Ministry of Chemical Industry
of 11 February 1965
on product packaging management
The Ministry of Chemical Industry provides in agreement with the participating central authorities pursuant to § 394 (1) of Economic Code No. 109 / 1964 Coll. (hereinafter referred to as the Act):
Scope
(1) This decree applies to transport packaging *) intended for their construction and material, from which they are made for multiple use in the supply of products between socialist organisations.
(2) Packaging not listed in Annex 2 (items 1 to 104) is subject to the provisions of this Decree where the conditions set out in paragraph 1 are fulfilled for the purpose of application and execution. For these packages, the supplier of the products (in contract, invoice, delivery note, etc.) shall indicate that the packaging in which the products are supplied is subject to the provisions of this Order. If they do not do so, they cannot exercise the rights of the customer under this Order.
(3) This decree does not apply to:
(a) pallets, transporters (containers) and transport boxes of carriers, or other similar transport equipment thereof; * *) shall, however, apply to border pallets and transport boxes of transporters;
(b) packaging the circulation of which is regulated by special regulations, * * *)
(c) packaging supplied by the customer,
(d) packaging of goods dispatched abroad;
(e) packaging in which goods were imported from abroad and delivered by the importing organisation to the first domestic customer;
(f) packaging included in the price of the goods. However, organisations may agree to return them.
(4) Packaging materials (e.g. wrapping paper) and auxiliary packaging materials (e.g. wood wool) are not packaging within the meaning of this Decree.
(5) The inner packaging, if any, and its nature allows it, or if it serves to attach the product inside the packaging, shall be returned at the same time as the packaging. External fastening material (e.g. beams, angles, wedges) shall be subject to the provisions of this Decree only if its return is reserved by the supplier (in the invoice, delivery note, etc.) or if specific regulations so provide.
Return of packaging
(1) The collector is obliged to return the packaging to the supplier as soon as it has been emptied, but not later than within the time limits set out in Annex No 1, unless, exceptionally, a special rule is provided for, or a different time limit is agreed between the organisations concerned.
(2) The supplier may agree to extend the time limit set for the return of packaging where this is economically appropriate (e.g. change of plan, frontloading, seasonal supply or seasonal need, supply of ships travelling abroad, storage of products in packaging). The collector must request an extension of the time limit before its expiry. The time limit for returning the packages shall be extended by an agreed period, even if the agreement is concluded only after the original period has expired. The supplier is obliged to agree to a reasonable extension of the deadline for returning the packaging where the customer so requests because the products had to be stored separately until the complaint has been settled.
(3) The course of packaging between production organisations and organisations carrying out the disposal of their products (where appropriate commercial organisations), as well as between organisations of the same department, may be adjusted by their superior authorities, after consultation with the Ministry of Chemical Industry, by derogation.
(1) The time limit for the return of packages shall begin on the day following the date on which the first public carrier or mail in the Czech Republic took over the products supplied in packages for transport from the supplier; in the case where the customer has taken the products directly from the supplier or the supplier has supplied them with its own means of transport, on the day following the date of their surrender to the customer.
(2) In the event of premature performance, if the customer has been refused (Section 169 of the Act), the deadline for returning the packaging shall begin from the first day of the contractual delivery period.
(3) The time limit for returning the packages is respected if the customer has supplied the package to the supplier or if he has transmitted it for transport to the public carrier or post office at the latest on the last day of the prescribed or agreed time limit. If the time limit for returning the packages has not been complied with only because the public carrier has not accepted the consignment duly declared for transport, the period of delay by the carrier shall not be added for the purpose of property sanctions. In such a case, the buyer in the transport document shall document the date of the declaration of empty packaging for transport (e.g. by the carrier confirmed by the indication on the transport document).
(4) Where the supplier is obliged to withdraw the empty packaging himself under an agreement with the customer, the customer shall meet the deadline for repayment by notifying the supplier, at the latest on the last day of the deadline, that the packaging is ready to be removed.
(1) Unless otherwise agreed, the packaging shall be returned to the consignor to the place where it was sent when the products were delivered.
(2) Each of the participating organisations will cover the cost of transporting packaging in one direction.
