevant question. The Commission of the Slovak National Council shall appoint one of its members as Chairman of the Subcommittee. Other members of the subcommittee may not be members of the Slovak National Council.
(1) The Commission of the Slovak National Council may invite other co-workers to its meetings, both Members who are not members of the Commission and other staff, in particular experts, scientists, civil servants and representatives of workers' organisations.
(2) Members of the Slovak National Council, who are not members of the Commission of the Slovak National Council, may be present at the meeting of the Commission of the Slovak National Council or of the sub-committee - if not declared secret - and have an advisory vote.
(1) The Commission of the Slovak National Council is working together and helping each other at work.
(2) The Commission of the Slovak National Council may act jointly and submit joint reports or proposals to the Slovak National Council and its Bureau, if it requires interest.
The Commission of the Slovak National Council may request explanations, information and other supporting documents from public authorities and other public bodies. To this end, they may also carry out surveys within the limits of their competence. The subcommittees have the same authority.
(1) The Commission of the Slovak National Council shall report to the Slovak National Council and its Bureau on its activities.
(2) The Commission of the Slovak National Council of the Bureau of the Slovak National Council, which will discuss them and report on them to the Slovak National Council.
If the resolution or measure of the Commission of the Slovak National Council is contrary to the resolution or measures of the higher authorities, the Bureau of the Slovak National Council may revoke it.
Members of the Slovak National Council
Members of the Slovak National Council shall have the right:
(a) submit draft laws and other proposals to the Slovak National Council;
b) raise questions with representatives of the Slovak National Council, the President of the Slovak National Council and the Bureau of the Slovak National Council. Questions may be oral or written; the enquiries shall answer questions within 30 days at the latest;
(c) require the authorities and other bodies to provide the explanations necessary for their activities.
Members of the Slovak National Council shall:
(a) to work in their constituency, to file regular accounts of their activities and to report to them on the activities of the Slovak National Council; to explain to voters the importance of the laws approved by the National Assembly and the Slovak National Council, thereby causing state and economic authorities and citizens to comply with the laws; in daily life to verify how the laws are implemented and how they are proven;
(b) to take account of the proposals, complaints and wishes of citizens and to apply the experience gained in contact with citizens in the Slovak National Council and its bodies:
(c) to work closely with national committees and workers' organisations and to assist them in the implementation of the laws and resolutions of the Party and of the Government, in particular by acquiring citizens of their constituencies to carry out active tasks of socialist construction and by developing the creative forces of workers.
(1) Members of the Slovak National Council are obliged to participate in all the work of the Slovak National Council, in particular the meetings of the Slovak National Council and its commissions and subcommittees. Each Member of the Slovak National Council is obliged to work on a committee of the Slovak National Council.
(2) If a Member of the Slovak National Council cannot participate in the work of the Slovak National Council or its bodies, he must apologise.
(3) A Member of the Slovak National Council may apply for leave for important reasons.
Members of national committees and citizens and workers' organisations support and assist the Slovak National Council in their work.
Regional Association of Members and Council of Members of the Slovak National Council
(1) In the interests of the best possible performance of their work, members of the Slovak National Council shall be joined in a regional association of Members.
(2) At meetings of regional associations of Members, directives for the work of Slovak National Council Members in their constituencies are discussed, their activities are coordinated, their methods of work are evaluated, their work is exchanged and experience in their activities is generalized and other tasks are determined.
The Presidency of the Slovak National Council and representatives of the Regional Association of Members - Members of the Slovak National Council - form the Council of Members of the Slovak National Council. Each regional association of Members sends one representative to the Council of Members of the Slovak National Council. The President of the Slovak National Council may invite other members of the Slovak National Council to the Council of the Slovak National Council.
(1) The Council of Members of the Slovak National Council assists the Bureau of the Slovak National Council in ensuring the proper functioning of the work of the Slovak National Council, in coordinating the work of regional associations of Members and in monitoring and coordinating the activities of the Slovak National Council in electoral districts.
(2) The work of the Council of Members of the Slovak National Council is managed by the President of the Slovak National Council.
Negotiations on bills
Draft laws of the Slovak National Council may be submitted by Members, Commission and Bureau of the Slovak National Council.
(1) All draft laws of the Slovak National Council submitted to it for consideration shall contain a precise wording of what the Slovak National Council is to act on and shall be accompanied by a budget on the financial scope of the outline with the proposal for reimbursement of the necessary costs, in accordance with the budgetary act.
(2) Whether a draft law of the Slovak National Council, submitted by a Member or by an individual Member of the Slovak National Council, is to be the subject of a meeting of the Slovak National Council, the Bureau of the Slovak National Council is to decide. If the Presidency of the Slovak National Council rejects the proposal, Members (Member) of the Slovak National Council may request that the proposal be put on the agenda for the next meeting of the Slovak National Council. Such a request shall be decided by the Slovak National Council by voting without debate.
The draft laws of the Slovak National Council, which are to be the subject of negotiations of the Slovak National Council, shall be assigned by the Bureau of the Slovak National Council to the competent Commission of the Slovak National Council, unless it is left to its own discretion or is directly discussed by the Slovak National Council.
(1) In order to discuss the draft law of the Slovak National Council allocated to the Commission of the Slovak National Council, the President of the Commission of the Rapporteur, who will report to the Slovak National Council on the outcome of the meeting of the Commission of the Slovak National Council. In addition to the lead rapporteur, the rapporteur may also be designated for each part.
(2) If several Slovak National Council commissions discuss the same draft law, the rapporteur or rapporteurs may report, agreed by the chairman of the Slovak National Council commissions.
The laws of the Slovak National Council shall be published by the Bureau of the Slovak National Council within 14 days of their approval. It declares them in the Collection of Laws of the Czechoslovak Socialist Republic.
