Decree of the Ministry of Agriculture, Forestry and Water concerning the operation of auxiliary and associated production in single agricultural cooperatives and the execution of works and services by single agricultural cooperatives

on the operation of auxiliary and ancillary production in single agricultural cooperatives and the implementation of works and services by single agricultural cooperatives
The Ministry of Agriculture, Forestry and Water Management provides in agreement with the participating central authorities and authorities pursuant to Sections 14 (2) and 61 of Act No. 49 / 1959 Coll., on Uniform Agricultural Cooperatives:
§ 1
Purpose
A single agricultural cooperative (hereinafter referred to as "cooperative ') may, in order to develop agricultural and forestry production, make better use of the means of production, use of its own material resources and the full application of the work of the members, in particular at the time of calmness of vegetation, perform auxiliary and associated production, or perform work and services outside the cooperative.
§ 2
Auxiliary production
(1) Auxiliary production means maintenance and repair work for the own use of cooperatives, in particular the maintenance and repair of machinery and buildings of cooperatives.
(2) There is no need to authorise the District National Committee to carry out this activity.
§ 3
Related production
(1) Associated production means the activity of a cooperative to apply the work of cooperatives and to use its own material resources during the season of vegetation. These include the extraction of sand, gravel and stone, the production of building materials (lime, bricks, concrete products, etc.), assistance to other cooperatives in carrying out self-help investment, processing of rapeseed straw, wreckage etc., especially for the needs of cooperatives. This activity must not be used to cover private business and its operation must not jeopardise the core activity of the cooperative, i.e. agricultural production.
(2) If the cooperative decides to operate associated production, it is obliged to indicate its type and scope in its own statutes. The cooperative may only start operating this activity on the date of approval of its own statutes or their amendments and additions by the District National Committee.
(3) Only members of the cooperative work in the associated production. In doing so, former exploiters or persons convicted of the theft of property held in socialist property or for speculation shall not be allowed to work in the leading positions in this production.
(4) The cooperative shall not engage in an activity the operation of which is solely for certain undertakings or sectors of the national economy. The processing of food raw materials for the needs of consumers other than cooperatives and their own joint holdings of cooperatives may be carried out by the cooperative only with the agreement of the Ministry of Food Industry. In carrying out another activity, in particular if it exceeds the cooperative's own needs, the cooperative shall be obliged to follow the instructions given for that activity by the competent central authority or authority.
(5) The necessary material for the operation of the associated production, which the cooperative cannot procure from its own resources, purchases at retail (sales) prices without any right to a trade haircut.
(6) The sale of the related production products is carried out by the cooperative at the prices determined in accordance with the Price Planning, Production and Control Regulations. *)
§ 4
Non-cooperative work and services
(1) Works and services outside the cooperative are activities in which the cooperative provides work or services to other organisations during a period of serenity. In particular, the use of transport means of cooperatives to assist forest production in the approximation and collection of wood, to assist other cooperatives in the import of building materials for investment construction etc.
(2) The cooperative may only operate with the approval of the District National Committee. Such consent is not required if it is to provide short-term assistance to other cooperatives.
(3) The rules on planning, pricing and control are also applicable to invoicing work and services outside the cooperative. *)
§ 5
Association production, work and services outside the cooperative in mountain and submountain areas
(1) The operation of associated production, the execution of works and services outside the cooperative is justified primarily in cooperatives in the mountain and submountain areas in which, due to local conditions, the season of vegetation is the longest.
(2) If a cooperative in these areas cannot provide sufficient employment opportunities for cooperatives under the previous provisions, it may allow them to work temporarily in local businesses, in production cooperatives and in other socialist enterprises, as appropriate, for a period of serenity.
§ 6
Remuneration for work
Cooperatives working in auxiliary and ancillary production, or performing work and services outside the cooperative, shall be remunerated for work according to the same principles as other cooperatives, i.e. either in labour units or in basic remuneration and cash premiums, provided that the cooperative has imposed cash remuneration. The remuneration for work provided in the form of a percentage of the profits of these activities shall not be admissible.
§ 7
Activities of national committees
(1) Local and district national committees provide assistance to cooperatives in selecting, introducing and operating auxiliary and associated production, works and services outside the cooperative. In doing so, local and regional national committees shall ensure that cooperatives:
(a) perform proper maintenance and repair of its own machinery, tools and buildings in the framework of auxiliary production;
(b) has not operated any type of related production other than that defined in Section 3 of the Decree;
(c) carry out work and services outside the cooperative only during the period of vegetation peace, especially for forest plants in the coming and gathering of wood, or for logging, as well as for single agricultural cooperatives and melioratory cooperatives in the import of building materials for investment construction, melioratory work, etc.
(2) Local and regional national committees are responsible for:
(a) all types of associated production, works and services outside the cooperative shall be carried out by cooperatives in such a way as not to interfere with their agricultural work and shall be operated during a period of serenity;
(b) cooperatives shall carry out only those works and services outside the cooperative to which the Regional National Committee has given its consent (Section 4 (2), first sentence);
(c) the cooperative shall operate only the type and extent of the associated production as specified in the statutes of the cooperative approved by the District National Committee;
(d) in the associated production, former exploiters or persons convicted of the theft of property held in socialist property or for speculation do not work in the leading positions.
Final provisions
§ 8
Decree No. 144 / 1960 Coll., on the operation of auxiliary and associated production in single agricultural cooperatives and their cooperation shall be repealed.
§ 9
This decree shall take effect on the day of its publication.
