Law on measures against the unauthorised crossing of national borders

on measures to prevent the unauthorised crossing of national borders.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
A foreigner who enters the territory of the Czechoslovak Republic illegally will be punished - if not more severely punishable - by a county national committee by a fine of up to 50,000 CZK or by a prison (lockdown) within 6 months or both. If a fine has been imposed, a replacement prison sentence (lock-down) shall be imposed at the same time in the event of non-availability, depending on the rate of guilt within 6 months. If, in addition to the fine, a punishment has been imposed on the free, the sentence on the free, together with the prison detention penalty, must not be more than 6 months.
§ 2.
(1) If a person of German or Hungarian nationality has been illegally removed from the Czechoslovak Republic under the Constitutional Decree of the President of the Republic of 2 August 1945, No 33 Coll., on the modification of the Czechoslovak citizenship of persons of German and Hungarian nationality, who has been moved or moved from the Czechoslovak Republic or has voluntarily moved out of it, has fled (in the next "German or Hungarian emigrated"), she will be punished - the most seriously criminal - by the county national prison (lock) within 6 months and fine up to 50,000 Kès. In the event of non-compliance with the fine, either a replacement prison sentence (lock-down) is imposed at the same time according to the rate of guilt within 6 months. The sentence on the free side, together with the replacement prison sentence (lockdown) for an impenetrable fine, must not exceed 6 months. In a criminal offence, it may be stated that the punished will serve the sentence in full or in part in a law enforcement office.
(2) The punishment referred to in paragraph 1 shall constitute grounds for expulsion from the territory of the Czechoslovak Republic.
§ 3.
(1) Whoever lodges (provides shelter) or employs an evicted German or Hungarian or otherwise allows or makes it easier to reside in the territory of the Czechoslovak Republic or provides him with assistance in the illegal crossing of state borders, even if he knows that he is such a person, will be punished - if not by a more severe criminal - by the county national prison committee (lock-up) within 6 months and a fine of up to 50,000 Kčs. In the event of non-compliance with the fine, either a replacement prison sentence (lock-down) is imposed at the same time according to the rate of guilt within 6 months. The sentence on the free side, together with the replacement prison sentence (lockdown) for an impenetrable fine, must not exceed 6 months.
(2) In the same way, it will be punished who will accommodate (provide shelter) or employ the evicted German or Hungarian, and will not require a pass that it is not a person who has not previously reported to the National Security Administration (District National Committee, National Security Directorate) or the nearest headquarters of the National Security Corps station that the person he wishes to accommodate (provide shelter) or employment has not shown him that he is not an evicted German or Hungarian.
(3) Who, on the day on which this Act takes effect, provides accommodation (shelter) or employs
(a) evicted German or Hungarian;
(b) a person who cannot prove that he is not an evicted German or Hungarian;
it shall be punished in accordance with paragraph 1 if it does not notify it within 3 days in the case (a), (b) within 15 days in the case of the National Security Administration (Regional National Committee, Directorate of National Security) or the nearest headquarters of the National Security Corps station.
(4) In addition to the penalty referred to in paragraph 1, the District National Committee may, in the case of a person who has recommitted an offence in that paragraph, state that he is being expelled from the border territory for a period of time or forever. Border territory means the Czechoslovak territory occupied in 1938 by Germany and Hungary, in 1939 by Hungary, but at least by the customs border zone.
(5) The Minister of the Interior - in Slovakia, after the statement of the delegate of the interior - lays down in the Official Journal the documents sufficient to be provided for the certificate referred to in paragraphs 2 and 3.
§ 4.
The general rules on the reporting of residence and the rules on the residence of foreigners and the regulations on their employment remain unaffected.
§ 5.
This Law shall take effect on the eighth day following its publication and shall expire on 31 December 1950; It shall be implemented by the Minister for the Interior in agreement with participating members of the Government.
