THE LAW
of 18 March 1998
amending and supplementing Act No. 140 / 1961 Coll., Criminal Act, as amended, and Act No. 200 / 1990 Coll., on Infringements, as amended
Parliament has decided on this law of the Czech Republic:
Act of the Czech National Council No. 200 / 1990 Coll., on infringements, as amended by the Act of the Czech National Council No. 337 / 1992 Coll., Act of the Czech National Council No. 344 / 1992 Coll., Act of the Czech National Council No. 359 / 1992 Coll., Act No. 67 / 1993 Coll., Act No. 290 / 1993 Coll., Act No. 134 / 1994 Coll., Act No. 82 / 1995 Coll., Act No. 237 / 1995 Coll., Act No. 279 / 1995 Coll., and Act No. 289 / 1995 Coll., is amended as follows:
1. In Article 30 (1) (b), the words "is alcohol 'are replaced by the words" are narcotic substances, psychotropic substances and alcohol'.
2. in Article 30 (1) (e), the following shall be inserted after the words "other addictive substances": "other than narcotic and psychotropic substances."
3. in Article 30 (1), the following point (f) is inserted after point (e):
"(f) allows the illicit consumption of narcotic drugs and psychotropic substances to a person under the age of 18, if not more severely punishable,"
Points (f) to (ch) shall be renumbered as points (g) to (i).
4. in Paragraph 30 (1) (h) and (ch), the words "(f)" shall be replaced by the words "(g)."
5. in Article 30 (1) (i), the dot at the end is replaced by a comma and the following point (j) is added:
"(j) improperly stored in small quantities for its use by a narcotic or psychotropic substance."
6. In Article 30 (2), the words "(e) and (f) 'are replaced by the words" (e) to (g)'; the words "(g) 'are replaced by the words" (h)'; the words "within one year and for the offence referred to in paragraph 1 (h) and (ch) are replaced by the words" within two years'; (j) fine up to 15 000 CZK. "
7. Paragraph 52 (c) reads as follows:
"(c) the authorities of the Police of the Czech Republic (hereinafter referred to as the" police authorities "), when it concerns offences committed by infringement of legislation on the safety and fluidity of road traffic and offences in the area of protection against alcoholism and other toxic substances referred to in Article 30 (1) (j),"
8. In Section 54, the words "generally binding 'are deleted and the words" in block proceedings' are inserted after the words "in block proceedings':" and offences on the section for the protection against alcoholism and other toxic substances referred to in Section 30 (1) (j) '.
9. in § 58 (2) (f), "§ 30 (1) (d) to (ch)" is replaced by "§ 30 (1) (d) to (j)";
10. in Article 86 (a), "§ 30" is replaced by "§ 30 (1) (a) to (i)" and in point (b) "§ 30 (1) (f), (g) and (ch)" is replaced by "§ 30 (1) (g), (h) and (i)";
This Law shall take effect on 1 July 1998, with the exception of Articles I (1), (5) and II, which shall take effect on 1 January 1999.
