THE LAW
of 30 November 1967
about the capital of Prague
Taking into account the position and role of Prague, the history created by the centres of political and cultural life of all the Czechoslovak people and the capital of our socialist country, and its growing importance for the further development of the national economy and culture of the whole country and for the deepening of friendly contacts between nations
and based on the need to ensure efficient administration of the capital and its universal development
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
Basic provisions
(1) The City of Prague is a separate territorial unit; is not part of any region.
(2) The territory of the capital city of Prague is divided into urban districts.
(1) The organisation of socialist state power and administration in the capital of Prague is the National Committee of the capital of Prague, which is governed directly by the government.
(2) The authorities of socialist state power and administration in urban districts are the national district committees; in which parts of the urban districts may also be operated by local national committees, this law provides (§ 20 (1) and § 22).
Management of the development of the capital
National committees operating in the capital city of Prague in the security of the construction and development of the capital, the government, central government and other state authorities in the performance of their tasks, if they affect the interests of the capital, are governed by the principle that the development of the economic and cultural construction of Prague as the capital of the state is an important social interest.
(1) The main task of the National Committee of the City of Prague is to take care of the universal development of the city, in particular its planned construction, the security of transport and other services at the large city level, the development of cultural and social life, the creation and protection of a healthy environment, the protection of cultural monuments and the safeguarding of public order. One of the leading tasks of the National Committee of the City of Prague is also the care of creating favourable conditions for the activities of the state authorities and other central bodies and institutions which have their seat in Prague as the capital of the state.
(2) State bodies and organisations are required to assist the National Committee of the City of Prague in the performance of its tasks effectively within their responsibility.
(1) The Government creates the preconditions for helping state bodies and organisations to address the issues of the construction and development of the capital city of Prague.
(2) The ministries and other central government bodies cooperate closely with the National Committee of the City of Prague to ensure the development of the capital and to deal with all the problems within their competence concerning the economic, cultural, health and social construction of Prague. They are obliged to discuss with the National Committee of the Capital City of Prague those parts of the proposals for development plans of their sector (s) which affect the interests of the capital. The government decides on the contradictions that the draft plans do not safeguard the needs of the capital as expressed in the draft development plan of the capital city of Prague. The National Committee of the City of Prague may propose to the Government that the ministries and other central government bodies should be given the task of securing the needs of the capital.
(3) The ministries and other central government bodies take care of the special conditions of the capital of Prague in their management activities and, in this respect, discuss with the National Committee of the capital of Prague draft legislation and other measures when they concern the capital of Prague. Different opinions on major issues will be discussed by the Minister (Head of the Central Authority) with the Mayor of Prague.
(4) The National Committee of the City of Prague shall coordinate the progress of the organisations and state bodies in carrying out the tasks relating to the development of the capital of Prague; it does not interfere with the competence of central or other bodies.
(1) Central economic, cooperative and other organisations which operate in the territory of the capital are obliged to cooperate with the National Committee of the City of Prague or with the national district committees to ensure the planned development of the capital of Prague and its districts. They provide them with the evidence of the important measures that national committees need to ensure the overall development of the capital and its districts. In particular, they are obliged to submit to the National Committee of the City of Prague to express their concept of development, studies, long-term prospects and economic plans, those parts of them which affect the issues of the development of the capital. In cases provided for by specific regulations, the opinion of the National Committee of the City of Prague is binding on them, in particular on the construction and creation and protection of healthy conditions and healthy ways of life and work; in other cases where the opinions of the National Committee of the City of Prague are not taken into account, the National Committee of the City of Prague may propose to the Government to discuss the matter.
(2) The approval of the National Committee of the City of Prague is needed to place the organisation or part of the organisation (plant, establishment, etc.) in the territory of Prague and to change its activities in relation to the substantial extent of the life of the city.
(1) The ministries and other central government bodies as well as the national committees and organisations cooperate with the National Committee of the Capital City of Prague to satisfy the important interests of the capital outside their territory and to assist them in doing so.
(2) If the territory of the Praha- East and Praha- West districts, Central Bohemian Regional National Committee or the relevant Regional National Committee in agreement with the National Committee of the City of Prague
- approve proposals for forward-looking national economic studies, plans for the overall development of areas and territorial plans,
- discuss and deliver an opinion on investment projects and project tasks for the construction and conversion of industrial buildings and equipment, in particular transport, water, energy and recreation.
(3) The National Committee of the City of Prague shall proceed mutatis mutandis in an agreement with the Central Bohemian Regional National Committee to address the issues referred to in paragraph 2, insofar as they affect the interests of the Prague-East and Prague-West counties.
