Decree of the Minister for the Interior
of 29 May 1948
issued by the new Firearms Exchange Statutes.
Under Section 4 of the Decree of 15 September 1943, No. 257 Coll., on the Fire Department, I declare in agreement with the Ministers of Finance, Industry, Internal Trade and Social Welfare:
New Statutes, as set up by Decree-Law No 257 / 1943 Coll., are hereby issued for the Fire Department, which are annexed to this Order.
The applicability of the Order of the Minister of the Interior of 20 September 1943, No 258 Coll., to which the Statutes of the Firearms Exchange are issued, is hereby revoked.
This decree is valid only in Czech and Moravian-Silesian countries and takes effect on 1 June 1948.

Fire department headquarters.
Name, legal nature and seat.
The Fire Department (hereinafter referred to as the Central Office), established by Government Decree No 257 / 1943 Coll., is a corporation of public law and has its seat in Prague.
Purpose.
The Centre shall be entitled - including for non-members - to provide for the purchase, sale, testing and acceptance of fire-fighting equipment and other fire-fighting needs, to co-operate under the guidelines of the Ministry of the Interior in the standardisation and characterisation of fire-fighting equipment and to provide evidence for the production of such equipment.
Members.
(1) Members of the Centre are municipalities as carriers of fire protection costs.
(2) Undertakings with their own fire protection may be accepted as members at their own request.
Develop resources.
(1) The basic asset of the Centre is the property of the fire brigade, liquidated under Section 10 of the Government Decree of 3 January 1942, No 31 Coll., on the fire protection tax administered by the Centre, as well as other income, according to the principles of commercial management.
(2) Net profit will be used:
(a) to supplement the general reserve fund, the amount of which shall be determined by the Ministry of the Interior in agreement with the Ministry of Finance and the Supreme Accounting Audit Office;
(b) for the purpose of preventive fire protection, to support firefighting, in particular to carry out all the tasks of organising fire services, training, training and training of fire brigades.
Part of the profit that is intended to support firefighting shall be allocated to each country in proportion to the gross turnover achieved in that country.
(3) Members may be required to pay contributions only if the proceeds of their business activities are not sufficient to carry out the tasks of the Centre and it is not possible to cover losses arising from the general reserve fund or borrowing. Order of the Administrative Committee on the determination of the contribution of members must be submitted to the Ministry of the Interior for approval pursuant to § 3 of Decree No. 257 / 1943 Coll.
Sales and sales agents.
(1) With the agreement of the Ministry of Interior in agreement with the Ministry of Internal Trade, the Centre may set up shops at the premises of the existing Earth Fire Unions and, where necessary, appoint its own commercial representatives in each district.
(2) Sellers shall provide a normal business agenda and tasks specifically entrusted to them by the Administrative Committee in accordance with the guidelines and instructions of the Centre. Sales representatives shall facilitate contact between customers and the Centre or its stores.
(3) For the testing of fire-fighting equipment, the Centre may, with the agreement of the Ministry of Interior, set up and maintain specific equipment.
Organs.
(1) The institutions of the Centre are the Administrative Committee, the President and the Deputy President.
(2) The functions of the members of the Administrative Committee are honorable. However, according to the guidelines of the Administrative Committee, approved by the Ministry of Interior, the Centre may provide them with the means to reimburse the actual expenses associated with the performance of this function.
Organ formation.
(1) The Administrative Committee shall be composed of:
(a) of two representatives of the volunteer fire department,
(b) of 1 representative of the professional firefighter,
(c) two representatives of the municipalities.
(2) The members of the Administrative Committee and their alternates shall be appointed by the Ministry of the Interior, as regards the representatives referred to in points (a) and (b) of the preceding paragraph, on the proposal for the appropriate organisation of the firehouse and, as regards the representatives of municipalities, the respective headquarters of municipalities, cities and districts. An alternate shall be appointed for each member of the Administrative Committee. When appointing members and alternates, account shall be taken of the relative number of representatives from that country in the Administrative Committee.
(3) The Chairman of the Administrative Committee and his Deputy Director shall be elected by the Administrative Committee from among the representatives of the fire department.
(4) The term of office of the members of the Administrative Committee shall be three years. The period of the First Administrative Committee may be fixed until 31 December 1950. The Ministry of the Interior may itself, after hearing the relevant interest organisation or on its proposal, relieve a member (alternate) of his or her duties if he or she fails to exercise it or if there are other serious reasons. If a member of the Administrative Committee loses his / her duties during his / her term of office, a new member shall be appointed for the remainder of the term of office in accordance with the provisions of paragraph 1. 2. In case of temporary employment, a member shall be represented by his alternate.
(5) The rules of procedure at which the Administrative Committee shall act shall be laid down in more detailed provisions on the competence, negotiation and resolution of the Centre's institution, unless they are already apparent from these Statutes. The Rules of Procedure require the approval of the Ministry of Interior.
