on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Hungary on cooperation in the field of plant protection
The Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Hungary on cooperation in the plant protection sector was signed in Budapest on 25 October 1969.
Pursuant to Article 15 thereof, the Agreement entered into force on 9 October 1970.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the Hungarian People's Republic on cooperation in the plant protection sector
The Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Hungary, led by the desire to consolidate and expand cooperation on the plant protection sector, thereby contributing to the further rise in agricultural crop yields, as well as to protect the territory of the two States against the introduction of quarantine pests, plant and weed diseases, have agreed as follows:
The Contracting Parties undertake:
(a) to implement on their territory the necessary measures against quarantine pests, plant diseases and weeds (hereinafter referred to as "plant pests") listed in the Annex to this Agreement;
(b) apply all measures to ensure that, with exported consignments of plants and plant products (hereinafter referred to as "consignments") or other means, plant pests listed in the Annex to this Agreement or in the additional conditions of the import State do not penetrate the territory of the other Party;
(c) comply with the relevant legislation of the importing State when exported;
(d) attach to each exported consignment a health certificate issued by the competent authorities of the exporting State certifying that the consignment is free of pests of plants listed in the Annex to this Agreement and that it also complies with the additional conditions of the importing State.
The Contracting Parties shall take all necessary measures to protect their national territories from introduction of plant pests from third States.
The transit of consignments shall be allowed if they are accompanied by a health certificate and comply with the relevant legislation of the State whose territory the consignments are accompanied.
The Contracting Parties undertake:
(a) avoid the use of straw, hay, weeds, leaves and other waste of agricultural plants as packaging material and use, as a priority, sawdust, shavings and other materials which prevent the introduction of plant pests in this way;
(b) to dispose of consignments intended for export of all removable soil residues;
(c) remove from the means of transport used to transport consignments any impurities and, if necessary, effectively recover them.
The import, export and transit of consignments shall take place through border crossing points designated by the competent authorities of the Contracting Parties.
The competent authorities of the Contracting Parties shall carry out plant health inspections of imported, exported and accompanying consignments. If the competent authority of one of the Contracting Parties does not permit the import or transit of consignments or provides for specific quarantine measures, it shall immediately inform the competent authorities of the other Contracting Party.
In order to facilitate and accelerate the import, export or transit of consignments, the competent authorities of the Contracting Parties may agree on the joint conduct of control plant health inspections, the joint use of technical means necessary for inspection and rendering and, where appropriate, the carrying out of such inspections by the competent authorities of one Contracting Party in the territory of the other Contracting Party.
The conditions, time and place of these inspections shall be agreed in advance between the competent authorities of the two Contracting Parties in each case.
The competent authorities of the Contracting Parties shall inform each other of:
(a) by 1 April each year, on the presence and spread of quarantine and dangerous plant pests as well as on measures taken to eradicate them. In the event of the detection of a new pest, they shall be informed immediately;
(b) the plant protection legislation governing the import, export or transit of consignments no later than 30 days after their issue;
(c) the results of scientific research in plant protection, the development of new methods and means of plant protection, as well as the publication of specialist journals, monographs and other serious publications on plant protection;
(d) changes to the border crossing points referred to in Article 4.
The Parties agree:
(a) to send experts, where necessary, to study scientific knowledge and to exchange experience on the plant protection sector;
(b) enable experts of the other Contracting Party to specialise in plant protection facilities and institutes;
(c) establish, where necessary, in particular in the border areas of the national territory of both Contracting Parties, a temporary Joint Commission for the coordination of plant protection activities.
The competent authorities of the Contracting Parties shall, as appropriate, hold joint consultations on plant protection problems to discuss and address practical and scientific tasks, as well as exchanges of experience on this section.
The meetings shall be held alternately on the national territory of both Contracting Parties. The time, place and schedule of such consultations shall be determined by agreement between the competent authorities of the Contracting Parties.
The competent authorities of the Contracting Parties may, when implementing this Agreement, be in direct contact and conclude sub-arrangements for the purpose of carrying out the tasks and addressing problems arising from this Agreement.
The provisions of Articles 6, 7, 8, 9 and 10 of this Agreement shall also apply to forestry, in particular as regards cooperation and any common measures to protect forests against plant pests in the border areas of the national territory of both Contracting Parties.
The costs of sending experts pursuant to Article 8a and (b) of this Agreement shall be borne by the Party sending experts.
The costs associated with the activities of the Joint Commissions referred to in Article 8c of this Agreement shall be borne by the Party on whose territory they will work.
The costs associated with the organisation of meetings referred to in Article 9 of this Agreement shall be borne by the Party in whose territory the deliberations will be held. The costs of sending experts to such meetings shall be borne by the Party which sent them.
Other payments resulting from the implementation of this Agreement shall be dealt with under the financing agreement applicable between the two Contracting Parties.
The attached list of plant pests is an integral part of this Agreement. The list may be supplemented or amended by the competent authorities of the Contracting Parties.
The supplements or amendments to the list shall be communicated to the other Contracting Party by diplomatic means and shall become effective 30 days after the date of receipt of the note on the additions or amendments made.
The provisions of this Agreement shall be without prejudice to the rights and obligations arising from agreements in force which have been concluded previously by the Contracting Parties or their membership of international plant protection organisations.
This Agreement shall be subject to approval under the constitutional provisions of the Contracting Parties and shall enter into force on the date of the exchange of notes on such approval.
The Agreement shall be concluded for a period of 5 years and shall be renewed for a further five-year period each time unless one of the Contracting Parties denies it in writing 6 months before the expiry of the period of validity.
Written in Budapest on 25 October 1969 in duplicate, each in the Czech and Hungarian languages, the two texts being equally authentic.
