establishing the Model Statute for the Urban National Committees
The Model Statute of the Municipal National Committees (hereinafter referred to as the Model Statute) provides, pursuant to Section 26 of Act No. 69 / 1967 Coll., on National Committees
(a) on which issues the Government entrusts the administration of the municipal national committee in Brno, Ostrava, Pilsen and Košice, which otherwise falls within the competence of the regional national committee under generally binding rules; such urban national committees shall be referred to as group I in further provisions;
(b) on which issues the Regional National Committee will entrust the administration of the municipal national committees, which otherwise falls within the jurisdiction of the Regional National Committee under generally binding regulations; in the light of differentiation, these urban national committees shall be referred to as Group II and III in other provisions.
- to the II. group include the municipal national committees at the locations of the counties and other cities designated by the Regional National Committee on a proposal from the District National Committee discussed with the Regional National Committee, and
- to the III group of other municipal national committees.
The municipal national committees of the first group are managed by the regional national committee, the municipal national committees of the second and third groups by the district national committee;
(c) the scope of the municipal national committee, its organisation, the mutual division of work and the powers of its bodies, the framework for defining the heading of its managed organisations and facilities, the differentiation of the urban national committees and the diversity of their forms of work and the creation of assets which assist the municipal national committee in carrying out its tasks.
The municipal national committees shall draw up, on the basis of the Model Statute, their own statute for the preparation of which they shall conduct a detailed analysis of the political, economic and cultural situation of the city. In its Statute, the territories of the city to which the competence of the municipal national committee (cadastral territory, part of the city and their local names apply) shall indicate the brief characteristics of the city in terms of its economic, cultural and social tasks and, where appropriate, the brief characteristics of the town's territorial territory and its interrelations. They shall disseminate in detail their responsibilities on the different sections of the activity, the organisation of their bodies, their competence and division of labour, the activities of the assets they establish, the means of ensuring the participation of citizens in the work of the municipal national committee and the range of organisations and facilities they manage or manage. Each municipal national committee shall highlight in its Statute those sections of its activities which are crucial for the life of citizens and the development of the city.
The municipal national committee at the spa site also takes into account the tasks which it performs under Act No. 20 / 1966 Coll., on the care of the health of the people, and includes in it the rights and obligations arising from the existing status of the spa site.
The municipal national committee shall approve the Statute at its plenary session after preliminary consultation with citizens and with the national higher-level committee. Similar changes and additions are made.
In order to meet these objectives, the National Assembly issues the following:
Model statute for municipal national committees.
I.
Status of the municipal national committee
City National Committee
1. Is the body of a single socialist state power and administration in a city which is simultaneously self-governing. It combines in its work the fulfilment of the needs of a company with special needs in its territorial area and brings the interests of the city into line with the social interests;
2. As a representative of the working people, which is composed of Members, it carefully and objectively examines the interests of citizens and their needs, advises them on proposals for serious measures, adds them to the solution and performance of its tasks, provides them with accounts of its activities and thus creates all-round conditions for the involvement of citizens in the administration of the State as widely as possible;
3. is the body which carries out, to the extent specified, the exercise of the administration in the city;
4. cooperate with social and interest organisations operating in the city, in accordance with their mission and focus. Cooperation shall apply mainly in the preparation and implementation of measures aimed at urban development, the pooling of financial and material resources for the building and operation of cultural, health, social, sports and other facilities of general interest, the coordination of activities and the cultural educational work of the national committee and social organisations;
5. Cooperates with other state bodies operating in the city to achieve common objectives;
6. Cooperates with other national committees operating in the city's catchment area in preparation for decisions affecting their achievement of the interests of the city and its surroundings;
7. in relation to centrally managed economic and other organisations, as well as to cooperative organisations operating in the city, the public administration shall, on the basis of the relevant provisions, ensure important social interests such as the harmonious development of the city, the security of the health of the people, the creation and protection of the environment, the safety of work, the purity of water and air, etc. It shall monitor the compliance of such organisations with their obligations imposed on them by the specific provisions governing the various sections of government within the scope of the responsibilities conferred on the municipal national committee;
8. deliver an opinion on matters of public interest; where they affect the powers of other bodies, they shall be submitted to them for resolution;
9. exercise control over the activities of the authorities and organisations it manages or manages; the content of this check is aimed at safeguarding the interests of the State, encouraging entrepreneurship and the autonomy of organisations without interference with their own management and at how they fulfil their mission, in particular how they safeguard the needs of the population.