The Administrative Committee.
(1) The Administrative Committee is responsible for deciding on all matters relating to the Centre, unless they are dealt with by the President or the Head of Officer of the Centre (§ 10 (2)). Further details shall be laid down in the Rules of Procedure. The prior approval of the Ministry of Interior is needed to dispose of and load real estate and to close borrowings. Certain tasks, in particular as regards management and supervision of stores, may be entrusted by the Administrative Committee to one or more of its members, after the case of alternates.
(2) The Administrative Committee shall meet at least once a month. At least three members shall be required to act in force. Where possible, all the ingredients from which the Committee is appointed shall be represented; when discussing the final accounts, the distribution of net profit and other important issues of organisation and operation of the Centre, it shall be ensured that at least 1 member or alternate from the Moravian-Silesian country is present. At least 3 votes shall be required for the resolution to be valid.
Chairman.
(1) The President of the Administrative Committee shall represent the Centre on the outside and sign on its behalf, together with another member of the Committee and the Head of the Centre's Office, all documents committed by the Centre. Other documents shall be signed by the Head of the Centre itself.
(2) The President shall convene and manage meetings of the Administrative Committee, prepare and implement its resolutions, arrange, unless the Head of Officer of the Centre, ordinary administrative matters of the Centre and its staff, and supervise the business activities of the Centre. It shall decide, within the limits of the approved budget, on expenditure not exceeding CZK 10,000 per case. The right of reference shall be exercised by the President together with the Head Officer of the Centre. The office of the Center is at his disposal.
(3) If there is a danger of delay or loss, the President may decide and take the measures which fall within the competence of the Administrative Committee, but shall be obliged to report it subsequently at the next meeting of the Committee.
(4) The Deputy Chairman of the Administrative Committee shall represent the President if he is temporarily occupied or taken. If the meeting of the Administrative Committee is not present, neither the Chairman nor his deputy shall be chaired by the oldest member present.
Staff.
(1) The Centre staff are in a private relationship. The Administrative Committee shall decide on their admission, redundancies and their employment and pay arrangements in accordance with the applicable rules and directives.
(2) The Head Officer of the Centre shall be appointed by the Ministry of the Interior to draft the Administrative Committee; its representative and senior sales officials shall be appointed by the Administrative Committee on the proposal of the Head of Officer of the Centre. It is for the Head Officer of the Centre to receive regular administrative and commercial work related to the business activities of the Centre in accordance with the instructions and guidelines of the Administrative Committee and its Chairman. It shall also take part in the advisory meetings of the Administrative Committee and shall regularly give it an overview of the economic situation and activities of the Centre. The Head Officer of the Centre shall be personally responsible to the Administrative Committee for the proper functioning of the Centre within the limits of his or her competence. They may not, without the approval of the Administrative Committee, operate or otherwise engage in any gainful activity or business on their own account or on a foreign account.
(3) The Head Officer of the Centre may also take measures which would otherwise be the responsibility of the Administrative Committee, provided that there is a direct risk of delay or commercial loss and that the decision of the Chairman of the Administrative Committee cannot be taken; However, it shall report the matter as soon as possible to the Chairman of the Administrative Committee, who shall inform the Administrative Committee thereof.
Financial economy.
(1) The administrative year of the Centre coincides with the calendar year.
(2) The Chairman of the Administrative Committee shall draw up, in consultation with the Head of the Centre, at the latest one month before the beginning of the new administrative year, the budget and the economic plan for the following year and by the end of February of the new administrative year, the final account for the last year in which the operation of the outlets will be recorded, together with a detailed annual report. The budget, the economic plan and the final account shall be approved by the Administrative Committee.
(3) Within 3 months of the end of the administrative year, the Central Bureau shall submit an approved budget, an economic plan and a final account with an annual report to the Ministry of the Interior and to the Supreme Audit Office. The budget and the closing account shall require the confirmation of the Ministry of Interior for their validity.
Surveillance.
(1) The Ministry of the Interior may, at any time, convince itself of the activities and economy of the Centre in a manner which it considers appropriate and take the measures necessary to remedy the deficiencies identified and to lead the administration properly. It may also attend its representative meetings of the Administrative Committee.
(2) In order to ensure the supervision referred to in the preceding paragraph, the Centre shall always notify the Ministry of Interior at least 5 days in advance of the date and place of the meeting of the Administrative Committee and its agenda and send a copy of the minutes of the meeting of the Committee.
(3) A representative of the Ministry of the Interior may request a postponement of the execution of the administrative committee's resolutions if he is contrary to the rules in force or endangers the operation of the Centre and the submission of the matter to the Ministry of the Interior.
(4) The central office will reimburse the State Treasury for the costs of State supervision, the amount of which is determined by the Ministry of Interior.
Representation before the courts.
It shall be represented before the courts by the Financial Prosecutor's Centre, which, if necessary, shall provide it with other legal assistance upon request.
