DECLARATION
of 11 June 2018
amending Decree No 512 / 2002 Coll., on the special competence of officials of local and local authorities, as amended
The Ministry of the Interior provides, pursuant to § 42, for the implementation of § 21 of Act No. 312 / 2002 Coll., on officials of local and local authorities and on the amendment of certain laws:
Decree No. 512 / 2002 Coll., on the special competence of officials of the local authorities, as amended by Decree No. 41 / 2006 Coll., Decree No. 273 / 2007 Coll., Decree No. 44 / 2012 Coll., Decree No. 39 / 2016 Coll. and Decree No. 173 / 2017 Coll., is amended as follows:
1. in Paragraph 1 (1) (h):
"(h) in the management of taxes, charges and other similar cash transactions,"
2. In the Annex to the section "Ministry of Finance 'in the section" Financial management and review of territorial units', the text in the fourth column reads:
"Act No. 128 / 2000 Coll., on municipalities (municipal establishment), as amended,
Act No. 129 / 2000 Coll., on Counties (Regional Establishment), as amended,
Act No. 131 / 2000 Coll., on the Capital City of Prague, as amended,
Act No. 250 / 2000 Coll., on the budgetary rules of the territorial budgets, as amended,
Act No. 218 / 2000 Coll., on budgetary rules and amending certain related laws (budgetary rules), as amended,
Act No. 243 / 2000 Coll., on the budgetary determination of the proceeds of certain taxes to local authorities and certain state funds (Act on the Budget Determination of Taxes), as amended,
Act No. 280 / 2009 Coll., Tax Code, as amended,
Act No 420 / 2004 Coll., on the examination of the management of local authorities and voluntary associations of municipalities, as amended,
Act No. 320 / 2001 Coll., on financial control in public administration and amending certain laws (Financial Control Act), as amended,
Act No. 565 / 1990 Coll., on Local Charges, as amended,
Decree No. 323 / 2002 Coll., on budgetary composition, as amended.
- the establishment of the budget and the final account,
- processing of the budget by budget composition,
- monitoring and evaluation of the implementation of the budget revenue and expenditure by budget composition,
- accounting and settlement of financial relations with the state budget, regional budgets, municipal budgets, other budgets, state funds and other persons,
- carrying out controls on the own management, management of organisational components and established and established legal entities,
- internal audit,
- the management of levies and periodic penalty payments for breaches of budgetary discipline. ';
3. In the Annex to the "Ministry of Finance ', the words" in the management of taxes, fees and other cash transactions to public budgets' are replaced by the words "in the management of taxes, charges and other similar cash transactions'.
4. In the Annex to the "Ministry of Finance ', the words" with the exception of the administration of levies and periodic penalty payments for breaches of budgetary discipline' shall be inserted after the words "the tax administrator's procedure and the rights and obligations of persons involved in tax administration in general '.
5. In the Annex under the heading "Ministry of the Interior ', the words" including the protection of classified information within the scope of the "Reserved' classification in relation to that agenda 'shall be inserted after the words" provision of a special facts agenda'.
6. In the Annex in the section "Ministry of the Interior ', the words" Government Regulation No. 51 / 2004 Coll., on State Defence Planning, as amended' are replaced by the words "Government Regulation No. 139 / 2017 Coll., on State Defence Planning '.
7. In the Annex under the heading "Ministry of the Interior ', the words" Protection of classified information: Act No. 412 / 2005 Coll., on the Protection of classified information and on security competence, as amended, of Government Decree No. 522 / 2005 Coll., establishing the list of classified information, as amended. - the exercise of public administration in matters of the protection of classified information in the delegated jurisdiction of the local authority.';
8. In the Annex in the section "Ministry of Agriculture ', the words" Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and amending certain other laws (Act on the State Agricultural Intervention Fund), as amended,' shall be inserted after the words "Act No. 252 / 1997 Coll., on Agriculture, as amended, '.
9. In the Annex in the section "Ministry of Agriculture ', the dot and the words" - registration of agricultural entrepreneurs pursuant to § 2f et seq. Act No. 252 / 1997 Coll., on Agriculture, as amended. At the level of the municipal authorities with extended scope: - the registration of agricultural entrepreneurs pursuant to § 2f et seq. of the Agricultural Act.' is deleted.
Transitional provisions
1. Special professional competence in the management of taxes, fees and other cash transactions to public budgets, as demonstrated by Decree No. 512 / 2002 Coll., as effective until the date of entry into force of this Order, shall be considered as a special professional competence in the management of taxes, fees and other similar cash transactions under Decree No. 512 / 2002 Coll., as effective from the date of entry into force of that Order.
2. An official who has demonstrated special competence in the management of taxes, fees and other cash transactions in public budgets pursuant to Decree No. 512 / 2002 Coll., as effective until the entry into force of this Order, may carry out administrative activities consisting in the imposition of levies and periodic penalty payments for breach of budgetary discipline, without demonstrating special competence in the financial management of the local authorities and its review.
Efficacy
This Regulation shall enter into force on 1 July 2018.
