Federal Ministry of Agriculture and Nutrition
of 28 September 1976
on the single agricultural cooperative reserve
The Federal Ministry of Agriculture and Nutrition provides, pursuant to § 14 (4) of Act No. 122 / 1975 Coll., on Agricultural Cooperatives, in agreement with the Federal Ministry of Finance and the Ministry of Agriculture and Nutrition of the Czech Socialist Republic and the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic:
Subject matter and scope of the adjustment
This decree sets out the details of the principles of the Government of the Czechoslovak Socialist Republic No 138 / 1975 Coll., implementing certain provisions of Act No. 122 / 1975 Coll., on Agricultural Cooperatives, in so far as they concern the creation and use of a reserve fund (hereinafter referred to as "the Fund ') of a single agricultural cooperative (hereinafter referred to as" cooperative').
Creation of the Fund
(1) The cooperative shall make the Fund a profit allocation; the fund may be supplemented by funds from other cooperative funds (excluding the funds from the construction fund 1) and the cultural and social needs fund).
(2) The profit allocation shall be made by the cooperative to the fund equal to the remainder of the profit after the allocation to the other funds.
Purpose of the Fund
The Fund serves the cooperative
(a) bridging economic fluctuations, both within the cooperative and within the cooperative group, (2) or the joint holding of which it is a member;
(b) allocations to other cooperative funds;
(c) to cover circulation;
(d) contributions to the activity and building of joint facilities within a cooperative association or joint agricultural holding;
(e) to provide compensation for work;
(f) to cover the cost of contributions to pensions under the Specific Regulation.3)
Application of the Fund
(1) The allocation from the Fund to other funds may be made by the cooperative in accordance with the rules applicable to those funds.
(2) The use of the Fund for the purposes set out in Article 3 (d) shall be made by decision of the cooperative and, where appropriate, by commitments resulting from cooperation agreements; (4) by decision of the Cooperative Board of the Cooperative Association or the Joint Undertaking.
(3) When using the Fund, the cooperative shall proceed in such a way that the amount of the Fund for the purposes set out in Section 3 (e) is at least 20% of the amount of the planned cost remuneration.
Final provisions
The Ministry of Agriculture and Nutrition of the Republic may, in agreement with the Federal Ministry of Agriculture and Nutrition, authorise exemptions from the provisions of Sections 3 and 4 of this Decree on a case-by-case basis.
This decree shall take effect on the day of its publication.
