GOVERNMENT REGULATION
of 25 February 2004
amending Government Regulation No 445 / 2000 Coll., establishing production quotas for milk for the years 2001 to 2005, as amended by Government Regulation No 44 / 2002 Coll.
The Government mandates pursuant to Sections 11d (10) and 11e (14) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and amending certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll.:
Government Regulation No. 445 / 2000 Coll., on the establishment of milk production quotas for the years 2001 to 2005, as amended by Government Regulation No. 44 / 2002 Coll., is amended as follows:
1. In Section 2, at the end of the text in point (a), the words "satisfying the requirements laid down by specific legislation1) 'are added.
footnote 1 is replaced by the following:
"1) Act No. 166 / 1999 Coll., on Veterinary Care and the amendment of certain related laws (Veterinary Act), as amended by Act No. 29 / 2000 Coll., Act No. 154 / 2000 Coll., Act No. 102 / 2001 Coll., Act No. 76 / 2002 Coll., Act No. 120 / 2002 Coll., Act No. 309 / 2002 Coll., Act No. 320 / 2002 Coll. and Act No. 131 / 2003 Coll. Decree No 203 / 2003 Coll., on veterinary requirements for milk and milk products. '.
footnote (1) shall be renumbered footnote (1a), including the references to that footnote.
2. footnote (1a) shall read:
"(1a) Decree No 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils."
3. In Article 9, the following paragraph 3 is added:
"(3) Paragraph 9 shall not apply to the granting of compensatory aid for the period 1 April 2003 to 31 March 2004."
4. The following Section 9a is inserted after Section 9, including the title:
Compensation for the period 1 April 2003 to 30 April 2004
(1) The Fund will grant compensation on request to a producer with an individual milk production quota allocated. Applications for compensatory aid for the period 1 April 2003 to 30 April 2004 shall be submitted by the applicant to the Fund by 10 March 2004 at the latest. The Fund shall decide on the application by 30 April 2004 at the latest. The application shall indicate the amount of the individual milk production quota available to the producer at the date of the application. The Fund shall decide to fix the compensatory aid up to an individual milk production quota available to the producer at the date on which the application is submitted, plus one twelfth. Compensation may be granted in advance.
(2) Compensation is fixed:
(a) for a producer whose share of the area of his agricultural parcels situated in less favourable areas defined under special legislation (2a) is at least 50% of the total area of his agricultural parcels managed by him, or for a producer who is an organic operator, (3) between 0,15 and 0,30 CZK for each litre of milk delivered between 1 April 2003 and 30 April 2004 to a sales organisation or processor, or sold directly to the consumer under an individual milk production quota; the Fund shall publish the rate in the Trade Bulletin by 30 June 2004,
(b) for other producers between CZK 0.10 and CZK 0.25 for each litre of milk delivered between 1 April 2003 and 30 April 2004 to a sales organisation or processor, or sold directly to the consumer under an individual milk production quota; the Fund shall be published in the Trade Bulletin by 30 June 2004. ';
5. After Paragraph 13, the following Section 13a is inserted:
Market and price reports
(1) Processors report to the Fund each first working day of the week by 12.00 p.m. the selling price excluding value added tax and the volume of the quantity sold over the previous week for the following milk products: total milk powder, skimmed milk powder, whole milk powder, milk concentrated unsweetened, milk concentrated sweetened, butter, lactose, eidam, cheese of the Swiss type. For all such milk products, the packaging method, the weight of the package and the characteristics of the milk product must be given at the same time (for all milk products, the fat content and for butter, the fat and water content).
(2) Processors shall submit to the Fund monthly, no later than 15 days after the end of each calendar month, information on:
(a) the purchase of milk, including the information from which the milk was bought from (producer, other processor or sales organisation, imports from Member States of the European Union, imports from third countries), the milk fat content, the average protein content and the price at which the milk was bought,
(b) the sale of milk, including information to whom the milk has been sold (to processors or sales organisations, exports to Member States of the European Union, exports to third countries), the milk fat content, the average protein content and the price at which the milk was sold,
(c) the manufacture of butter, whole-milk powder, skimmed-milk powder, semi-rough, hard and extra-hard cheeses;
(d) the consumption of milk for the production of butter, whole milk powder, skimmed milk powder, semi-hard, hard and extra hard cheeses;
(e) lots of butter, whole milk powder, skimmed-milk powder, semi-rough, hard and extra hard cheeses.
(3) Sales organisations shall submit monthly information on:
(a) the purchase of milk, including the information from which the milk was purchased (producer, other processor or sales organisation, imports from the Member States of the European Union, imports from third countries), the milk fat content, the average protein content and the price at which the milk was bought,
(b) the sale of milk, including information to whom the milk has been sold (to processors or outlets, exports to Member States of the European Union, exports to third countries), the milk fat content, the average protein content and the price at which the milk was sold.
(4) Processors and sales organisations shall transmit the information referred to in paragraphs 1, 2 and 3 on forms issued by the Fund. In the case of multiple establishments 1 processor or 1 sales organisation in the Czech Republic, data may be provided in total for all establishments or for each establishment separately, but it is necessary to avoid double counting of the same item.
(5) The Fund shall provide the information referred to in paragraphs 1, 2 and 3 to the Ministry of Agriculture (hereinafter referred to as "the Ministry"). "
6. In Paragraph 14 (4), the words "Ministry of Agriculture (" Ministry ')' are replaced by the words "Ministry '.
Efficacy
(1) This Regulation shall enter into force on the day of its publication.
(2) This Regulation shall expire on 30 April 2004.
