Decree of the Ministry of Planning of the Czech Socialist Republic on fuel and energy bases for appliances of solid, liquid and gaseous fuels and electricity

Ministry of Planning of the Czech Socialist Republic
of 11 November 1970
on fuel and energy bases for appliances for solid, liquid and gaseous fuels and electricity
The Ministry of Planning of the Czech Socialist Republic, in agreement with the Ministry of Industry of the Czech Socialist Republic and other participating central authorities, provides for the establishment of ministries and other central bodies of the Czech National Council in accordance with § 391 paragraph 1 of the Economic Code No. 109 / 1964 Coll. and in accordance with § 1 and 3 of the Act of the Czech National Council No. 2 / 1969 Coll., on the establishment of ministries and other central bodies of the state administration:
§ 1
The decree regulates the procedure for the planned determination of fuel and energy bases for appliances of solid, liquid or gaseous fuels and electricity (hereinafter referred to as appliances). Applies to:
(a) heat equipment for central heating and industrial boilers
- if solid fuels or heavy fuel oil are ignited, if the rated total heat output, e.g. the whole boiler room, is at least 600,000 kcal / hour;
- if it is a gas combustion plant, where the rated total heat output is at least 300,000 kcal / hour. and where the annual consumption of gas or coke oven gas exceeds 120 000 m3 and natural gas exceeds 60 000 m3;
- if it is a light and medium fuel oil plant, all installations, regardless of their performance or annual consumption;
(b) other equipment (technological equipment such as industrial furnaces, drying equipment, fission station, etc.);
- if solid fuels or heavy fuel oil are burned in them, if the output of the individual fuel plants is at least 300,000 kcal / hour;
- if it is a gas burning plant, if the output of the individual fuel plants is at least 150 000 kcal / hour. and if, for all newly connected appliances, the annual consumption of lamp gas or coke oven gas exceeds 120 000 m3 and of natural gas exceeds 60 000 m3;
- if it is a plant for the combustion of light and medium heating oil, all plants, regardless of their performance or annual consumption;
(c) installations where electricity is used for direct heating of industrial furnaces and drying plants and where the technical possibility of substitution of electricity is another type of fuel if the required power exceeds 1 000 kVA;
(d) equipment in which solid, liquid or gaseous fuels are processed as raw materials;
(e) equipment for the combustion of petrol and propane-butane (liquefied heating gases), regardless of their performance or annual consumption.
§ 2
(1) For each newly built or reconstructed appliance for which, after completion of construction or reconstruction, one of the conditions laid down in Section 1 is met, the fuel or energy base must be determined before the construction or reconstruction begins; shall be determined by agreement between the investor (customer) and the supplier of fuels or energy on the basis of the opinion of the central authority in whose field the organisation in which the construction or reconstruction will take place belongs, namely:
(a) in the form of a pre-commitment, if it is the stage of work on preparatory documentation or of actions not yet included in the plan; *)
(b) in the form of an agreement on a fuel or energy base, in the course of work on project documentation, generally before the submission of the project at the stage of a comprehensive project solution for the construction or reconstruction of the appliance. * *)
(2) If the appliances are imported, the fuel base referred to in paragraph 1 (a) or (b) shall be determined before ordering them.
(3) If the appliances referred to in Article 1 are for residential construction (including corporate and cooperative) and civil construction, the fuel or energy base shall be determined by the suppliers following the observations of the relevant regional national committees or national committees directly managed by the government on the investor's request.
(4) Where agricultural drying plants are concerned, the fuel base in light fuel oil shall be determined by the supplier, on a proposal from the Ministry of Agriculture and Nutrition, within the overall volume of such fuel, as determined by the Ministry of Planning for these purposes.
(5) For the determination of fuel bases in fuel oils and gaseous fuels, the criteria set out in the Annex to this Regulation (Principles for determining fuel and energy bases in fuel oils and gaseous fuels) shall apply.
