of 11 February 2004
on a national programme for reducing emissions of solid pollutants, sulphur dioxide and nitrogen oxides from existing particularly large combustion stationary sources of air pollution
The Government mandates pursuant to § 6 (3) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act) ("the Act '):
§ 1
In accordance with the law of the European Communities (1), this Regulation establishes a national programme for reducing emissions of solid pollutants, sulphur dioxide and nitrogen oxides from existing particularly large combustion stationary sources of air pollution (hereinafter referred to as the "National Programme '); Annexes 1 to 3 to this Regulation specify the existing particularly large combustion stationary sources; Annex 4 to this Regulation sets out the group emission ceilings and the time limit for achieving them in order to improve air quality by reaching the limit of imitation laid down in the specific legislation2) for the above pollutants.
§ 2
(1) The permanent cessation of operation of any source listed in Annex 1 or Annex 2 to this Regulation, or the permanent reduction of its rated thermal input below 50 MW, is excluded from Annex 1 or Annex 2 to this Regulation and the group emission ceilings listed in Annexes 4 and 5 to this Regulation are reduced by its share of emissions.
(2) By stopping the operation of any of the sources listed in Annex 3 to this Regulation or by permanently reducing its rated thermal input below 500 MW, that source shall be excluded from Annex 3 to this Regulation.
§ 3
(1) The operators of the sources listed in Annexes 1 and 2 to this Regulation shall submit for approval, within the time limit laid down in Article 54 (7) of the Act, a plan for reducing emissions of solid pollutants, sulphur dioxide and nitrogen oxides from existing sources (hereinafter referred to as the "emission reduction plan").
(2) The approval of the emission reduction plan is without prejudice to the obligation to comply with specific emission limits at source for designated pollutants under a specific legislation, 3) or with specific emission limits set by the operator of that source in the operating rules.
§ 4
The emission reduction plan shall also include an assessment of the possibility of further reducing emissions of solid pollutants, sulphur dioxide and nitrogen oxides from the source, indicating the necessary measures, including the implementation process and compliance with the emission ceilings set out in Annex 5 to this Regulation for solid pollutants, sulphur dioxide and nitrogen oxides within the territory of the relevant region.
§ 5
(1) In the emission reduction plans for the sources listed in Annex 1 to this Regulation, the annual emissions of solid pollutants, sulphur dioxide and nitrogen oxides shall not exceed the average annual emissions of these substances for the years 2000 to 2002. This is based on the assumption that there will be no increase in the specific sulphur content of the fuel above the average level for the years 2000 to 2002 from 2004 onwards. In the event that this assumption is not met, the emission reduction plan shall specify the procedure by which, by mutual agreement between the operators of the sources concerned, the increase in sulphur dioxide emissions, including its justification, will be compensated.
(2) In the case of an agreement according to which the corresponding amount of emissions at another source from Annex 1 or Annex 2 to this Regulation shall be reduced by no more than the limit values for sulphur dioxide, solid pollutants (10 µm or less of the size fraction), nitrogen oxides and nitrogen dioxide under special legislation2), or any other deterioration of the current level of air pollution shall be exceeded by the relevant regional sulphur dioxide ceiling under the specific legislation4. The agreement is part of the emission reduction plan.
(3) In the event of a change in the operating conditions of the source, the operator shall propose an amendment to the already approved emission reduction plan.
§ 6
Annex 2 to this Regulation lists the sources with binding emission ceilings for sulphur dioxide. For these sources, where appropriate, an adjustment plan shall be provided to allow, while maintaining the total emission ceiling, to vary emissions from individual sources for the same operator within the territory of the relevant region. These measures shall not exceed the limit of the limit of the limit of the limit for sulphur dioxide, solid pollutants (size fraction 10 µm or less), nitrogen oxides and nitrogen dioxide in accordance with the special legislation.2).
§ 7
Where this is not excluded for technical reasons, the requirements for nitrogen oxides set out in Annex 3 to this Regulation shall apply from 1 January 2016 to source operators with a rated thermal input above 500 MW listed in Annexes 1 and 2 to this Regulation. Where compliance with these requirements is not possible, a reduction of emissions corresponding to the difference between the fixed emission ceiling and the actual emissions from the source shall be ensured in accordance with the procedure laid down in Article 5 (1).
§ 8
(1) In the case of existing sources located in a degraded area under Section 7 (1) of the Act for suspended particles or for oxides of nitrogen, the reduction plan includes an assessment of the impact of the source on the immunological concentrations of those pollutants and, where necessary, a proposal for additional measures to limit emissions of sulphur dioxide, solid pollutants and nitrogen oxides in order to contribute to the achievement of the limit limits for sulphur dioxide, suspended particles, nitrogen oxides and nitrogen dioxide laid down by specific legislation.2)
(2) The procedure referred to in paragraph 1 shall also apply to those sources which are not located in an area of impaired air quality but which are involved in exceeding the health or environmental and vegetation limits due to remote transmission of their emissions.
§ 9
This Regulation shall enter into force on the day of its publication.