(3) When transporting packaging carried out by a public carrier or by post, the risk of loss or damage to packaging shall be borne by each of the participating organisations in one direction, while when transporting to the customer the risk of loss or damage to packaging of the organisation at whose risk the transport of the products is concerned.
(1) The collector is obliged to return and the supplier is obliged to accept packaging of the same type, size and material as the packaging in which the products were supplied and the condition of which corresponds to normal wear. The collector shall treat the packaging properly; in particular, packaging must be returned completely empty and not contaminated by other substances. If it is provided for in specific provisions that emptied packaging must be cleaned before returning in a certain way (e.g. rendering, disinfection), the customer is obliged to carry out such operations.
(2) Where the supplier of the products designates packaging exclusively for the supply of a particular type of product and where this is apparent from the label on the packaging, the purchaser is obliged to return the packaging only to the organisation and to the place resulting from the label.
(1) Returned packaging is always counted on the fulfilment of the oldest obligations; However, they must be packaging of the same type and, where appropriate, identification (Section 5 (2)).
(2) Where packaging sheets are introduced between organisations, returned packaging shall be counted according to these documents. Details of the method of registration and the accounting of packaging by packaging sheet shall be determined or agreed upon when they are introduced.
(1) In the case of en route supplies, the consignee of the products is obliged to return the packaging directly to the consignor unless the organisation concerned has agreed otherwise.
(2) The rights arising from this decree against the recipient of the products are exercised by an organisation which has management (ownership) on the route supplies, unless otherwise agreed between the consignor and the supplier. However, such an agreement shall be notified to the recipient of the products by the supplier.
(3) The provisions of this Order on the rights and obligations of the supplier and the customer apply mutatis mutandis to the consignor and the consignee in the case of en route supplies.
Non-refundable periodic penalty payments
(1) If the customer does not return the packaging within the prescribed or agreed time limit, the supplier is obliged to pay a periodic penalty payment of 50% of the registration price of the packaging (Annex 2).
(2) If the customer does not return the packaging within two months of the expiry of the period of repayment, he shall be obliged to pay the supplier an additional penalty equal to three times the registration price of the packaging; This triple is also covered by a replacement for the unreturned packaging.
(3) If the customer returns the packages for which the supplier has charged him three times the registration price referred to in paragraph 2 for non-return, he shall be obliged to notify the supplier and charge him a refund equal to the registration price of the packages; the supplier is obliged to accept those packages back and pay the registration price to the customer if they are capable of further use.
(4) If the customer returns the packaging after the right of the supplier to pay three times the registration price of the packaging, but before it is accounted for, he shall be obliged to pay a penalty payment to the supplier only twice the registration price.
Loss or destruction of packaging
(1) If the packaging is lost or destroyed in the transport of products by a public carrier or by mail, the customer shall notify the supplier, upon receipt of the carrier's registration or confirmation, that the packaging has been lost or destroyed during transport, within the maximum period for returning the packaging. If the packaging is lost or destroyed as a result of a natural disaster or other irrevocable event with the customer, the customer shall notify the supplier of this circumstance within the same time limit, calculated from the detection of the loss or destruction of the packaging, and shall prove it accordingly.
(2) If the customer fails to comply with the notification obligation referred to in paragraph 1, he shall be obliged to pay the periodic penalty payment of the amount set out in Paragraph 8 (1) and (2).
(3) The date on which the supplier received notification of the loss or destruction of the packaging referred to in paragraph 1 gives him the right to pay against the customer the registered price of the packaging lost or destroyed; where such loss or destruction has occurred during the transport of the products, the supplier shall be entitled to such a right only if the customer, as referred to in Article 4 (3), was in danger of transport.
(4) For the loss or destruction of returned empty packages when they are transported back by a public carrier or by mail, the customer shall pay the supplier the registration price in accordance with Article 4 (3) if he was in danger of such transport.
(5) The refunds referred to in paragraphs 3 and 4 shall be reduced by the amount received by the supplier of the products following a legitimate claim from the carrier.
(6) In other cases of non-return of packaging because they were lost or destroyed at the customer, the customer is obliged to pay the penalty payment of the amount referred to in § 8 (1) and (2).
