on the procedure for the appointment of professors and teachers and for the occupancy of vacancies of university teachers
The Ministry of Education of the Czech Socialist Republic provides, pursuant to § 98 paragraph 1 (g) of Act No. 39 / 1980 Coll., on Higher Education Institutions (hereinafter referred to as "the Act"):
IMPLEMENTATION OF PROFESORIES AND DOCUMENTS OF HIGH SCHOOL
Conditions of appointment
(1) A professor of a particular field may be appointed a lecturer, a scientific or artistic worker or an important practitioner who fulfils the conditions laid down in Paragraph 74 (2) of the Act; a lecturer in a particular field of professional assistant, scientific or artistic worker or practitioner who fulfils the conditions laid down in Section 75 (2) of the Act.
(2) The pedagogical capacity is for a lecturer, assistant, scientific or artistic worker or an important practitioner (hereinafter referred to as the "proposed worker") who is engaged in educational activities at a university in the field in which he is to be appointed or in a similar field and achieves good results in this work.
(3) Scientific or artistic competence shall be demonstrated in particular:
(a) works on the basis of which the scientific rank of Doctor of Sciences or Candidate of Sciences has been awarded; or
(b) works of art or works of art; or
(c) monographs, in particular dissertation or other scientific or professional work, including university textbooks, teaching texts and other teaching aids of social importance; or
(d) the results of the successful research tasks; or
(e) discoveries and significant inventions1) and projects.
(4) As regards the appointment of a professor and the proposed worker is from a university or a scientific or research institute, the education of scientific or artistic staff shall be required to demonstrate scientific or artistic competence in addition to the assumptions set out in paragraph 3.
(5) The required practice shall be the appointment of professors for at least eight years, in justified cases of at least four years, in the appointment of teachers for at least five years, in justified cases of at least three years,
(a) educational activities at a university; or
(b) in scientific and research activities at universities, institutes and other workplaces of the Czechoslovak Academy of Sciences, the Slovak Academy of Sciences, central bodies and socialist organisations, and research and development facilities; or
(c) professional or social activity related to the relevant field in bodies or socialist organisations.
Appointment procedure
(1) The appointment procedure shall be initiated on a proposal from the Rector or Dean, provided that he has been empowered by the Rector to do so.
(2) The appointment procedure shall take place primarily at the faculty or university at which he is taught in the field to which the proposed worker is active and where at least one professor is present in the field. If these conditions are not met, the appointment procedure will take place at a faculty or university designated by the Ministry of Education of the Czech Socialist Republic (hereinafter referred to as the Ministry of Education) on a proposal from the Rector.
(3) To prepare a proposal for appointment by a professor or professor, the Rector or Dean shall, as an advisory body, set up a three-member panel from experts in the same or related field. The chairman and one other member of the committee are professors or doctors of science. Another member of the committee is a professor, an important scientist or an important practitioner. At least one of the committee members must be from another university. In order to prepare a proposal for appointment, the professor or doctor of science shall be at least the chairman of the commission. If the appointment procedure takes place at a faculty or university other than the one to which the proposed staff member is to be involved, the commission shall be extended to represent that faculty or university.
(4) The appointment procedure shall include:
(a) proof of higher education;
(b) evidence of pedagogical competence, professional or social political activity, evidence of practice;
(c) proof of the scientific rank of doctor of sciences or candidate of sciences,
(d) a list of scientific, professional or artistic works;
(e) the most important scientific, professional or artistic work or evidence of artistic performance.
(5) On the basis of the documents submitted, the Commission will evaluate the civil and moral characteristics of the proposed worker, his scientific (professional) or artistic and educational competence and practice. Where necessary, the Commission may request further expertise on scientific and professional work or work of art or artistic performance; in the field of art, the committee shall request the opinion of the relevant artistic association.
(6) If the rector or Dean finds from the documents submitted or the evaluation of the Commission that the application for appointment by the professor or professor does not comply with the required conditions, the proceedings shall be terminated.
(7) The proposal to appoint a professor or associate professor shall be submitted to the Scientific (artistic) board of the faculty and to the Scientific (artistic) council of the university.
(8) If the Rector agrees to the proposal, he will submit it after possible addition to the Minister of Education of the Czech Socialist Republic (hereinafter referred to as "Minister of Education '); otherwise the appointment procedure shall cease.
The Minister of Education may appoint a lecturer and propose the appointment of a professor also without proposal and without discussion in accordance with § 2.
CONDUCT OF FREE WORKING POSTS OF HIGH SCHOOL TEACHERS
Placing free posts for professors and docents
(1) The vacancies of professors and teachers in universities for a particular field are filled by bankruptcy; the audition is written by the rector. The Minister of Education may authorise the vacancy without bankruptcy.
(2) The opening of the bankruptcy shall include:
(a) the indication of the vacancy and the relevant field;
(b) the conditions for its occupancy (scientific, educational, artistic, scientific or professional, required period of experience, etc.),
(c) the date of the expected take-up;
(d) the deadline for filing the application;
(e) place of filing of the application;
(f) the list of required documents referred to in paragraph 4.
(3) The deadline for filing the application cannot be less than four weeks after the publication of the bankruptcy in the national press. The bankruptcy is also published in the Bulletin of the Ministry of Education and the Ministry of Culture of the Czech Socialist Republic.
(4) The application must be supported by documents
(a) a scientific or artistic degree;
(b) scientific (professional) or artistic and educational activities;
(c) practice and duration;
(d) the scientific rank, where the applicant has obtained it.
(5) The rector shall set up a maximum of five members of the bankruptcy committee for the conduct of the bankruptcy. The President of the bankruptcy committee shall appoint the Rector and other members shall appoint the Head of the Institute for which the bankruptcy has been filed, the staff member of the cadre and personnel department and other staff of the university. The Commission shall, no later than four weeks after the end of the deadline for the submission of applications, prepare the overall evaluation of tenderers and propose their order.
(6) A candidate's application may also be accepted for bankruptcy, who has not yet obtained a professorial or artistic degree.
(7) The Rector will ask the Minister of Education for approval to fill the vacancy, after giving his consent, the Rector will conclude a contract of employment with the Professor or Professor and notify the Dean.
Other teachers' vacancies
(1) The vacancies of professional assistants, assistants and lecturers are filled by bankruptcy; the audition is written by the rector. The Ministry of Education may authorise the vacancy without bankruptcy. The rector shall set up a maximum of five members of the bankruptcy committee for the conduct of the bankruptcy and appoint its chairman from among university officials and other members. Article 4 (2) and (3) and Article 4 (4) shall apply to the vacancy of these teachers.
(2) A staff member with a higher education who fulfils the conditions laid down in Section 69 of the Act and has at least three years of professional experience in the relevant field, after leaving the university, may be admitted to the vacancy of an assistant or tutor. An exception to the length of experience may be permitted by the rector.
(3) A staff member with a university degree who fulfils the conditions laid down in § 69 of the Act may be recruited as an assistant. Priority shall be given to a worker who has already been successful in scientific (professional) or artistic activities during his studies. In the field of study where prior professional experience is required, the Dean shall determine its length individually, within one to two years.
FINAL PROVISIONS
This Decree shall take effect on 1 September 1980.
