laying down closer conditions for the submission of applications for registration of data on the authorisation of representation via the public administration contact point and other conditions for the execution of the agenda
The Digital and Information Agency provides pursuant to § 69 (3) (e) of Act No. 111 / 2009 Coll., on Basic Registers, ("the Act '), as amended by Act No. 100 / 2010 Coll., Act No. 192 / 2016 Coll., Act No. 12 / 2020 Coll., Act No. 36 / 2021 Coll., Act No. 261 / 2021 Coll., Act No. 429 / 2022 Coll., Act No. 471 / 2022 Coll. and Act No. 125 / 2024 Coll.:
§ 1
Subject matter
This decree provides
(a) the requirements for the content, structure and other details of the application for registration of an authorisation to represent, the registration of a change to the authorisation to represent and the registration of an authorisation to represent pursuant to Article 52e (9) of the Act (hereinafter referred to as the "application for registration of a right to represent"),
(b) the manner in which the agenda is kept when the application for registration of an authorisation for representation is processed; and
(c) the extent and duration of the storage of the data relating to the application for registration of the authorisation for representation.
§ 2
Content and structure of the application for registration of an authorisation to represent
(1) Where there is a representative or represented natural person or an undertaking natural person, the application for registration of the creation of an authorisation for representation shall contain, in respect of such persons, information within the scope of the general procedural requirements laid down in the Administrative Rules and the following particulars:
(a) place and district of birth; the place and state of birth of the data subject born abroad,
(b) citizenship; and
(c) the number and type of identification document by which the person who submitted the application for registration of the authorisation to represent him has proved his identity.
(2) Where the representative or represented legal person is a legal person, the application for registration of the creation of an authorisation for representation shall contain the general requirements of the administrative procedure and the particulars of the person authorised to act on behalf of the legal person within the scope of paragraph 1.
(3) The application to register the creation of an authorisation for representation also contains:
(a) the code of the template created under Section 52e (5) of the Act;
(b) the definition of the powers of representation, including the possibility of its imposability;
(c) the identifier of the representation authorisation in respect of the transfer of the existing representation authorisation;
(d) the date on which the authorisation to represent is established; and
(e) the date of expiry of the authorisation for representation.
§ 3
Content and structure of the application for registration of an amendment or termination of the authorisation to represent
The application for registration of an amendment or termination of the authorisation shall indicate:
(a) the information referred to in Article 2 (1) and (2),
(b) the identifier of the authorisation to represent the change or termination of which is required; and
(c) the requested change in the information referred to in Article 2 (3) (e) in the case of a request for a change in the authorisation to represent.
§ 4
Method of keeping a record of the agenda, scope and duration of data storage
(1) The contact point of the public administration shall provide the following information to the Digital and Information Agency for the purposes of the registration and registration of data on the application for registration of the authorisation for representation in the information system of the authorisation for representation:
(a) the username of the person who has accepted the application for registration of the authorisation and the identifier of the public administration contact point;
(b) the identifier of the application for registration of the authorisation to represent; and
(c) identity details of the representative and represented to the extent of:
1. the natural person's name, name, surname, date of birth, nationality, number and type of identification document by which the person who submitted the application for registration of the authorisation to represent him has established his identity,
2. the individual identification number of the person in business;
3. legal person identification number of the person.
(2) The application for registration of an authorisation to represent a public authority contact point shall be kept for a period of 10 years from the end of the calendar year in which the application was lodged.
§ 5
Efficacy
This Decree shall take effect on 1 July 2025.