§ 3
The determination of the fuel or energy base within the meaning of Article 2 shall include in particular:
(a) the name of the investor's immediate superior and central authority (customer), the name and registered office of the organisation with a closer identification of the operating unit in which the appliances will be built or reconstructed, and the list of appliances, including their parameters, indicating whether new or reconstructed;
(b) total annual consumption in actual units, including quality characteristics according to the applicable CSN (added to the customer's request for additional ones, e.g. for solid fuels with combustion heat, quality characteristics of ash and sulphur content) and annual consumption in each year up to full (planned) use of the capacity of appliances. In the case of gaseous fuels or electricity, whether or not a maximum hourly supply and an annual sampling curve; in the case of electricity, other requirements laid down in a separate regulation; *)
(c) the name, address or, where appropriate, the name of the fuel supplier's operating unit;
(d) the technical conditions for the implementation of the fuel or energy base; * *) the capacity of liquid fuel storage tanks and propane-butane fuel gas shall correspond to at least 45 days' consumption of the relevant appliances during their maximum load period unless the investor (customer) agrees with the supplier otherwise.
§ 4
Prior to the conclusion of an agreement (or a commitment) on the determination of the fuel or energy base, in cases where the annual consumption of the full use of appliances reaches:

assess the determination of the base in terms of the perspective concept of comprehensive coverage of the needs of the national fuel and energy economy by the Ministry of Planning. This is also the case if the customer and supplier are the same organisation and determine their own fuel or energy base. The supplier requests the assessment in agreement with the customer. The opinion of the Ministry of Planning is binding on both customers and suppliers in terms of concluding agreements within the meaning of Section 2. any negative opinion on the draft commitment or agreement shall be discussed in advance by the Ministry of Planning with the central investor authority.
§ 5
(1) Fuel and energy suppliers are obliged to inform the Ministry of Planning and the competent central authority of the investor (s) of the determination of all fuel and energy bases corresponding to Article 1 agreed with them by investors (s) in preparation for the construction or reconstruction of the appliance, as well as their implementation and changes. This obligation also applies to cases where the supplier and the customer are the same organisation and determine their own fuel or energy base.
(2) Investors (customers) are required to discuss with the fuel or energy supplier all the facts affecting the designated fuel or energy base (e.g. change in the quantity and type of fuel or energy, transfer of the sampling point, etc.).
§ 6
(1) The Decree of the State Planning Commission No. 92 / 1967 Coll., on fuel and energy bases for appliances of solid, liquid or gaseous fuels and electricity does not apply on the territory of the Czech Socialist Republic. decisions issued pursuant to it and under Decree of the State Planning Commission No. 112 / 1961 Coll.:
(a) remain in force in cases of determination of fuel and energy bases in solid, gaseous fuel and electricity;
(b) in cases where liquid fuels are concerned, such decisions shall be replaced by fuel base agreements within the time limit to be determined by the Ministry of Planning, in accordance with the relevant resources for the period 1971-1975, or be repealed by fuel base agreements within the meaning of § 1-4; in so doing, the competent authorities shall also take into account the purchases carried out so far without determining the fuel bases. Departures initiated before the Decree of the State Planning Commission No 156 / 1958 Ú. l., will be considered as fuel base purchases.
(2) This Decree shall take effect on 1 January 1971.

