DECLARATION

of 27 March 2017

on the declaration of the National Natural Monuments of Bublák and Niva Pledné and the determination of its closer protection conditions

The Ministry of the Environment provides pursuant to § 79 (4) (h) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 349 / 2009 Coll.:

§ 1

Announcement of a national natural monument

(1) The National Natural Monument of Bublak and Niva Plesné ("the National Natural Monument") is announced.

(2) A natural service, as defined in paragraph 3, shall be declared a national natural monument, with the presence of:

(a) shrubbery and forest ecosystems of wetlands, wetlands, peat forests, meadow forests and beech beets;

(b) wetland and aquatic ecosystems of saltwater and transverse peat, reeds and vegetation of high oysters and macrophyte vegetation of watercourses;

(d) biotopes of rare and endangered species of white rootseeds (Rhynchospora alba) and roundfish (Drosera rotundifolia), including their populations;

(e) biotopes of rare and endangered species of aquatic mihul (Lampetra planeri), spotted flounder (Pelobates fuscus) and beaver (Castor fiber), including their populations; and

(f) mofet (natural carbon dioxide and helium fumes) and natural mineral water fumes.

(3) The national natural monument is situated in the territory of the Karlovy Vary Region, in the cadastral territory of Bor u Kopanina, Doubrava u Milhodov, Hartoušov, Brown, Milhostov, Mlýnek, Bridge u Crožovatka and Vackovec. The boundaries of the national natural monument shall be determined by closed geometric patterns with direct sides whose vertices are determined by coordinates of the uniform trigonometric network of the cadastral1). The lists of coordinates of the vertices of geometric patterns as they follow in the patterns are given in Annex 1 to this Decree.

(4) The protection zone of the national natural heritage is situated in the territory of the Karlovy Vary Region, in the cadastral territory of the Brown, Milhostov, Bridge near the Crossroads and Vackovec. The boundaries of the national natural monument protection zone shall be determined by closed geometric patterns with direct sides whose vertices are determined by coordinates of the uniform trigonometric network of the cadastral1). The lists of coordinates of the vertices of geometric patterns as they follow in the patterns are given in Annex 2 to this decree.

(5) An indicative graphical representation of the territory of the national natural heritage and its protection zone is given in Annex 3 to this Decree.

§ 2

Closer protection conditions

(1) Only with the consent of the nature conservation authority can the national natural monument

(a) permit or make changes to the types of land or to their exploitation (2);

(b) carry out geological work linked to the earth's surface;

(d) permit or carry out construction, permit or carry out changes to completed structures or changes to buildings before they are completed or place construction, advertising or information equipment;

(e) to adjust the surface of the road using non-local natural material of the same geological origin;

(f) store items, except for the short-term storage of timber on forest land;

(g) intervene in watercourses or otherwise alter the natural aquatic regime of a territory which does not harm a national natural monument;

(h) indicate cycling or hiking routes;

(i) planting or planting plants other than forest renewal or release animals;

(j) fertilise land or use chemical resources on land;

(k) establish new feeding facilities or slanisks;

(l) to feed or bait animals outside the fattening establishment; or

m) start fires.

(2) The agreement of the nature conservation authority referred to in paragraph 1 is not necessary for the activities carried out on the parcels of parquet numbers 10 and 11 in the cadastral territory of Doubrava u Milhotov in connection with the use of the natural medical source of pelloid from the bearing Vackovec II.

§ 3

Consent-related activities in the protection zone

Only with the consent of the nature conservation authority can national natural monuments in the protection zone

(a) permit or make changes to the types of land or to their exploitation (2);

(b) authorise or make changes to the land water regime;

(d) store items, except for the short-term storage of timber on forest land; or

e) start fires.

§ 4

Efficacy

This Decision shall enter into force on 15 April 2017.
