Decree of the Ministry of Agriculture on the method of carrying out the classification of carcases of pigs for slaughter and the conditions for issuing certificates of competence of natural persons for that activity

on the procedure for carrying out the classification of carcases of pigs for slaughter and the conditions for issuing certificates of professional competence for that activity
According to Article 18 (n) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, as amended by Act No. 306 / 2000 Coll., (hereinafter referred to as "the Act"):
§ 1
Method of implementation of the classification
The classification of carcases of pigs for slaughter shall be carried out in accordance with the procedure laid down in this Order at all slaughterhouses, 1) except for slaughterhouses which slaughter fattening pigs for slaughter and which do not put into circulation carcases. (2) The classification shall not be carried out on carcases of pigs for slaughter obtained by slaughter. (3)
§ 2
Basic concepts
For the purposes of this decree:
(a) by a classifier, a person meeting the conditions for the implementation of the classification laid down by law and by this decree, which carries out the classification of carcases of pigs for slaughter in the quality classes and labelling of carcases referred to in Article 5;
(b) two carcases belonging to each other, with head, kidney fat and rind, without cuts of the eyes and ears, brain, spinal cord, diaphragm, kidney, sex organs, spades, thoracic, abdominal and pelvic organs removed even with attached fat.
§ 3
Classification
(1) In the case of carcases weighing between 60 and 120 kg, the classification of the carcases shall be carried out by classifying the carcase in the quality class on the basis of the determination of the proportion of muscle in relation to the total weight of the body assessed. Each quality class is given in Annex 1, Table 1.
(2) Carcasses which do not correspond to the weight referred to in paragraph 1 or which are solid sows, butchers, thin sows, thin butchers, boars or cryptorchids shall be classified in the quality classes and according to the requirements laid down in Annex 1, Table 2. The percentage of muscle referred to in Article 4 shall not be fixed for these carcases.
(3) No fat, muscle or other tissue may be removed from the carcase referred to in Article 2 (b) before weighing, sorting and marking.
(4) The classification of the carcase in the class shall be carried out after veterinary inspection and shall be valid for the whole carcase.
§ 4
Determination of muscle content
(1) The muscle content of the carcase is determined in a manner consistent with the procedure laid down in CSN 46 6160.
(2) In slaughterhouses with an average weekly slaughter of up to 400 head of slaughter pigs, the proportion of muscle may be determined by a two-point method corresponding to the procedure referred to in Article 4.2 (1) of ČSN 46 6160.
§ 5
Identification of the carcase by quality class
(1) After classification of the carcase in the quality class referred to in Article 3, the marking of the carcase shall be carried out in a non-toxic, non-washable, indelible colour or by another method approved by the veterinary authorities.
(2) The designation referred to in paragraph 1 shall be made:
(a) by the letter of the relevant quality class referred to in Annex 1; or
(b) a percentage of the muscle content determined in accordance with Annex 1 to Table 1.
(3) The mark of the carcase shall be made on the skin of the leg or back leg of each half of the pig. The letters or digits shall be at least 20 mm high and clearly legible.
§ 6
Classification protocol
(1) The classifier shall issue a classification report (hereinafter referred to as "the protocol") on the classification carried out. The model of the Protocol is set out in Annex 2.
(2) The Protocol is to be drawn up for the whole group of pigs for slaughter from one supplier delivered on one day.
(3) The classifier shall keep the original of the protocol for at least six months from the date of issue. One copy of the protocol shall be transmitted by the classifier
(a) suppliers of pigs for slaughter;
(b) slaughterhouses where classification is carried out;
(c) the person authorised to keep a central register of livestock in accordance with the special legislation.4)
§ 7
Training
(1) The training of natural persons for the implementation of the classification of carcases (hereinafter referred to as "the applicant") is provided by the Ministry of Agriculture (hereinafter referred to as "the Ministry") through the Research Institute of the Animal Production of Uhroneves.
(2) The applicant submits an application for training to the Ministry. The model of the application is set out in Annex 3.
(3) Within 14 days of receipt of the application, the Ministry shall notify the applicant in writing of the time and place of training.
(4) Before training, the applicant shall receive a range of subjects to be the subject of training, including a list of recommended study literature.
(5) Training consists of theoretical lectures and practical training. At the end of the training, the candidate shall take a vocational examination (hereinafter referred to as "the test ') consisting of a theoretical and practical part.
(6) After successful completion of both theoretical and practical part of the examination, the candidate shall receive a written proof of completion of the professional examination on the day of the examination.
§ 8
Expert test
(1) The examination shall be composed before a three-member examination committee appointed by the Ministry (hereinafter referred to as the "Examination Committee"), in such a way that the chair is always the representative of the Ministry; the other members are experts of the Ministry or of the Research Institute of the Animal Production of the Uhraneves.
(2) The Chairman of the Examination Board shall direct its actions; decide on the issues in question relating to the examination.
(3) The examination committee shall be bound by a set of questions set by the Ministry for the examination.
(4) If the candidate does not pass the test, the test may be repeated not earlier than 30 days and not more than 6 months after the date of the unsuccessful test.
(5) The corrective test shall only be carried out by the tenderer on the part in which he has failed.
(6) Candidates who could not attend the test or repair test for a serious reason shall be given a replacement date.
§ 9
Conditions for issuing a certificate of competence
(1) The certificate of competence (hereinafter referred to as the certificate) shall be issued by the Ministry to the person carrying out the classification no later than 30 days from the date of the examination on the basis of:
(a) documentary evidence of completion of the professional examination;
(b) the presentation of a certificate that it has at its disposal a classification instrument which complies with the classification method and has its type-certificate and marking, 5)
(c) medical certificate, 6)
(d) proof of completion of secondary school;
(e) proof of two years' experience in livestock farming or meat processing.
(2) The certificate issued by the Ministry shall include the personal number assigned to the classifier.
(3) The certificate shall be valid for two years from the date of issue. The Ministry may withdraw the certificate from the classifier only if it finds that the classifier performs the classification in a manner that does not correspond to the procedure laid down in this Decree.
(4) The classifier may request the Ministry to extend the validity of the certificate ("the application").
(5) The application may be lodged not earlier than 3 months before the expiry of the certificate. The application shall be accompanied by the documents referred to in Article 9 (1) (b) and (c).
(6) The Ministry will assess whether the conditions for issuing the certificate referred to in Article 9 (1) (b) and (c) continue to be fulfilled; if applicable, extend the certificate for a further 2 years. The Ministry shall decide on the application within 30 days of the date of the application.
(7) In the event that, during the period of validity of the certificate, the classifier has no longer qualified to carry out the classification because it no longer fulfils the conditions laid down in Article 9 (1) (b) or (c), or has interrupted the performance of the classifier, it shall notify the Ministry of this fact no later than 30 days after the date on which it became aware of that fact.
§ 10
Transitional provision
Slaughterhouses with an average weekly slaughter of 400 or more pieces of slaughter pigs which, on 1 April 2001, carry out a classification by a two-point method using an electromechanical scale may use this method of classification no later than 31 December 2001.
§ 11
Efficacy
This Decree shall take effect on 1 April 2001.
