GOVERNMENT REGULATION
of 7 March 2001
on comparing and accepting data from the Czech Real Estate Register and the population register
The Government orders pursuant to § 30 paragraph 2 of Act No. 344 / 1992 Coll., on the cadastral property of the Czech Republic (cadastral law), as amended by Act No. 120 / 2000 Coll., and for the implementation of Act No. 265 / 1992 Coll., on the registration of property rights and other property rights, as amended by Act No. 210 / 1993 Coll., Act No. 90 / 1996 Coll., Act No. 27 / 2000 Coll. and Act No. 30 / 2000 Coll.:
Subject matter
This Regulation lays down the procedure
(a) comparison of data on natural persons registered in the cadastral of real estate of the Czech Republic (hereinafter referred to as "the cadastre") 1 as owners of real estate (hereinafter referred to as "owners") or other persons authorised from a legal relationship (hereinafter referred to as "other authorised persons") and data on natural persons registered in the population register, 2)
(b) taking data on natural persons from the population register for the purposes of the register.
Initial comparison and receipt of data
(1) The authority managing the register (3) (hereinafter referred to as the "registry administrator") in liaison with the registry administrator of the population (4) will carry out an initial comparison of the name, surname and birth number of natural persons (hereinafter referred to as "basic identification data").
(2) In the case of identification of basic identification data on a particular natural person in the population register and in the register, the registry administrator shall take over such data on the natural person in the population register, including shared data, indicating the address of the permanent residence and the academic title of the natural person.
(3) In the event of non-compliance between the basic identification data contained in the register and the data in the population register, the registry administrator shall check the correctness of the data kept in the register. If the registry administrator finds that the data in the register are incorrect, it shall correct them; If it finds that the data in the register are correct, it shall inform the registry administrator accordingly.
(4) In the event that, after the examination, the non-compliance between the data in the register and the data in the population register has been removed and it is clear that the data in the register and in the population register relate to the same natural person, the registry administrator shall take the data from the population register, including the shared data into the register.
Notification of the removal of non-compliance in the basic identification data
The removal of non-compliance in the basic identification data or their specification in the register referred to in § 2 (3) and (4) shall be notified by the registry administrator by registered letter to the natural person concerned by the corrected data. 5)
Continuous comparison and receipt of data
(1) The registry administrator shall, when registering a natural person as the owner or other authorised person, compare the accuracy and completeness of the basic identification data on the natural person in the file for registration with the population records. Where it is clearly established that the data in the files for registration and the data in the population register relate to the same natural person, the data in the population register, including shared data, shall be taken into the register.
(2) In the event of non-compliance, the registry administrator shall investigate the cause of the non-compliance. If they find that the information contained in the documents for registration in the register is incorrect, they shall proceed according to specific legislation. 6) If it does not find an error in these documents, it shall enter in the register the data on the natural person listed therein and draw attention to the need to remove the mismatch of the resident registry administrator.
(3) The administrator of the population register provides, at agreed intervals, data on the natural persons kept in the register whose basic identification and shared data have changed in the population register. This data shall be taken from the population register to the cadastral register.
Compliance with the reporting obligation on the change of shared data
If, for a natural person registered in the population register and at the same time as the owner or other authorised person in the register, a change in the shared data of the cadastral register occurs, it shall be sufficient for that person to notify the change to the reporting population register. It is therefore considered that its reporting obligation with regard to the change of such data towards the registry administrator is fulfilled. 8)
Final provision
The processing of personal data and the protection of personal data are governed by the Data Protection Act. 9)
Efficacy
This Regulation shall enter into force on 15 April 2001.