II.
Scope of the municipal national committee
The Municipal National Committee ensures the development of economic and cultural life in the city by applying all its means of power, administrative, economic and cultural education. In particular:
- develop political and cultural activities and ensure socialist coexistence between citizens;
- the widest participation of citizens in the management, administration and control of urban affairs ensures the development of socialist democracy;
- protect the socialist achievements and rights of citizens and organisations and lead citizens to fulfil their obligations; ensure respect for socialist legality and public order in the city;
- ensure the creation and continuous improvement of the environment, the growth of both the physical and cultural levels of the population;
- ensure the planned development of the economic base and cultural, health and social construction of the city, taking into account the needs and interests of the city and its surroundings;
- encourage subordinate organisations to safeguard the interests and needs of citizens and, above all, to control their activities;
- organizes a socialist competition to promote the city.
On the planning section
A. In planning the comprehensive development of the economy on the territory of the city, the municipal national committee shall in particular carry out the following main tasks:
1. It shall, after consultation with the District National Committee or the Regional National Committee, develop draft plans for the comprehensive development of the economy on the territory of the city, which it shall submit to the national higher-level committee under the applicable rules.
2. It shall assess the forward-looking plans of the undertakings and organisations operating in the territory of the city and managed by the central, cooperative bodies and national higher-level committees, in particular in the following areas:
(a) consult such undertakings and organisations on their long-term development concepts and methods of implementation with a view to optimising the use of the natural and economic conditions of the territory of the city, the effective deployment of production forces, the pooling of resources for the construction of educational, cultural, health, social, water and other facilities of general interest and in terms of comprehensive development and links to the directly managed economy;
(b) assess the solution of fundamental issues relating to:
- investment construction of enterprises and organisations within the territory of the city,
- the needs of the workforce, recruitment, employment of women, housing, civil and technical equipment, etc., and takes an opinion on them.
3. Develop and implement ideas, analyses and studies on the possibilities of using natural and economic conditions and creating optimal city development proportions.
4. It shall decide, within the limits of the defined competence, the location and disposal of the establishments and establishments it controls.
5. It gives a binding opinion to centrally managed economic organisations, cooperative organisations and other organisations in cases provided for in specific provisions; the organisation is obliged to cooperate with the municipal national committee and to provide it with evidence of the investments and other important measures needed by the urban national committee to ensure the overall development of the city.
6. It shall use the relevant department of the State Statistical Office to carry out its tasks, in particular in the planning section, urban and regional statistics, to the extent specified.
7. It shall ensure the consistency of the comprehensive development of the city with its catchment area and shall cooperate to this end with the relevant national committees.
B. When planning its own economy, the municipal national committee is based on the provisions of the National Committees Act, and its development is provided by a system of economic plans which express the objectives set for the period, routes and means of implementation.
It shall establish and approve:
- a long-term economic plan setting out the concept of urban development managed by the urban national committee; based on the long-term plans of the national higher-level committee;
- an implementing economic plan (short-term programme) which ensures and clarifies the tasks of the long-term plan in accordance with the conditions set out in its implementation;
- budget.
When managing businesses, it primarily uses long-term economic instruments and ensures that their maximum autonomy and entrepreneurship are applied.
On financial management and asset management
A. The City National Committee shall manage under a budget which it shall establish under its own authority. It is based on comprehensive binding financial relations with the budget of the national higher-level committee, established in the long term and on special-purpose subsidies. The budget must be balanced and discussed with citizens by the municipal national committee.
The budget of the municipal national committee shall include, in a defined breakdown, the revenue and expenditure of the national committee and its budgetary organisations and the financial relations with its economic and contribution organisations. The budget includes revenue to the extent set out in Section 32 of the National Committees Act.
The municipal national committee must ensure that its own commitments and legal obligations are covered in the budget.
In the more detailed development of issues relating to the budget and budgetary management, in particular as regards the sources of revenue of the municipal national committee, the municipal national committee shall be governed by the Law on national committees and the relevant legislation and shall ensure that budgetary appropriations are used effectively to further develop and meet the needs of its inhabitants. It regularly informs citizens of its financial management.
The municipal national committee may pool its resources with the resources of other national committees and with the resources of socialist organisations to build or operate joint facilities.