Derogation of packaging
(1) In the event of significant damage to the packaging, or where the packaging has been so degraded by use that it is not fit for circulation, the customer shall immediately notify the supplier, who shall provide the customer with the disposal of the packaging.
(2) Specific provisions apply to the further use of certain wood and paperboard packaging. *)
Compensation for wear
Compensation for wear of packaging may be charged if the organisation or their superior bodies so agree and if the value of packaging is not included in the price of the products.
Packaging records
(1) The supplier must indicate in the invoice for the products supplied (on the documents annexed thereto), or on the packaging sheets, the type and quantity of packages (at least by reference to the relevant entry in Annex No 2), in such a way as to avoid confusion of the packaging or doubts as to the quantity and packaging referred to in Annex 2. If the supplier fails to comply with this obligation, he loses his right to half the penalty payment (Paragraph 8 (1) and (2)).
(2) If the supplier accounts to the customer in accordance with Paragraph 8 (2) for unreturned packaging three times the registration price, he shall write them off from the packaging records.
(3) In the case of recorded packaging, organisations shall regularly - at least once a year - agree on the movement of packaging. If the supplier submits to the customer or the supplier an extract of the record of the movement of the entrusted packaging, the other organisation shall send its written observations within one month of receipt of the extract; If they do not, they shall pay a penalty of 50 CZK for each day of delay, but not more than 1000 CZK.
If the registration price is set in Annex 2 according to the weight of the packaging, the organisation may agree on the level of the registration price per piece. Similarly, they may also agree if the registration price per head is fixed.
Packaging invoicing
(1) When products are delivered, the packaging is invoiced in accordance with price regulations, the recovery of which is inadmissible for health reasons.
(2) Organisations may agree that the supplier will invoice packaging in cases where their return is not effective for serious economic reasons.
(3) Organisations or their superior authorities may, where economically appropriate, agree that certain packaging which the customer is obliged to return will be invoiced by the supplier with the products delivered at or multiple of the registration price. At the same time, however, it must agree on the conditions under which such invoiced packaging will be accepted back by the supplier. In this agreement, the obligation of the supplier to take back the packaging available cannot be excluded.
(4) Where the packaging referred to in paragraphs 1 and 2 is invoiced, the provisions of paragraphs 2 to 12 and Annex No 1 shall not apply.
Transitional and final provisions
(1) The rights arising from the relationship between suppliers and customers in the course of the circulation of packaging before 1 April 1965 are settled in accordance with the existing rules. The time limits for returning packages which began before 1 April 1965 shall be assessed in accordance with the existing rules until their conclusion.
(2) The supplier shall be entitled to charge for the supply of products completed before 31 December 1966 for wear and tear of packaging in the current manner (i.e. according to Annex 2 to Order No 208 / 1957 of the Ú. l., and if he has already charged it) if he does not previously reach an agreement under Paragraph 11, or if the value of packaging is not included in the prices of the products.
(1) The following shall be deleted:
(a) Decree No. 208 / 1957 of the Ministry of Internal Trade on the management of packaging in the circulation of goods;
(b) a communication from the Ministry of Internal Trade on Article 6 (2) of Decree No 208 / 1957 of the Úl. published in the figure 13 of the Official Journal of 1958;
(c) Paragraph 6 (1) of Decree No. 119 / 1964 of the Ministry of Chemical Industry Coll., which issues the basic conditions for the supply of chemical products,
(d) the provisions of § 10 (1) and (6) of Decree No. 129 / 1964 Coll., which issue the basic conditions for the supply of food and certain other products.
(2) On 1 April 1965, the measures of the main arbitrator ČSSR no. HS-1914 / 64 / 34.3 of 11.9.1964, which extended the effectiveness of Decree No. 208 / 1957 Ú. l., on the management of packaging in the circulation of goods, to beer barrels registered in the amount of 84 Collection of Acts of 1964, cease to be effective.
(3) The provisions on the management of packaging contained in the specific provisions remain unaffected.
(4) The agreements negotiated under Paragraph 9 (2) of Decree No 208 / 1957 Ú. l shall also remain without prejudice.
This decree shall take effect on 1 April 1965.
