of 15 September 1961
on work relief and the economic security of learners in secondary and higher education schools, in certain universities and in the evening universities of Marxisméleninism
The Government of the Czechoslovak Socialist Republic establishes, pursuant to § 33 paragraph 3 of Act No. 186 / 1960 Coll., on the System of Education and Education (Education Act), and pursuant to § 20 paragraph 2 of Act No. 58 / 1950 Coll., on Higher Education, as amended by Act No. 46 / 1956 Coll.:
§ 1
Preliminary provisions
The development of production forces requiring the introduction of the latest technology, the continuous deepening of socialist democracy and the universal development of personality implies a continuous increase in the skills and education of workers. That is why studying at work is an integral part of the educational and educational system of our socialist society.
The level of the results of the study at work according to the needs of our company must also be ensured by creating suitable conditions for the study for workers.
In the current period, it is necessary for workers to increase and acquire qualifications and education in particular in fields requiring major technological development. Teaching and training of teachers must also be constantly improved. Increasing economic and, in particular, political knowledge is important.
The employment allowances and economic security of learners at work are therefore adjusted to take account of the importance of study in those fields.
With the gradual shortening of working time, workers will continue to grow leisure time, thus creating other conditions for studying at work, and therefore a new adjustment will be made for the period of the fourth five-year national economy development plan.
§ 2
Scope
This Order applies
A. for workers whose working hours are 46 hours a week or who work in establishments where reduced working hours have been introduced to 42 or 40 hours a week, and for workers whose regular working hours are laid down by special rules, *) if they study at work (hereinafter the "student"):
1. in schools administered by national committees:
(a) secondary schools for workers;
(b) in vocational schools, secondary vocational schools and conservatories;
(c) long-term courses organised at these schools;
2. in educational establishments of establishments:
(a) secondary schools for workers;
(b) in business technical schools and in business institutes;
3. technical schools (technical, agricultural, forestry, transport and chemicaltechnology schools), the Faculty of Mathematics and Science and the Faculty of Science of Universityeducation, the University of Economics and the evening universities of Marxism-Leninism;
B. to teachers and educators, if they study in the schools referred to in § 5 (hereinafter referred to as "students").

Work relief
§ 3
Working allowances for students in schools administered by national committees and in educational establishments
(1) In all forms of study (e.g. evening, exchange, long distance, external), the competitions will provide the following benefits to students in schools administered by national committees (Section 2 (1)):
1. in secondary schools for workers
(a) 4-8 hours of paid leave per week;
(b) a total of 2 days of paid leave to prepare and carry out examinations in each school year;
(c) 3 weeks of unpaid leave for the preparation and performance of the graduation examination; a study grant will be granted during this period (§ 8 (1) -3),
(d) additional leave of work for a maximum of 2 weeks at the end of the study and for preparation for the graduation examination, provided that this does not interfere with the operation of the plant, without compensation for wages and without the provision of a study allowance;
2. in vocational schools, secondary vocational schools and conservatories
(a) 4 hours of paid leave per week;
(b) a total of 1 week of paid leave to prepare and carry out examinations in each school year;
(c) 5 weeks of unpaid leave for the preparation and completion of the final examination (final artistic examination), which includes professional work, or 2 weeks of unpaid leave, provided that the final examination (final artistic examination) is provided for without professional work. During this period, a study allowance will be granted by the plant (§ 8 (1-3)). If the graduation examination (final artistic examination) is divided into IV. and V., this leave may also be divided into these years of study,
(d) additional leave of absence for a maximum period of 2 weeks at the end of the study to prepare for the final examination (final artistic examination), provided that this does not interfere with the operation of the plant, without compensation for wages and without the provision of a study allowance;
3. in long-term courses provided that the course lasts continuously for at least one school year and has 400 teaching hours per year
(a) 3 hours of paid leave per week and 2 hours of paid leave per week for teachers, for a normal degree of teaching;
(b) 3 days of paid leave for the preparation and completion of the final examination.