B. City National Committee
- keep records of its management and check the correctness of keeping records of the subordinate undertakings and organisations;
- develop analyses of the creation of own financial resources and evaluate the effectiveness of the financial economic instruments of subordinate organisations;
- carry out periodic audits of the management of subordinate organisations;
- carry out financial settlement and draw up the final account;
- to administer taxes and charges which are the revenue of its budget;
- manages the national assets used to carry out its tasks and the surplus immovable national assets, for which the social interest requires it to remain in state socialist ownership for future tasks.
C. City National Committee of Group I
- decide, after consultation with the national district committees, which of the revenues of the municipal national committee will constitute the own revenue of the district national committees in accordance with the scope to be defined by them; lay down the principles of material interest of the District National Committees in the results of the management and the way in which the results are assessed;
- carry out the administration and control of state finances to the extent specified by specific rules;
- carry out the interim management of national assets under Section 65 (3) of the Economic Code.
On the spatial planning section
City National Committee
1. by zoning, it creates conditions for the development of the city and its catchment area, for the optimal implementation of the tasks of economic and cultural construction. To this end, it shall define, within the framework of urban planning, the areas of the city in the most appropriate composition and scope for the various elements of urbanisation to achieve the necessary consistency between the natural conditions of the territory and social needs;
2. be responsible for developing and addressing the town's territorial plan;
3. in the light of the zoning plan, it shall draw up detailed territorial plans for the various parts of the city for which it is developing the construction programme and which, after consultation, are approved as a mandatory directive for the organisation of the operation and construction of the city;
4. in the exercise of its competence in the field of spatial planning, it shall:
(a) for the complexity, efficiency and consistency of the proposed territorial solution with the national economy development plan;
(b) for the procurement of land-use plans in advance, allowing for the timely and versatile preparation of investment construction on the territory of the city, in particular housing and civil construction;
(c) for the continuous specification of the territorial solution in accordance with changes in the development conditions and needs of the city;
5. uses tools and methods to ensure the implementation of the urban spatial plan, which aim to make efficient use of its areas both under construction and operation;
6. Issue the relevant territorial decision (if it is a building office) in accordance with the approved urban planning.
In creating and protecting the environment
City National Committee
1. ensure consistency in the development of activities of all kinds within the territory of the city with the creation of a socialist environment;
2. as part of the planned management of urban development, establish long-term plans for measures to protect and create the environment which are binding on all businesses and organisations within the city and which are based on:
(a) by its own activities, the authorities and organisations of national committees on the territory of the city;
(b) long-term and / or short-term agreements with organisations managed by the Central, Regional and District National Committee, social organisations or national committees in the city's catchment area, on mutual participation and cooperation in environmental creation;
3. checks the implementation of the measures imposed on organisations in the territory of the city to prevent harmful effects on the environment. In particular, air and water pollution;
4. Fees and fines shall be imposed where it is entrusted under the Air Pollution Measures Act.
In the area of city construction
City National Committee
1. ensure proper and effective organisation of the construction of the city with the possibility to co-organise investment construction serving several organisations and manage the meetings of the participating organisations on investment costs;
2. where it is a construction office, in particular:
(a) carry out the selection of land suitable for the housing and construction of family houses, compile lists of land intended to establish the right to permanent use of socialist organisations and the personal use of citizens and keep lists of land on which the right of personal use has already been established;
(b) decide, in accordance with the provisions in force, on the modification of underground networks and installations, the conditions for their protection and, under the rules in force, the amount of compensation for the construction, repair and operation of such networks and installations, if no agreement is reached between the participants;
(c) compile plans for rendering and decide on demolitions after the expression of the authorities of the State Monument Care and Nature Protection according to the relevant regulations;
(d) decide on the admissibility of buildings within the territory of the city and give consent to their permanent use to the extent specified;
(e) imposes on the owners of the objects the necessary modifications;
(f) authorises information, advertising and similar facilities in buildings, buildings and public spaces;
(g) issue a decision on the expropriation of real estate in accordance with the relevant rules;
(h) exercise state building supervision;
3. carry out, to the specified extent, an investor's function in the field of housing and civil and technical equipment in the city and, in this respect, establish, in accordance with the social guidelines, the main parameters of the concentrated construction of housing units and decide on their implementation;
4. in the area of the economy managed by it, it shall decide, to the extent possible, on the implementation of special-purpose buildings and diffuse housing;
5. Continuous care for the state, level and maintenance of the city's home fund and creates the preconditions for optimum service life and efficient use;
6. to carry out the maintenance and reconstruction tasks of the city's home fund, in particular the housing fund, orienting and developing the activities of local construction and maintenance units of housing organisations;
7. is entitled to establish and manage an urban construction undertaking;
8. Establish and manage an engineering or project engineering organisation (in cities with a large investment scale or complex investor issues).
