DECLARATION
of 7 January 2010
amending Decree No 560 / 2006 Coll., on the participation of the State Budget in the financing of property reproduction programmes
In agreement with the Ministry of Regional Development, the Ministry of Finance provides, pursuant to § 13 (4) of Act No. 218 / 2000 Coll., on budgetary rules and amending certain related laws (budgetary rules):
Decree No. 560 / 2006 Coll., on the participation of the State Budget in the financing of property reproduction programmes, is amended as follows:
1. In Section 1, the words "information system for the financing of property reproduction 'are replaced by the words" programme financing information system';
2. in Article 2 (b):
"(b) a participant in the programme, an organisational body of the State or a contribution organisation financing the preparation and implementation of an action from State budget resources, including State budget funds, which are or are to be covered by the budget of the European Union, the financial mechanism or NATO funds, or by a legal or natural person financing the preparation and implementation of an action from resources provided by the State budget, including funds provided from the State budget which are or are to be covered by the budget of the European Union, the financial mechanism or NATO funds,";
3. In Article 2 (c), the words "or the parameter 'are added after the word" indicator' and the word "programme 'is replaced by the words" action (project)'.
4. in Article 2 (e), including footnotes 1 and 2:
"(e) the information system of the public administration, which serves to record the documents for the preparation and implementation of the state budget and the implementation of the expenditure of the state budget in terms of the detailed breakdown for the programme area (1), including the records of management procedures carried out under the Financial Controll2 Act,
1) Article 12 (1) of Act No. 218 / 2000 Coll., on Budgetary Rules and on the Amendment of Certain Related Laws (Budgetary Rules), as amended by Act No. 26 / 2008 Coll.
2) Act No. 320 / 2001 Coll., on financial control in public administration and amending certain laws (Act on Financial Control). '.
5. in Article 2, the following points (f) to (j) are added:
"(f) the title of the programme designation or part of the programme for the purposes of disembarking from the information system, part of the State-owned property management,
(g) the subsidy title of the programme designation or part of the programme for the purposes of output from the information system, part of the Registration subsidy system,
(h) a sub-heading identifying part of the expenditure or subsidy title for the purposes of the output from the information system;
(i) documentation of the action (s) of the document file requested by the administrator of the programme for the registration of the action (s) in the information system;
(j) the objective of the action (s) of the value to be achieved in order to achieve the objectives of the programme. ";
6. Paragraph 3 (2) reads as follows:
"(2) The programme manager shall submit the documentation to the Ministry in paper and electronic form."
7. in Article 3 (3) (b):
"(b) set out the objectives of the programme to be the subject of a final evaluation of the programme, which must be based on the objectives of the programme contained in the relevant programme co-financed by the budget of the European Union, the financial mechanism or NATO funds;"
8. In Article 3 (4), the words "indicators and parameters' are replaced by the words" programme objectives'.
9. In Article 3, at the end of paragraph 4, the sentence "Request for amendment may be added at the time of validity of this information, as set out in the approved programme documentation."
10. in Article 4 (1) (a), the words "the form of which appears in Annex 1 to this Decree" shall be replaced by the words "forms P 09 370, D 09 370, V 09 370, the models of which appear in Annex 1 to this Order."

Registration and financing of the action
(1) The programme participant shall submit to the programme manager the investment project of the action (s) established in accordance with the objectives set out in the programme documentation. Programme Manager
(a) assess the content of the investment project submitted by the programme participant, including the supporting documents, the models of which are set out in Annex 2 to this Decree, or, if deficiencies are found, may be returned to the programme to be completed. It lays down the terms and conditions for the participation of the State budget for further preparation, award and implementation of the action (s) or indicates that the State budget will not participate in the action (s),
(b) register the action (project) in the information system, lay down the conditions for the participation of the State Budget for further preparation, award and implementation of the action (project), and, if the action (project) involving the State Budget in the form of individually assessed expenditure and individual subsidies, issue a document from the information system on the registration of the action (project), the model of which is set out in Annex 3 to this Decree, and submit it to the Ministry for approval;
(c) assess the content of the award of the action (project) for individually assessed expenditure of the State's organisational component or individual subsidy according to the criteria set out in the programme documentation. If the programme administrator finds deficiencies in the assessment of the content of the award, it shall return the award to be completed. If the programme manager does not identify deficiencies, he shall submit the award to the Ministry for approval,
(d) determine the expenditure to finance the action (s) of the State's organisational body or issue a decision to grant a subsidy (hereinafter referred to as "the decision") and determine the conditions for the participation of the State budget in the implementation of the action (s).
(2) An action (project) co-financed by the budget of the European Union corresponding to an action (project) subject to European Commission legislation shall be submitted by the administrator of the programme to the Ministry before it is submitted to the European Commission.
(3) The action (project) co-financed by the financial mechanism or NATO funds corresponding to the action (project) subject to approval by the Financial Mechanism3 shall be submitted by the programme administrator to the Ministry before it is submitted to the Financial Mechanism Office.
(4) The models of the forms for the registration of the action (s) in the information system and data registration system or for the determination of expenditure on the financing of the action (s) by the State body or decision are set out in Annex 2 to this Decree.
(5) When the actions (projects) are entered into the information system, the individual actions (projects) shall be entered in:
(a) the title of expenditure, for the purposes of outputs from the information system, if the organisation of the State is a participant in the programme, or a contribution organisation established by it;
(b) the grant title, for the purposes of outputs from the information system, where a person other than the State's organisational body is a participant in the programme, or a contribution organisation established by it.

12. in Article 6 (1), at the end of the text of point (a), the words "from the financial mechanism or from NATO funds" shall be added after the words "European Union,";
13. in Article 6 (1) (b), the words "values of indicators, parameters" shall be replaced by the words "programme objectives" and the words "set out in the action registration sheet" shall be replaced by the words "contained in the establishment of expenditure on the financing of the action (project) of the State's organisational component."
14. in Article 6 (1), the words "(project) and the documents proving the amount of expenditure incurred to finance the action (project) shall be added at the end of the text in point (c), with the exception of expenditure to be charged and settled financially under point (a)."
15. in Article 6 (1) (e), the words "set out in the action registration sheet" shall be replaced by the words "set out in the financing expenditure of the action (s) for the State's organisational units."
16. In Article 6, at the end of paragraph 2, the sentence "If the programme administrator does not identify deficiencies, a final evaluation of the action (s) shall be carried out using the form set out in Annex 3 to this Decree. ';
17. in Article 6, paragraph 4 is deleted;
