THE LAW
of 19 April 1990
amending and supplementing Foreign Exchange Act No 162 / 1989 Coll.
The Federal Assembly of the Czechoslovak Federal Republic has decided on this law:
Act No. 162 / 1989 Coll., Foreign Exchange Act, is amended as follows:
1. In the first sentence of Article 9 (3), the words "and natural persons - entrepreneurs (" entrepreneur ") 6a 'shall be inserted after the words" legal persons'. the following footnote 6a is added:
"(6a) Act No. 105 / 1990 Coll., on the Private Business of Citizens. '.
2. In Article 12 (1), the following text is inserted after point (a):
'(b) an entrepreneur to the extent that he may be designated in the implementing regulation;';
3. point (b) shall be renumbered as point (c).
4. In the first sentence of Paragraph 12 (1) (c), the words "natural person 'shall be replaced by the words" other natural person than that referred to in point (b)' and the amounts "1000 Ccs' in the first and second sentences shall be replaced by" 2000 Ccs'.
5. In Article 12 (2) (b), the words "or an entrepreneur 'shall be inserted after the words" a legal person'.
6. In the first and second sentences of Paragraph 13 (1), the words "or entrepreneur 'are added after the words" legal person'.
7. In Paragraph 13 (2), the words "referred to in paragraph 1" shall be inserted after the words "to another foreign exchange domestic."
8. In Paragraph 13 (3), the words "referred to in paragraph 1 'shall be inserted after the words" or other persons' and the text set out at the end of the provision in brackets shall be deleted.
9. In the second sentence of Paragraph 13 (5), the words "referred to in paragraph 1 'are added after the words" Foreign exchange seal'.
10. In Section 14, the words "or entrepreneur 'shall be inserted after the words" legal person'.
11. in Article 23 (1) (b), the words "or entrepreneur" shall be inserted after the words "legal person."
12. in Article 23 (1) (d), the words "or entrepreneur" shall be inserted after the words "legal person."
13. in Paragraph 26 (1) (e), the words "real estate" are deleted.
14. In Paragraph 26, paragraph 4 is added after paragraph 3:
"(4) A foreign exchange alien cannot acquire ownership of foreign exchange domestic property in the territory of the Czechoslovak Federal Republic except for inheritance. The Government of the Czechoslovak Federal Republic may, in agreement with the Government of the Czech Republic and the Government of the Slovak Republic, lay down the conditions under which the foreign exchange seal may exceptionally transfer the right of ownership of such property to foreign exchange aliens."
15. in Article 30 (4), the amount "1000 CZK" shall be replaced by "2000 CZK";
16. In Paragraph 33 (4), the words "and on condition that they are brought back to the country 'shall be added at the end.
17. The title of Section 11 is: "Participating in business abroad."
18. In Paragraph 34 (1), the words "domestic or 'are deleted and at the end the words" issued in an agreement with the Federal Ministry of Finance and the Federal Ministry of Foreign Trade' are added.
19. Paragraph 34 (3) is deleted.
20. In Paragraph 34, paragraph 4 is renumbered and renumbered paragraph 3, in which the words "paragraphs 1 and 3 'are deleted and replaced by" paragraph 1'.
21. In Paragraph 36, paragraph 2 is added after paragraph 1:
"(2) Income in foreign exchange assets arising from business activities shall be kept by the foreign exchange monetary institution for entrepreneurs separately from other foreign exchange domestic income - natural persons in foreign exchange funds. The provisions of paragraphs 1 and 3 shall apply mutatis mutandis to the foreign exchange account set up by entrepreneurs. ';
22. Paragraph 36 (2) and (3) are renumbered paragraphs 3 and 4.
23. in Article 36 (3), the words "and 2" shall be added after the words "in accordance with paragraph 1."
24. Paragraph 59 is deleted.
This Act shall take effect on 1 May 1990.