The competence of the National Committee of the City of Prague and the District National Committees
(1) The National Committee of the City of Prague, in close cooperation with the National Circular Committees, plans, manages and ensures the construction and reconstruction of the capital and organises the planned development of economic, cultural, health and social construction in the territory of the capital. It draws up a proposal for a capital development plan, which regulates the correct proportions in the development of the capital. Involved in further work on the preparation of the state plan for the development of the national economy, collaborates with central government authorities and makes proposals to address issues affecting the development of the capital.
(2) The National Committee of the City of Prague manages, directs and controls the activities of the District National Committees. He oversees the implementation of laws and the maintenance of state discipline by the national committees and conducts reviews of their management. It provides comprehensive assistance to the national committees in their work and in addressing urban challenges and advising them on their tasks, building on their knowledge and discussing their initiatives and comments. Proposals for serious measures shall be prepared and discussed with the national committees.
(3) The National Committee of the City of Prague establishes and manages, or manages, organisations and facilities which serve to meet needs beyond the perimeter and whose management (administration) is more efficient and economical to organise for the whole city.
(4) Furthermore, the National Committee of the City of Prague exercises jurisdiction according to other laws and regulations of the National Committees, provided that the Act does not entrust it to the National Circular Committees (§ 9, 10, 11, 12). In the areas of public order and culture and information, it also carries out public administration, which would otherwise belong to the national committees, if these are matters of urban importance; The National Committee of the City of Prague shall be set up in greater detail at its plenary session. The National Committee of the Capital City of Prague may, in its plenary session, provide, in agreement with the National Circuit Committees, that it will carry out a state administration which would otherwise belong to the National Circuit Committees, as well as to other matters, if this would make the administration more efficient or better satisfy the needs of citizens and organisations.
The District National Committees, in line with the planned development of the city, ensure the development of their districts with the widest participation of citizens. They take care of the enhancement and appearance of the circuits. They work closely with the National Committee of the Capital City of Prague to address city-wide issues and to submit initiatives to it. They are involved in drawing up long-term urban development concepts and plans and formulating and approving plans for the development of their economy and their budgets.
(1) Circumstantial national committees carry out state administration on matters belonging otherwise to regional and local national committees on the section
- the creation and protection of healthy living and working conditions,
- construction rules,
- labour force,
- agriculture,
- energy,
- housing management,
- management of non-residential premises,
- finance and management and protection of national assets,
- supply and trade,
- services,
- education and childcare,
- culture and information,
- health services,
- social security,
- State defence,
- protection of public order,
- general internal administration.
(2) The National Committee of the City of Prague may, at its plenary session, provide, in agreement with the Circular National Committees, that certain tasks falling within the competence of the Circular National Committees will also be performed by a Circular National Committee in the territory of other Circular National Committees for reasons of effectiveness or other serious reasons. In the same way, it may entrust certain tasks under its responsibility to the National Circuit Committees.
Under the Law on the Organisation of Courts and the Election of Judges, the Circular National Committees elect the President of the Circular Court and its Deputy Director and discuss reports on the activities of the Circular Court.
(1) The District National Committees shall establish and manage:
- primary and primary schools,
- out-of-school educational establishments of peripheral importance,
- national health district institutes; other organizational arrangements may be carried out by the National Committee of the City of Prague in agreement with the National Circuit Committees.
They may also establish and manage:
- cultural and awareness-raising facilities,
- social security facilities of peripheral importance.
(2) To carry out their tasks, the national district committees may establish and manage:
- the housing district organisation,
- restaurants and canteens
and other economic organisations and facilities which satisfy predominantly local needs or which are more efficient to organise by circuit.
(1) Within the limits of their scope (Paragraph 10), the District National Committees carry out public administration vis-à-vis central management and cooperative organisations, organisations managed and managed by the National Committee of the City of Prague and other bodies, in particular on the construction, creation and protection of healthy living and working conditions, health services, trade, public order and state finances.
(2) The National Committee of the Capital City of Prague will determine, in agreement with the Circular National Committees, the scope and form of participation of the Circular National Committees in determining the tasks of organisations managed by the National Committee of the Capital of Prague and in monitoring their activities.
(1) National Committees operating in the capital of Prague, their institutions and Members are developing a wide range of organisational and cultural educational activities, thereby creating the preconditions for active participation of citizens in the administration of the capital.
(2) The Circular National Committees establish civil committees, home committees and other their assets, familiarise them with the work of the National Committees, use their initiatives in the performance of their tasks and focus their activities on active cooperation between citizens and national committees.
Organizational construction of the National Committee of the City of Prague and the District National Committees
At least 60 Members shall be elected to the district national committees, at least 130 Members to the National Committee of the City of Prague.
