of 16 March 2016
amending Act No. 165 / 2012 Coll., on Supported Energy Sources and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 407 / 2012 Coll., Act No. 310 / 2013 Coll., Act No. 90 / 2014 Coll. and Act No. 131 / 2015 Coll., is amended as follows:
1. Paragraph 4 (12) reads as follows:
"(12) Paragraph 6 (c) shall not apply to producers producing electricity from renewable sources whose main activity is agricultural production. The method of determining the main activity of agricultural production and the way in which the list of producers with the main activity of agricultural production is kept shall be laid down in the implementing legislation. ';
2. In Article 6, the following paragraph 8 is added:
"(8) Paragraph 5 shall not apply to producers which produce electricity from high-efficiency cogeneration whose main activity is agricultural production. The method of determining the main activity of agricultural production and the way in which the list of producers with the main activity of agricultural production is kept shall be laid down in the implementing legislation. ';
This Act shall take effect on the day of its publication.
