governing certain questions relating to criminal proceedings in the field of maintenance, supply and price.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
(1) Administrative offences in the field of maintenance, supply and price shall be limited in three years.
(2) The limitation period shall begin on the day on which the offence was committed. The statute of limitations shall be viewed by authority.
(1) The Office (authority) responsible for carrying out the criminal proceedings for an administrative offence referred to in Article 1 shall state, either in a criminal offence or in an exemplary manner, that the matters by which the offence has been committed, which have been obtained by it or which are likely only to be intended to commit the offence, as well as the property gain which the guilty party has acquired by the offence, or that he has obtained for it, are forfeited to the State.
(2) The forfeiture referred to in paragraph 1 may also be declared if, after the offence has been committed, the guilty party has transferred the matters referred to in paragraph 1 to another person in order to escape the measures provided for in this paragraph, if that person knew, or had to know, as the case may be, that they were of such a nature.
Paragraph 1 and § 2 also apply to offences under the Decree of the President of the Republic of 27 October 1945, No 113 Coll., on the modification, management and control of foreign trade, and to infringements under the Act of 13 February 1947, No 15 Coll., on the prosecution of black trade and similar pledgings.
Paragraph 1 to 3 shall apply to the offences referred to therein, even if they were committed before the entry into force of this Act, unless they have been definitively decided on.
This Law shall take effect on the third day following its publication; it shall be carried out by all members of the Government.
