DECLARATION
Ministry of Agriculture
of 15 June 1995
laying down the legal and economic conditions for the independence of small independent breweries
The Ministry of Agriculture in agreement with the Ministry of Finance pursuant to Article II (5) of Act No. 260 / 1994 Coll., amending and supplementing the Act of the Czech National Council No. 587 / 1992 Coll., on Consumer Taxes, as amended, provides:
The small independent brewery is the person who makes beer in the form of a business 1) and fulfils the following conditions:
(a) the participation of other entities involved in the production of beer and malt is possible if their total share of the net commercial currency is not more than 20%;
(b) the production of stamp beer in licence (3) shall not exceed 49% of its exhibition in the calendar year in which all the beer produced is removed from storage during that year;
(c) the premises of both underground and above-ground are not technologically linked to the premises of another legal or natural person who produces beer; if one legal or natural person owns several breweries and their common exhibitions in a calendar year do not exceed 200 000 hl, those breweries may be considered as one small independent brewery,
(d) younger (4) and young beer may be purchased up to 10% of its beer exhibition per calendar year; young beer means a semi-finished product which has not completed the technologically necessary fermentation and maturation process.
Efficacy
This Decree shall take effect on 1 July 1995.