(2) The competitions will provide students in educational establishments of establishments (§ 2 (2)) in all forms of study (e.g. evening, exchange, long distance, external) with the following work allowances:
1. in secondary schools for workers
(a) 4-8 hours of paid leave per week;
(b) a total of 2 days of paid leave to prepare and carry out examinations in each school year;
(c) 3 weeks of unpaid leave to prepare and carry out the graduation examination; a study grant will be granted during this period (§ 8 (1) -3),
(d) additional leave of absence for a maximum period of 2 weeks at the end of the study to prepare for the graduation exam, provided that this does not interfere with the operation of the plant, without compensation of the salary and without the provision of a study allowance;
2. in business technical schools and institutions
(a) 4 hours of paid leave per week;
(b) a total of 1 week of paid leave to prepare and carry out examinations in each school year;
(c) where the company technical school is completed by the final examination and the enterprise institute is awarded the same relief as during the secondary examination [paragraph 1 (2) (c)];
(d) additional leave of work for a maximum of 2 weeks at the end of the study to prepare for the graduation examination (final examination), provided that this does not interfere with the operation of the plant, without compensation of the salary and without the provision of a study allowance.
(3) Students in schools administered by national committees and in educational establishments of establishments (Sections 2 (1) and (2)) shall be granted, in addition to the work allowances referred to in paragraphs 1 and 2, unpaid leave to attend all-day or boarding courses (concentration) if they are a compulsory part of the study; a study allowance will be provided during this period (§ 8 (1-3)).
(4) Students in vocational schools, secondary vocational schools and conservatories, in business technical schools and in business institutions where more than 15 teaching hours of compulsory subjects per week are provided for in evening study programmes shall be extended to a maximum of 8 hours of paid leave per week by means of the work allowance provided for in paragraph 1 (2) (a) and paragraph 2 (2) (a).
§ 4
Work relief for students in universities and evening universities of marxism-leninism
The competitions shall provide the following work concessions for students at the schools referred to in Section 2 (3):
1. at evening studio
(a) 22 days of paid leave in the school year for study, consultation and laboratory exercise (excluding the main holidays);
(b) 2 days of paid leave to prepare and carry out each test;
(c) 16 weeks of paid leave in the last year of study or after completion of the final national examination;
(d) on the recommendation of a university in individual cases where, for serious reasons, a student has failed to complete his / her studies in the last year under the conditions of the work allowances, the establishment may grant another, maximum monthly unpaid leave to the student. During this period, a study allowance shall be granted by the plant in accordance with Paragraph 8 (5);
2. for remote studies
(a) 24 days of paid leave in the school year for studies, consultations and laboratory exercises;
(b) 2 days of paid leave to prepare and carry out each test;
(c) 1 week of paid leave in the school year to attend short-term boarding courses;
(d) 16 weeks of paid leave in the last year of study or after completion of the final national examination;
(e) on a recommendation from a university in individual cases where, for serious reasons, a student has failed to complete his / her study tasks in the last year under the conditions of the work allowances, the establishment may grant another, maximum monthly unpaid leave to the student. During this period, a study allowance shall be granted by the plant in accordance with Paragraph 8 (5);
3. when studying at the evening universities of Marxism- Leninism
(a) 2 days of paid leave to prepare and carry out each test;
(b) 1 week of paid leave for final examinations;
4. post-graduate studies organised by one of the forms of study at work;
(a) 24 days of paid leave in the school year for studies, consultations and laboratory exercises;
(b) 2 days of paid leave to prepare and carry out each test;
(c) 1 week of paid leave in the school year to attend short-term boarding courses;
5. in long-term courses lasting one continuous school year and having a total of 400 teaching hours per year,
(a) 3 hours of paid leave per week and 2 hours of paid leave per week for teachers, for a normal degree of teaching;
(b) 3 days of paid leave for the preparation and completion of the final examination;
6. for special courses *)
(a) 4 hours of paid leave per week to attend a course and to prepare, and no such leave shall be granted for courses organised according to the period of evening study,
(b) 2 days of paid leave to prepare and carry out each test;
(c) 1 week of paid leave for final examination;
(d) in the case of masters of vocational training in supplementary pedagogical studies, in addition, two weeks of paid time to concentrate;
7. external studies
(a) 1 week of paid leave for each examination;
(b) a monthly paid leave to carry out a state final examination (thesis).
§ 5
Working allowances for teachers and educators who study at education schools, educational institutes and in teaching studies at universities and at artistic universities
(1) Teachers who study in the field of employment at education schools, educational institutes and at the universities and at the universities of art shall be granted the following concessions:
(a) 2 hours of paid leave per week from the normal level of teaching. In doing so, provision of teaching tasks in larger schools will be achieved mainly by better organisation of work at school, in schools with fewer classes by a new organisation of work under § 6 (2) of the Education Act. The timetable shall be adjusted for the students to have 1 free working day each week to visit the consultation and individual studies,
(b) 2 days of paid leave to prepare and carry out each test;
(c) 14 days of unpaid leave for the completion of the final examination; a study allowance will be granted during this period (§ 8 (1-3)).