On the housing fund and non-housing sector
City National Committee
1. In accordance with the Housing Management Act and other regulations, in particular cooperative, corporate and individual housing construction, it is responsible for the consistent application of housing policy in the city and pursues further modernisation of the housing fund and an increase in the housing culture of the urban population. It also uses active participation of apartment users;
2. ensure that the organisation and owners keep the housing, housing and non-residential fund and its surroundings in good condition;
3. manage and decide on the use of non-residential premises in accordance with the relevant regulations;
4. decide, in accordance with the relevant rules, on payments for the use of flats and non-residential premises and on the sale of flats from national property to citizens;
5. Manages the organization of the housing economy and ensures, or other suitable organisational form, with the active participation of users of flats management and maintenance of the housing fund.
On the section of water and forestry
City National Committee
1. ensure the supply of drinking water to the population and organisations on the territory of the city, ensure the drainage and cleaning of waste and surface water, unless the activity is entrusted to another organisation;
2. ensure efficient water management and decide on the necessary and effective measures, in particular to prevent or reduce waste of water, pollution of streams and other waters; lay down rules on penalties for non-compliance with those measures and permit specific water use;
3. be entitled to establish and manage the water management facilities of the city;
4. Helps to ensure forest management tasks, forest fund protection and efficient management of timber. The municipal national committee of the 1st group exercises state control over the forestry sector in the district of the city.
On energy, gas and telecommunications
City National Committee
1. ensure, in cooperation with the relevant organisations, that the development of the city's electricity, gas, heat and telecommunications facilities is consistent;
2. Is entitled to establish and manage thermoplastic equipment if it is to be managed by its managed organisations;
3. provides public lighting of the city.
On the transport section
City National Committee
1. cooperate in coordinating the interconnection of all modes of public transport within its territory in the interests of optimal organisation of transport services;
2. Manages local roads and roads in cities with urban lanes, responsible for their well-being, mobility and proper marking. It shall exercise State supervision and investment on such communications. It shall decide on the inclusion of dedicated communications in the local communications network and on the exclusion of local communications or part thereof from the local communications network where it is not necessary to organise the network effectively. It shall exercise State supervision over public special-purpose communications and shall lead their administrators to care for their mobility, maintenance and renewal;
3. Manages the organisation of public transport and is responsible for ensuring that the needs of the population are met as far as possible, especially when travelling to employment, schools and the field of peri-urban recreation;
4. the City National Committee of the I Group may set up an organisation of transport engineering and, subject to conditions, an organisation for the management and maintenance of local communications;
5. in the places where the public transport is provided by ČSAD, the municipal national committee shall ensure that the service is provided to the necessary extent and quality. It shall cooperate in the decision on the management of urban public transport lines, the establishment of timetables and the setting of the relevant tariffs;
6. coordinate and ensure the development of services for motorists, including, for example, by setting up parking lots, garages, etc.;
7. also provides other necessary transport services to citizens (passenger and freight taxi service) and recreational transport (sightseeing, river, etc.).
On the local production and services section
City National Committee
1. ensure that local production and services properly and smoothly meet the socially justified needs and requirements of citizens and organisations and create the conditions for their optimal development;
2. Coordinates the activities and deployment of the network of its own local production and service organisations with the activities and network of production cooperatives, or other organisations engaged in such activities, in order to ensure an efficient division of work while maintaining the possibilities of mutual competition;
3. be responsible for the development of unpaid services which increase the level of the environment, hygiene, cleanliness and the overall appearance of the city;
4. Establish and manage the enterprises and organisations of local production and services and according to the local conditions and needs of a smaller establishment of the food industry, construction materials, etc., not only in terms of the needs of the city, but also its catchment area. It also supports the development of services for the population by other organisational forms (small establishments, by organising specific forms of internal management, by independent operation of services by individuals, etc.);
5. controls compliance with the principles of good pricing policy and the relevant provisions of the Civil Code in its own local production and service undertakings;
6. Organises the use of local sources of raw materials and coordinates the folk collection of raw materials;
7. may set up an organisation of a comprehensive urban economy, or a separate multi-sectoral enterprise of the urban economy for economic activity and a separate budgetary organisation of the urban economy for budgetary activity, in the event that the activity of one complex urban economy undertaking would be too extensive.
