THE LAW
of 19 April 1990
amending and supplementing Act No. 100 / 1988 Coll., on Social Security, and Act No. 54 / 1956 Coll., on Staff Disability Insurance
The Federal Assembly of the Czechoslovak Federal Republic has decided on this law:
Act No. 100 / 1988 Coll., on Social Security, is amended as follows:
1. In Paragraph 1, the fourth sentence of paragraph 2 and the second sentence of paragraph 6 are deleted.
2. the following paragraphs 7 and 8 are added:
"(7) Citizens who employ other citizens are subject to pension insurance in accordance with a special provision. 19)
(8) Self-employed persons participate in sickness and pension insurance on the basis of the payment of insurance premiums. "
3. Paragraph 2 (1) (c) reads as follows:
"(c) the sickness insurance of self-employed persons, in particular entrepreneurs, artists who do not carry out their activities in an employment relationship and self-employed farmers."
4. In Section 5, the following words are added at the end:
"and citizens who employ other citizens (§ 1 (7))."
5. in Article 6 (1) (d), the words "artists [§ 2 (1) (c)]" and the words "and citizens providing benefits in kind and performance on the basis of the approval of the national committee" shall be deleted.
(6) Paragraph 6 (1) shall be added to point (f), which shall read as follows:
"(f) self-employed."
7. in Article 6 (2), the provisions of (a) and (b) and (c) shall be deleted;
8. in Article 6 (2) (b), the words "members of the People's militia" shall be deleted;
9. in § 7 (a), point 9 is deleted;
(10) Paragraph 8 (1) shall be added to point (g), which shall read as follows:
"(g) the activity of self-employed persons, to the extent and under the conditions laid down in the implementing regulation."
11. paragraph 4 shall be deleted in Paragraph 8.

If there are no other international agreements, the periods of employment and replacement periods abroad for the creation and amount of pension rights
(a) the periods referred to in § 8 (1) (f) and § 9 (1) (e), if they are Czechoslovak nationals,
(b) the periods referred to in Article 8 (1) (a) to (d) and (g), if they are citizens who are resident on the territory of the Czechoslovak Federal Republic and have paid insurance premiums for such periods; the amount of the premium shall be 20% of the assessment base, which shall be at least 400 CZK per month. ';
13. in Paragraph 34 (1) (b), the words "member of the People's militia" shall be deleted;
14. in Paragraph 40 (2) (e) and (f), the words "after consultation with the relevant committee of the Trade Union of Arts, Culture and Social Organisations and with the relevant artistic union" shall be deleted.
15. In the second part of the head of the second part, the tenth part is deleted.
16. In Article 58 (1), the words "if not the period referred to in Article 11 (b)" shall be inserted after the words "periods of employment abroad."
17. in Paragraph 71 (1) (a), the word "personal" shall be deleted;
18. In Paragraph 82 (3), the words "Revolutionary Trade Union Movement or others, as the case may be, shall be deleted."
19. Paragraph 86 shall be added to paragraph 3:
"(3) The State shall provide such persons with assistance in the work of classification and application as well as the conditions for their inclusion in social and public life. ';
20. In Paragraph 90, the current text becomes paragraph 2 and the following paragraph 1 is added:
"(1) Citizens whose living needs are not covered by income from a gainful activity or other income or benefits, as the case may be, and the National Committee cannot provide them with the appropriate employment, shall receive benefits in kind and cash."
21. in Article 100 (2), the words "at least one half" shall be added after the words "part of the pension."
22. the third sentence shall be deleted in Paragraph 103 (2).
23. Part Six reads:
SOCIAL SECURITY
The other provisions of this Act and the provisions on occupational sickness insurance shall apply to the sickness and pension insurance of self-employed persons, unless otherwise provided for in this Act or in the implementing regulation.
(1) Self-employed persons are required to pay insurance premiums for their sickness and pension insurance and to submit applications and applications for such insurance.
(2) The amount of the premium is 25% of the applied-in assessment base, which is at least 400 CZK per month. the premium is paid for a specified period in advance.
(3) The competent social security authority may impose fines on a self-employed person for failure to fulfil or breach obligations under the social security rules, up to a cumulative amount of CZK 10 000 in a calendar year.
The Government of the Czechoslovak Federal Republic may temporarily reduce the amount of insurance premiums, even for certain groups of persons. "
Parts sixth and seventh shall be renumbered as parts seventh and eighth.
24.
(1) The Government of the Czechoslovak Federal Republic provides by regulation for a regular increase in pensions, taking into account wage and other labour income increases, price adjustments and changes in living costs.
(2) The Government of the Czechoslovak Federative Republic may, by regulation, lay down, taking into account facts similar to those referred to in paragraph 1:
(a) increases in pensions which are the only source of income;
(b) a one-off increase in pension payments. "
25. The following Section 169a is inserted after Section 169, including the title:
Periods of employment abroad
The periods of employment and alternate periods abroad before 1 May 1990 shall be evaluated in accordance with the provisions in force before that date; In so doing, the conditions of authorisation of the Czechoslovak state authorities to reside abroad shall not be required. ';
26. In Paragraph 177 (1), the words "and with the Central Council of Trade Unions' and the words" and 4 'are deleted.
27. in Article 177 (2), the words "and with the Central Council of Trade Unions and after consulting the Association of Cooperative Farmers" shall be deleted.
28. in Paragraph 177 (2) (i), the following words are added at the end: "and the regulation of the security of self-employed persons during military training,"
29. Paragraph 177 (2) (m) reads as follows:
"(m) more detailed conditions for the provision of welfare benefits to the citizens referred to in Article 90 (1),"
30. in Paragraph 177 (2) (p), the words "pension insurance" shall be deleted.
31. Paragraph 177 (3) reads as follows:
"(3) The Federal Ministry of Labour and Social Affairs provides for a decree in agreement with the other central authorities involved
(a) for self-employed persons, the definition of the group of such persons, the additional conditions, scope and implementation of their sickness and pension insurance, details of the assessment basis, the method of payment, recovery and settlement of premiums, the conditions for the provision of the co-workers and other family members of such persons;
(b) details of the assessment basis and the method of paying the insurance premiums for the assessment of periods of employment abroad referred to in Article 11 (b). ';
32. In Paragraph 177 (4), the words "the Czech Trade Union Council or the Slovak Trade Union Council and after consultation with the relevant association of cooperative peasants" are deleted.
The personal pension granted pursuant to Article 53 of Act No. 100 / 1988 Coll., on social security or other provisions previously in force, shall be changed from 1 May 1990 to that which he replaced under the provisions in force before 1 May 1990, at the rate at which it was paid on that date; This is without prejudice to the possibility of a pension reduction granted as a personal pension before the date of application of this Act, in accordance with the existing rules on personal pensions.
This Act shall take effect on 1 May 1990.