(2) Trainees in school cooperatives and school clubs who study at education schools, educational institutes or, where appropriate, in school studies at universities shall be granted 3 hours of paid leave per week from direct educational work with children, educators at home who study at those schools shall be granted 3 hours of paid leave per week; a working schedule shall be adjusted to ensure that every week they have 1 free working day to visit consultations and to study individually. They shall also be subject to the provisions of paragraph 1 (b) and (c).
(3) Concentration for teachers and educators studying at work is organised on holidays.
(4) Teachers and educators who study in secondary vocational schools other than those referred to in paragraphs 1 and 2, or, where appropriate, in vocational schools, in business technical schools, in business institutions and in conservatories, shall be granted work allowances and economic security in accordance with § 3, teachers and educators who study in universities other than those referred to in paragraphs 1 and 2 shall be granted work allowances and economic security in accordance with § 4.
§ 6
In exceptional cases, e.g. in the case of long-term illness or major time losses associated with commuting for consultations and tests, the plant may, as far as it can be, provide students with higher work concessions than those laid down in this decree.
§ 7
Drawing of work relief
(1) The number of hours paid which the student can draw per week (Sections 3 and 4) does not need to be exhausted in the week concerned, can be added up and used for a maximum period of 4 weeks in aggregate, in agreement with the race.
(2) The two hours of paid leave per week from the normal level of teaching duty [Paragraph 5 (1) (a)] does not need to be exhausted by the teacher studying during the week in question, can be added up and used cumulatively for a maximum period of 2 weeks.
(3) A 3-hour paid-leave allowance per week from direct education with children, if it is a governess in youth and school clubs, and 3 hours paid-leave per week, if it is a home educator (§ 5 (2)), may not be used in the week concerned, may be added up and used for a maximum period of 2 weeks.
(4) The allowances referred to in paragraphs 1, 2 and 3 are due to the student for a week (month) in which he has not worked for a specified number of hours for the disease or because he has been granted leave under other regulations. In a disease of more than 1 month, leave may not be transferred to the next month. Paid leave is not for students for the period of their vacation to be recovered, but can be provided in full in a week when the student has not chosen more than 1 day of leave.
(5) Unspent leave cannot be transferred to the following school year.
(6) Paid leave shall be provided for remotely and externally students throughout the school year, including the period of main holidays, and for evening or exchange studies outside the main school holidays. A course student shall be granted leave only for the duration of the course.
(7) Wages (salaries) for days or hours of paid leave shall be calculated on the average earnings earned by the student during the previous accounting period on a regular basis (i.e. including premiums and allowances but excluding overtime).
(8) The competitions will enable the students to carry out all the duties associated with the study, in particular by scheduling working time, and will not, if possible, impose overtime on them.

Economic security during unpaid leave
§ 8
Study contribution
(1) The study allowance granted by the studios during the period of unpaid leave under Sections 3 and 5, or 6, shall be:
u ženatých (vdaných), ovdovělých,rozvedených a svobodných, kteří pečují o nezaopatřené děti Kčs 340,-,
u ženatých (vdaných), bezdětných Kčs 275,-,
u svobodných, ovdovělých, rozvedených (bezdětných) Kčs 170,-.
(2) For unpaid leave of less than one week, a proportion of the study allowance shall be granted according to the number of hours per week.
(3) However, for unpaid leave of more than one week, a study allowance may be granted only at a weekly rate which does not exceed the average weekly earnings of the student over the last 3 months and only up to the amounts referred to in paragraph 1.
(4) During the period during which the plant provides unpaid study leave with a study allowance or unpaid work leave to visit all-day or boarding courses (concentration), the student is not responsible for additional compensation for accommodation and meals. Students at secondary and higher education institutions are entitled to meals in school canteens and mensas under the same conditions as students in internal studies at all-day or boarding courses (concentration).
(5) During the period of unpaid leave in the last year of study in higher education (§ 4 (1) (d) and (2) (e)), the plant provides a study allowance to the single student of 600 Kns per month and to the married one of 900 Kcs per month.
(6) The cost of study allowances during unpaid leave is borne by the plant. *)
§ 10
Working allowances and economic security for members of the JZD
(1) The single agricultural cooperatives will grant their study members work concessions in a similar manner to those of their workers.