(1) The National Committee of the City of Prague and the District National Committees establish executive and control bodies: the Council, the Commission, the Commission of People's Control, the Administrative Commission and the Trade Unions (other departments).
(2) The Council of the Circular National Committee shall be composed of the President, Vice-President (Vice-Presidents), Secretary of the Circular National Committee and other members elected by the Circular National Committee of Members. The Council of the District National Committee shall have 12-15 members.
(3) The Council of the National Committee of the City of Prague is composed of the Mayor of the City of Prague, its Deputy, Secretary of the National Committee of the City of Prague and other members elected by the National Committee of the City of Prague from Members. The Council of the National Committee of the City of Prague has 15-20 members.
(4) The Head of the National Committee shall perform the functions of the President of the National Committee under the Law on National Committees. As a representative of the capital, he has the right to use historical primary insignia.
Character and colors of the capital of Prague, honorary citizenship and other honours
(1) If the use of a state emblem is not prescribed, national committees operating in the capital city of Prague and their managed and managed organisations and facilities may use the emblem of the capital city of Prague.
(2) Other organizations can use the title of the capital city of Prague only with the permission of the National Committee of the capital city of Prague.
(3) The emblem of the capital of Prague and its use are regulated by the National Committee of the capital of Prague.
(4) The colours of the capital city of Prague are gold and red, the gold color is above.
(1) The National Committee of the City of Prague may grant the honorary citizenship of the capital of Prague to persons who have been significantly responsible for the development of the capital of Prague, for peace and friendship between nations or for other general welfare.
(2) The National Committee of the City of Prague can appreciate the particularly important activities of the deserving persons by granting public recognition for merit.
(3) The National Committee of the City of Prague can also appreciate the award of the National Committee of the City of Prague.
Expansion of the City of Prague
(1) The territory of the capital city of Prague is connected and the territory of these municipalities is integrated into the surrounding urban districts
(a) from Praha- west
Háje, Chodov, Kunratice, Libush, Blue, Lahovice (part lying on the left bank of Berounka), Great Chuchle, Beech, Nebuchi, Lysolais, Suchdol;
(b) from the Praha- east district
Lower Chabry, Devils, Letňany, Chakovice, Kbels, Kyje, Upper Slug, Lower Slug, Petrovice, Crunchies.
(2) The territory of the capital city of Prague consists of the following urban areas (cadastral territory):
Old Town, New Town, Small Town, Hradčany, Josefov, Vyšehrad, Holešovice, Troja, Karlín, Libeň, Kobylisy, Bodynice, Chimice, Lower Chabry, Devils, Sřezhkov, Prosek, Vysočany, Depbětín, Hlušovice, Letňany, Čakovice, Třebořice, Miškovice, Kbela, Hostivice, Strachnice, Malešice, Žižkov, Vinohrady, Vršovice, Šeklovice, Brálovice, Hospolovice, Pobořice, Měchovy, Příboholy, Petrovice, Háje, Chodochodov, Michle, Ne, Krůvělovice, Púlovice, Púlovice, Púlovice, Púlovice, Povolice, Púlovice, Púlovice, Púlovice, Púšenice, Púšice, Púš@@
(1) In the parts of the urban districts resulting from the integration of the municipalities referred to in Paragraph 19 (1), the local national committees shall operate under the control of the national district committees; They shall be governed by the jurisdiction of the local national committees under the National Committees Act.
(2) Local national committees cooperate with the National Committee of the City of Prague and the District National Committees, participate in their tasks in securing the construction and development of the capital city of Prague and contribute their activities to the consistent development of the whole city.
(3) The National Committee of the City of Prague or the District National Committee may, in agreement with the Local National Committee, take over certain tasks falling within the competence of this Local National Committee.
(4) The National Committee of the City of Prague or the District National Committee may, in agreement with the Local National Committee, delegate some of its tasks to the local National Committee.
The Circular National Committee may decide, on a proposal from the Local National Committee after consultation with citizens, to terminate the Local National Committee and take over its responsibilities.
If other municipalities join the territory of the capital city of Prague after 1 January 1968, the parts of the urban districts resulting from their integration are covered by the provisions of Sections 20 and 21.
Final provisions
If this law does not contain different arrangements, the provisions of the Law on National Committees apply to national committees operating in the capital of Prague.
The Minister of Justice shall establish a decree in the Collection of Laws from which the organisation of courts and state notaries shall adapt to the territorial changes provided for in this Act.
Government Decree No. 79 / 1960 Coll., on the powers and responsibilities of the National Committee of the City of Prague and the District National Committees in Prague, is hereby repealed.
This Act shall take effect on 1 January 1968.
