Law repealing the Special Fund for the Reduction of the Loss of the Resolutions of the Post-War Races and adjusting certain legal conditions of the General Fund of the Monetary Institutions in the Czechoslovak Republic

abrogating the Special Fund for the Reduction of the Loss of the Resolutions of the Post-War Races and adjusting certain legal conditions of the General Fund of the Monetary Institutions in the Czechoslovak Republic.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
(1) The Special Fund for the Reduction of the Loss of the Resolutions of the Post-War Conditions ("the Special Fund") established by the Law of 9 October 1924, No 237 Coll., and whose legal ratios have been further regulated by the Law of 21 April 1932, No 54 Coll., and by the Decree of 30 June 1937, No 160 Coll., shall be repealed on 31 December 1945 without liquidation.
(2) All the rights and obligations of the Special Fund, including claims and liabilities, which were to be adjusted in Slovakia pursuant to Article 33 (2) of the Law of 22 July 1941, No 172 of the Act on the Establishment of the Auxiliary Fund of the Money Institutions (hereinafter referred to as the "Auxiliary Fund") and the rights and obligations of entities covered by the Law of 31 March 1944, No 34 of the Slovak Republic amending and supplementing the Act of Law No 242 / 1940 of the Slovak Republic, go to the Czechoslovak State on 1 January 1946.
(3) The rights and obligations arising after 31 December 1945 from the proceedings of the bodies of the Special Fund until the date of entry into force of this Act remain unaffected.
§ 2.
(1) The interest rate on Special Fund bonds is reduced to 3% on 1 January 1946.
(2) The debt service of the Special Fund bonds, which has so far been procured under the provisions of the Government Decree of 9 November 1939, No 28 Coll. of 1940, on the purchase of coupons of the Special Fund for the Relief of losses arising from post-war conditions and bonds of the General Fund of the Monetary Institutions, and pursuant to § 8 of the Decree of 24 September 1939, No 242 of the Coll. on the compulsory listing and the forced custody of the Special Fund for the Relief of losses arising from post-war conditions and bonds of the General Fund of the Financial Institutions and on the reporting of other liabilities and claims against these funds, as well as well as under Article 1 of the Law No 34 / 1944 of the Act of 1 January 1946, the Ministry of Finance under the principles applicable to the debt service of the internal government debt. The Ministry of Finance shall also decide on the debt service of the Special Fund bonds which do not fall under the provisions of the first sentence.
§ 3.
(1) The obligation of monetary institutions to pay self-help contributions and a contribution premium (§ § 7 to 11 of Act No. 237 / 1924 Coll. as amended by its amendments and § 10 and § 11, § 1 to 6 of Act No. 172 / 1941 Coll.) expires on 31 December 1945.
(2) For 1945 and previous years, the Czech and Moravian-Silesian countries collect contributions and surcharges (paragraph 1) for the Czechoslovak State Zemská banka for Bohemia - central bank of savings banks in Bohemia and Moravia - still according to the provisions of Act No. 237 / 1924 Coll. as amended by the regulations amending it and supplementing it; This activity may be transferred to the Office of the General Fund of the Monetary Institutions in the Republic of Czechoslovakia (hereinafter referred to as the "General Fund"), which was established by the Law of 10 October 1924, No 238 Coll., and whose legal circumstances were regulated by the Law of 21 April 1932, No 54 Coll., and by the Government Decree of 30 June 1937, No 161 Coll. The Ministry of Finance shall supervise the collection of contributions.
(3) The other scope, which according to Act No. 237 / 1924 Coll. as amended by the regulations amending it and by other regulations, falls within the jurisdiction of the Curatorium of the Special Fund and its bodies and which concerns the rights and obligations which were to be governed by the Decree of the Government pursuant to § 33 (2) of Act No. 172 / 1941 of the Ministry of Finance.
§ 4.
The interest and reimbursement of the General Fund bonds has been exclusively paid in the Czech and Moravian-Silesian countries since 1 January 1946 on the basis of this fund, in Slovakia on the basis of the Auxiliary Fund, to which the State contribution under Section 13 of Act No. 172 / 1941 will be preserved.
§ 5.
All the claims and liabilities of the General Fund which were to be adjusted in Slovakia pursuant to Paragraph 33 (2) of Act No. 172 / 1941 Coll. z., as well as the liabilities of the assistance referred to in that provision, including the rights and obligations vis-à-vis the entities covered by the Order with power of Law No. 34 / 1944 Coll. z., are transferred from 1 January 1946 to the Support Fund as at 31 December 1945.
§ 6.
This Act shall take effect on the day of its publication; to be carried out by the Minister for Finance.