On business and public catering
City National Committee
1. monitor and control the continuous supply of food and industrial goods to the necessary extent and range of inhabitants. It checks the culture of sales and hygiene at the premises. In order to address deficiencies, they shall take action with the competent authorities and organisations which are required to respect the opinion of the municipal national committee;
2. ensure a good level of public catering, accommodation and supplies to the population with solid fuels;
3. establish, in cooperation with trade organisations, the development concept of the retail and public catering networks on the territory of the city. It shall ensure that the network is built in accordance with the housing and needs of the population and the needs of other retail customers;
4. Approves the distribution of outlets, sales hours and takes further measures to ensure the proper supply of the population;
5. Creates assumptions and lays down conditions for the sale of products on urban markets to organisations and individuals to improve the supply of the population. Under conditions, it organises traditional markets (annual markets);
6. it may manage the restaurant and canteens, or establish urban restaurants, wine cellars, canteens, accommodation establishments and retail stores of undertakings and establishments controlled by it;
7th Town National Committee of the I. Group:
(a) decide on the inclusion of public catering and accommodation establishments in price groups;
(b) manage a firm providing supplies of solid fuel.
On tourism and recreation
City National Committee
1. creates assumptions and ensures the development of tourism within the city;
2. coordinate the activities of all authorities and organisations in the city involved in tourism services. In doing so, it shall be responsible for the direct satisfaction of tourism needs in the various sections of the urban economy and shall ensure that the assumptions and conditions for its development meet the needs of the city;
3. Creates the preconditions and ensures the development of recreation on the territory of the city; establish and manage its own recreational facilities.
On the agricultural sector
City National Committee
1. facilitate the development of agriculture in the territory of the city in cooperation with the relevant managing authorities and ensure that the development of agriculture is consistent with the development of other sectors in the city; assist in the security of labour, means of transport, supplies, etc., in particular in top jobs, on the basis of timely and justified requirements of the agricultural management authorities;
2. Supports the development of public interest organisations dealing with small livestock farming, gardening, fruit farming, etc.;
3. the administration of the State on this section shall, in particular:
- monitor compliance with the Law on the Protection of the Agricultural Soil Fund,
- keep records of agricultural land and livestock,
- take measures to combat diseases and other animal diseases,
- keep records of all pests infested parcels, check how users are doing the protection of those parcels and declare civil labour assistance as necessary,
- ensure that agricultural holdings and establishments comply with the regulations on the hygiene, occupational health and fire protection sectors,
- monitor the management of individual farmers, cooperate in concluding their contracts with purchasing organisations and monitor their implementation.
On the education and childcare section
City National Committee
1. Creates conditions for the universal development of youth education and education in the spirit of scientific world opinion and for the close connection of schools to life. It strengthens the authority of the school and seeks the unity of the school, family and society. It manages the activities of the association of parents and friends of the schools it manages;
2. Manages schools and educational establishments (in its own statute it shall specify which schools and educational establishments it manages within the meaning of Sections 20, 25 and 26 of the National Committees Act);
3. co-operate in the determination and modification of school circuits in the first cycle;
4. Expresses itself on the dislocation of school teachers he manages;
5. in the performance of the administration, in particular:
(a) give consent to exceptional admission to school for children who complete six years before the end of December;
(b) determine, where necessary, the order for the admission of children to a school, a school cafeteria or a school cooperative;
(c) address the neglect of compulsory education of children;
6. Provides tasks in the care of children within the scope of the relevant regulations.
On the cultural and information section
City National Committee
1. creates conditions for the universal development of culture and information;
2. Manages and coordinates cultural activities in the city and ensures an increase in its idea level. It shall develop it on the basis of a single plan and coordinate it with the social and other institutions and organisations in the city. It shall take particular care to develop the cultural activities of young people;
3. Manages cultural and artistic facilities in the territory of the city, the activities of which are mainly intended to meet the cultural needs of the city's inhabitants and its catchment area. The higher authorities manage the activities of their cultural facilities in the city, which also serve to meet the cultural needs of the city's inhabitants, in agreement with the municipal national committee. (The Municipal National Committee shall indicate in its own management and management status their activities);
4. in cooperation with professional bodies State conservation takes care of the cultural political use of monuments and reservations, their maintenance and protection, nature conservation and management of monuments of local importance;
5. allows and controls the organisation of individual cultural events, including public production of folk musicians, dance and social entertainment, etc.;
6. ensure the management of the city chronicle;
7. On the information section, it works to raise citizens' awareness as one of the basic conditions of socialist democracy and to increase their social activity.
On the section of physical and sport
