DECLARATION
of 1 March 2005
amending Decree No 221 / 2004 Coll., laying down lists of dangerous chemicals and dangerous chemicals whose placing on the market is prohibited or whose placing on the market, putting into circulation or use is restricted
In agreement with the Ministry of Health and the Ministry of Agriculture, the Ministry of the Environment provides, pursuant to § 26 (3) of Act No. 356 / 2003 Coll., on Chemicals and Chemical Products and amending certain laws, as amended by Act No. 186 / 2004 Coll.:
Decree No. 221 / 2004 Coll., establishing lists of dangerous chemicals and dangerous chemicals whose placing on the market is prohibited or whose placing on the market, putting into circulation or use is restricted, shall be amended as follows:
1. In Annex No 2, Part I, point 23, the text in the third column reads:
"In substances or preparations placed on the market or put into circulation, these substances shall not be used in concentrations of 0,1% or more by mass. '
2. In Annex No 2, Part I, point 28 in the third column of paragraph 1 shall read:
"1. These substances may be used in sling sets which are inserted into pierced ears or other pierced parts of the human body only if the rate of nickel release from these articles is less than 0,2 μg / cm2 / week (migration limit). '
3. In Annex 2, Part I, point 28, in the third column of paragraph 2, the word "earrings' is replaced by" earrings not inserted into pierced ears'.
4. In Annex No 2, Part I, point 43 in the third column of paragraph 1 shall read:
"1. Azo dyes which may release one or more of the aromatic amines referred to in point 43 of the Appendix to this Annex at detectable concentrations, i.e. at concentrations above 0,003% by mass, by reducing the cleavage of one or more azogroups. in finished or dyed articles, according to the test methods set out in that Appendix, shall not be used in textile and leather products which may come into direct and long-term contact with human skin or oral cavity, such as:
- clothing, bedding, towels, hairpins, wigs, hats, diapers and other sanitary articles, sleeping bags,
- footwear, gloves, straps, handbags, wallets, briefcases, seat covers, neck money bags,
- textile or leather toys and toys incorporating textile or leather garments,
- yarns and fabrics intended for the final consumer. ';
5. In Annex No 2, Part I, point 44, in the third column, the following paragraph 3 is added:
'3. Paragraphs 1 and 2 shall not apply to emergency emergency evacuation systems until 31 March 2006. ';
6. In Annex No 2, Part I, point 46, in the third column, the following is added: "Commercial arrangements for pesticides containing nonylphenol ethoxylate, registered before the entry into force of this provision, may be placed on the market or used until the expiry of the marketing authorisation. Commercial modification of biocides containing nonylphenol ethoxylate, authorised before the entry into force of this provision, may be placed on the market or used until their authorisation expires. '
7. In the Appendix to Annex No 2, point 43, the following table is added:

This Decree shall take effect on the 15th day following its publication, with the exception of Article I, points 2 and 3, which shall take effect on 1 September 2005.
