of 29 March 1949
on certain measures relating to unused material.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42, paragraph 1 of the Act of 27 October 1948, No 241 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
(1) In order to ensure the fulfilment of the tasks of the five-year plan, raw materials, semi-finished products, auxiliary substances, means of production (machinery, apparatus, tools, equipment and parts thereof), as well as other articles not used (hereinafter referred to as "material '), may be carried out in accordance with other provisions.
(2) The material referred to in paragraph 1 may be:
(a) require users of rooms, buildings or other immovable property in which the material is present to report it within the prescribed period;
(b) to take appropriate measures for its use, in particular to limit the possibility of handling it and to order the owner to leave it to the undertaking working to carry out the tasks of the five-year plan, within the prescribed period and for appropriate remuneration.
(3) The owner of the material shall agree on the remuneration for the material transferred to the undertaking to which the material referred to in paragraph 2 (b) is to be delegated; If no agreement is reached, the amount of the remuneration in the undisputed proceedings shall be determined by the district court competent according to the owner's residence (s).
(4) Paragraph 2 (b) does not apply to raw materials collected.
§ 2.
(1) The measures provided for in Article 1 are the following:
(a) the material covered by this Regulation;
(b) measures of a general nature pursuant to Paragraph 1 (2).
(2) In the case of measures of a general nature, the Ministry of Industry may entrust national and other undertakings, after economic and other organisation, to act under its directives under Paragraph 1 (2) (b).
§ 3.
National committees shall be required to cooperate under the guidelines of the Ministry of Industry in the implementation of this Regulation.
§ 4.
(1) The Ministry of Industry and Enterprise and Organisations entrusted with it (§ 2 (2)) is entitled to request that users of rooms, buildings or other real estate and owners of the material provide them with the necessary reports and submit the material, after its samples and evidence.
(2) The Ministry of Industry may, for the examination of the regulations of the Act of 13 May 1936, No. 131 Coll., on the defence of the State, carry out checks in buildings, rooms or other real estate, while looking at records, commercial books and documents. In accordance with the previous sentence, the Ministry of Industry may entrust national committees.
§ 5.
If the measure under this Regulation concerns the competence of another Ministry, it shall be made by the Ministry of Industry in agreement with the Ministry responsible.
§ 6.
This Regulation shall not apply to materials and products which, pursuant to Article 1 of the Law of 21 December 1948, No 313 Coll., on bound building materials and their allocation, have been declared as bound building materials.
§ 7.
(1) The acts and omissions contrary to the provisions of this Regulation or the provisions issued pursuant to it shall be punishable, in so far as the offence is not more severe, by the county national committees as an offence according to the penalty rate of up to 50 000 CZK or by a prison (lock-up) within 6 months or both. If a fine has been imposed, a replacement prison sentence (lock-down) should also be imposed in case of non-availability, depending on the rate of guilt within 6 months. If both penalties are imposed at the same time, the punishment on the free side, together with the replacement penalty, must not be more than 6 months for an impenetrable fine.
(2) Where an offence has been committed in the course of trade and the offender has already been lawfully punished for the conduct or omission referred to in paragraph 1, the loss of the trade licence may also be declared, either on time or forever.
§ 8.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister of Industry in agreement with the participating members of the Government.
