GOVERNMENT DECLARATION
of 4 June 1964
on the exceptional provision of pensions to certain working pensioners
The Government of the Czechoslovak Socialist Republic provides, pursuant to § 58 of Act No. 101 / 1964 Coll., on Social Security, and § 96 of Act No. 103 / 1964 Coll., on Social Security of Cooperative Farmers:
Entitlements on old-age pension for additional employment (cooperative work)
Entitlements on old-age pension at work
Old-age pension from occupational or cooperative farmers' pensions or pension insurance of self-employed persons for the duration of their further employment shall be granted under the following conditions:
(a) workers who are entitled to an old-age pension from category I employment before the age of 60 shall be entitled to a pension after that age;
(b) workers who are entitled to an old-age pension from the first working category after the age of 60 shall be entitled to a pension from the start of the pension,
(c) women who are entitled to an old-age pension before the age of 60 shall be entitled to a pension after that age;
(d) women who are entitled to a full retirement pension after the age of 60 shall be entitled to a pension from the start of the pension;
(e) other workers, cooperative farmers and self-employed persons entitled to an old-age pension shall be entitled to a pension after the age of 65;
old-age pension is granted in all such cases up to the amount
1 000 CZK per month, if they are employed in the first working category,
800 CZK per month, if they are employed in the second working category,
600 CZK per month, if they are working in the 3rd category.
Entitlements on old-age pension for work in the single agricultural cooperative
(1) An old-age pension from workers' pension or an old-age pension to which entitlement has been acquired after 30 June 1964 from pension schemes of members of single agricultural cooperatives with a higher level of management shall be granted mutatis mutandis in accordance with Section 1, where the pensioner works in a single agricultural cooperative with a higher level of management.
(2) The old-age pension referred to in the preceding paragraph shall be granted to a pensioner who works permanently in a single agricultural cooperative which has not been recognised as a cooperative with a higher level of management, even if he is not a member of it, but up to a maximum of 600 CZK per month.
(3) An old-age pension from the pension insurance of cooperative peasants designated by the pension belt is granted up to the amount set out in Section 1 * for the period during which the pensioner works in a single agricultural cooperative with a higher level of management.
(4) The old-age pension for self-employed persons is also granted for the period during which the pensioner works in the single agricultural cooperative.
For the period of continued employment (working in the cooperative) during which an old-age pension is granted pursuant to Sections 1 and 2, entitlement to that pension shall not be increased. The beneficiary may choose the place of payment of the pension to increase the pension entitlement; the choice made cannot be changed before one year has elapsed.
Pension entitlements for campaign, seasonal and other short-term work
(1) Old-age, widower's and orphan's pension pension (insurance), which would not have been paid or would have been reduced if they were employed, is granted the pension unchanged,
1. Where a pensioner enters a job in which he / she is engaged for a period not exceeding 120 working days in a calendar year
(a) working in underground coal mines; or
(b) manual work in the food industry campaign; or
(c) manual labour in agriculture during peak work and forestry during afforestation and at polling; or
(d) work in connection with the autumn transport campaign; or
(e) the work of a teacher (educator) in education or the work of a healthcare professional in a medical institution; or
(f) work in the provision of services to the population (except administrative work) in the business, including public catering and accommodation facilities, in the local economy and in the production cooperatives, in the repair and maintenance of the housing fund, in the heating industry of the national committees in the organisation of the residential economy of the winter heating season, in Prague, Bratislava, Brno and Ostrava, and in the cleaning of the city in Prague, Bratislava, Brno and Ostrava and during the season in the spa and recreation centres;
2. where the pensioner enters into an employment relationship which is agreed for a period not exceeding 60 working days, provided that he has not actually worked more than 60 working days in that employment relationship or several employment relationships so agreed in the same calendar year; an employment relationship not exceeding 60 working days shall also be assessed with a work relationship of such a small scale that it shall not exceed 400 working hours in a calendar year.
(2) The total duration of all the work referred to in the preceding paragraph must not exceed 120 working days in the calendar year. Where a pensioner has, in the same calendar year, both seasonal, campaign or other short-term employment contracted for a period of time, as well as employment with a working time not exceeding 400 working hours per year, each working 8 hours of such work shall be assessed as one working day.
(1) For the period of employment for which an old-age pension is granted under Paragraph 4, entitlement to that pension shall not be increased; However, if a pensioner asks to be entitled to an old-age pension instead of a pension, the period of employment for increasing the pension entitlement under the general rules shall be assessed from the day following the end of the period for which the pension payment has already been paid.
(2) For the period of employment referred to in Section 4, the pensioner shall be granted a place of childcare allowance.
Common and transitional provisions
If an old-age pension is granted in respect of another job (work), it is also paid for as long as the pensioner is insured.
In the period from 1 July to 31 December 1964, beneficiaries of an old-age pension shall participate in the benefits provided for in Article 4:
(a) in the case of works referred to in Article 4 (1) (1) (b) and (d), where the duration of such work, together with the period of work held before 1 July 1964, does not exceed 8 months in the calendar year 1964;
(b) for other short-term work referred to in Article 4 (1), where the duration of such work, together with the duration of work carried out before 1 July 1964, does not exceed the scope of the work provided for in Article 4 in calendar year 1964;
However, if, on 1 July 1964, a short-term employment relationship favoured by the Government's resolution of 17 July 1959 on the granting of benefits to old-age pensioners temporarily employed in campaign and other short-term work, the benefits under that resolution shall continue until the end of the period for which the employment was agreed, but until 31 July 1964 at the latest.
The provisions of this Order shall also apply to beneficiaries of social security pensions of members of the armed forces.
They shall be deleted:
1. Government Resolution of 17 July 1959 on the granting of benefits to old-age pensioners temporarily employed in campaign and other short-term work, published at 66 Úl. of 1959,
2. Government Resolution of 7 July 1961 on the provision of an unabated old-age pension to former CSDs staff entering a temporary employment relationship with CSDs for the performance of railway service.
This Decree shall take effect on 1 July 1964, with the exception of Article 8, which shall take effect on 1 October 1964.