PRINCIPLES
for the determination of fuel and energy bases in heating oils and gaseous fuels *)
1. In view of the extent of the fuel bases already identified and the limited resources, for the years 1971 to 1975 new fuel bases in heating oils * *) and gaseous fuels are determined only in the following cases:
- large-scale (gas) supply of public catering and hot-water preparation in urban, spa and recreational services, schools, health facilities, etc.;
- when it comes to technological appliances for the manufacture of food goods of daily consumption (bakery, confectionery, etc.) and agricultural primary production (drying);
- specifically justified cases where the use of solid fuels is permanently making the environment worse and where this problem cannot be addressed
- falling of the ash
- technical measures; these are home boilers, as well as block and residential small heating plants serving mainly for new housing and civil construction in concentrated urban buildings, in particular with a strong concentration of industry, as well as in spa, medical and recreational conurbations; In addition, the combustion of gas in combination with solid or liquid fuel shall be considered for gaseous fuels whose use in boilers is limited to totally exceptional cases;
- liquefied heating gases (propane-butane) are mainly intended for the supply of the population and small municipal customers in the field of energy use (supply in pressure vessels); for large customers, propane-butane may only be used in exceptional cases for minor technological consumption (e.g. preparation of an inert atmosphere, drying of products, carburisation of other heating gases, etc.);
- technological appliances (furnaces, drying plants, etc.) only in new plants, especially for the production of building materials (including bituminous mixtures for road construction and repair);
- appliances capable of burning two types of fuels: e.g. solid fuel and fuel oil, or solid fuel and fuel gas or fuel oil and gaseous fuel, depending on the situation in the sources of the different types of fuels (technological appliances as well as steam or hot water boilers);
- stabilization of combustion in the combustion of lower-quality solid fuels, regulation of frequency in power plants and ensuring the operation of steam boilers with powder heating under technical minimum.
In all other cases, specific approval of the Ministry of Industry of the Czech Republic and the Ministry of Planning of the Czech Republic is needed to determine the fuel base.
2. The specific procedure for determining fuel and energy bases under Section 1 of the Decree is regulated by the Ministry of Planning of the Czech Republic in line with the development of the situation in the sources of individual fuels.
*) In the current organisation of the business sphere, the investor (customer) agrees to:
- s Ústavem technických a ekonomických služeb, úsek tuhých paliv, jde-li o černé a hnědé uhlí vč. meziproduktu, lignit a koks; u paliv z dovozu je Ústav povinen přihlížet k mezinárodním závazkům a na jejich základě k uzavřeným kontraktům mezi podnikem zahraničního obchodu Metalimex a zahraničními dodavateli;
- s oborovým ředitelstvím Chemopetrol - Závody pro zpracování ropy, jde-li o topné oleje těžké, topné oleje lehké a střední, benzín pro technologické účely, hnědouhelný koks a topný plyn propan-butan (zkapalněné topné plyny);
- s oborovým ředitelstvím Čs. plynárenských podniků,jde-li o zemní plyn naftový, zemní plyn karbonský, svítiplyn a koksárenský plyn;
- s Krajskými energetickými podniky,jde-li o elektřinu, je-li tato, používána jako topné medium v zařízeních podle § 1 písm. c);
- s Českými energetickými závody, generálním ředitelstvím, jde-li o elektřinu z nadřazené soustavy a je-li používána jako topné medium v zařízeních podle § 1 písm. c).
Při sjednávání předběžného příslibu dohodne dodavatel s investorem (odběratelem) dobu platnosti příslibu a způsob jeho nahrazení dohodou o palivové nebo energetické základně.

- s organizacemi uhelného průmyslu,jde-li o tuhá paliva dodávaná z jeho zdrojů;
- s oborovým ředitelstvím Hutnictví železa nebo jím pověřenými organizacemi,jde-li o koks z hutních koksoven;
- s podnikem zahraničního obchodu Metalimex,jde-li o tuhá paliva z dovozu;
- s organizacemi pověřenými oborovým ředitelstvím Chemopetrol,jde-li o tekutá paliva ze zdrojů České socialistické republiky;
- s n. p. Slovnaft,jde-li o topné oleje těžké dodávané ze Slovenské socialistické republiky;
- s podnikem zahraničního obchodu Chemapol,jde-li o tekutá paliva z dovozu;
- s plynárenskými podniky pověřenými oborovým ředitelstvím Čs. plynárenských podniků,jde-li o plynná paliva;
- s Krajskými energetickými podniky,jde-li o elektrickou energii;
- s Českými energetickými závody, generálním ředitelstvím,jde-li o elektrickou energii z nadřazené soustavy.