(2) The County National Committees shall grant to students, at the time of unpaid leave, except for unpaid leave provided for in § 3 (1) (1) (d), point 2 (d) and point 2 (1) (d) and point 2 (d), a contribution of such an amount, together with the remuneration (remuneration or labour unit) awarded to them pursuant to Article 21 (1) (d). F point 2 of the Model Statutes of the Unified Agricultural Cooperatives (Decree No 49 / 1961 Coll. did not exceed the amounts mentioned in § 8 (1); if the unpaid leave in the last year of study in universities (§ 4 (1) (d) and § 2 (e))), the study allowance may not exceed the amount referred to in § 8 (5).
(3) For the period of unpaid leave, the students of the JZD shall remain insured for sickness and pension insurance benefits of the members of the JZD.
§ 11
Reimbursement of fare
(1) With the exception of local transport, the CSDs will provide a discount on the fare as students and students in the internal studio and will therefore issue them monthly, weekly or student tickets for half of the normal fare for each trip, for the visiting of the teaching, for the examinations, for excursions, for compulsory consultations and for participation in compulsory all-day and boarding courses (concentration) which form part of the study. The discount is granted only to students who pay the fare from their means.
(2) In regular bus transport, ČSAD, with the exception of local transport, will provide students with a discount fare as students and students in the internal studio and will therefore issue them monthly or student tickets for individual trips. Discounts will be provided only for driving up to 70 km of bus lines and only to those students who pay the fare from their means.
(3) In postgraduate studies and in special courses at universities, the student can pay the full fare.

Provisions common and final
§ 12
(1) Students whose hours of work are less (part-time) than those referred to in § 2 are granted work allowances, economic security and a discount on the fare as other students, with the exception of the hours paid per week.
(2) Work allowances, economic security and fare reductions may be granted only to those students who have been recommended by the plant and the trade union in the plant. They shall be kept as long as they fulfil all the duties of study linked to them, in particular if they are successful within the specified deadlines, all the examinations provided for in the study procedure.
(3) The work allowances, economic security and fare reductions shall be withdrawn from the student who failed to pass the tests prescribed for the relevant semester or school year within the prescribed time limit. They shall be provided again if all prescribed tests are successfully carried out within the corrective period. Exceptions in justified cases allow the plant, after consultation with voluntary social organisations in the plant.
(4) If the plant and trade union have recommended the worker to study in the plant, the plant is obliged to provide him with all the concessions and economic security provided for in this decree.
(5) For the purposes of this decree, other organisations and establishments shall be considered as a plant.
§ 13
(1) The employment allowances and economic security of learners in the course of completion of primary education and in higher education other than those referred to in § 2 (3) shall be governed by Decree No 20 / 1955 Ú. l. *) The decree cited also governs work relief and economic security for workers who study at higher education institutions and are not teachers or educators.
(2) The occupational benefits and economic security of learners in special courses at universities other than those referred to in § 2 (3) are governed by Decree No 131 / 1956 of the Ú. l.
§ 14
This decree shall take effect on the day of its publication.

*) For example, the working hours of minors under 16 years of age laid down in § 7 (1) of Act No. 45 / 1956 Coll., to reduce the working time or working hours of workers who work permanently under the influence of X-ray or radio radiation or are subjected to permanent tuberculosis infection, as determined by the Government Resolution of 7 October 1952.
*) The Ministry of Education issued a special course study and examination schedule for universities by Decree of 16 November 1955 No 74 914 / 55-C II / 1 (High School Regulations No 72).
*) These study contributions shall be paid and charged (a) for economic organisations and (a) for industrial enterprises in the account of the corporate director under the cost of preparing cadres for own production costs, (b) for non-industrial enterprises in an account of a similar nature, (b) for budgetary special organisations in the account of administrative and economic direction under the cost of preparing cadres, (c) for budgetary organisations from the item other expenditure to natural persons.
* *) Article 9 of Decree No 102 / 1957 of the Ú. l., on sickness insurance and pension insurance for students and scientific aspirants: 1. sickness insurance and pension insurance for workers studying at work shall continue for the period of unpaid leave granted to them by the establishment for the purposes of study; 2. the period of unpaid leave shall be considered (a) when calculating the net daily wage for determining the cash benefits of sickness insurance as an excuse for a break at work not taken into account, for entitlement to child allowance for the period worked at the place of employment, (b) for the pension insurance sector as a replacement; 3. the economic security provided by the plant at the time of unpaid leave shall not be taken into account in the field of sickness and pension benefits. However, the amounts of economic security thus provided shall be included in the total of the premiums paid by the plant; 4. Where a worker who is a participant in a study in employment suffers an accident in the circumstances laid down in Article 3 of the Decree cited, such accident shall be considered as an accident at work for the purposes of sickness insurance and pension insurance.
