DECLARATION

amending Decree No. 221 / 1995 of the Ministry of Health Coll., on expert committees
The Ministry of Health provides pursuant to § 77 (6) of Act No. 20 / 1966 Coll., on the Care of People, as amended by Act No. 548 / 1991 Coll. and Act No. 132 / 2000 Coll.:
Decree No. 221 / 1995 Coll., on expert committees, is amended as follows:
1. Paragraph 1, including footnote 1, reads as follows:
The expert committee set up as the advisory body of the Minister for Health or of the Region's Delegated Authority (hereinafter referred to as the Regional Authority) (1) assesses individual cases where there has been doubt as to whether the proper procedure has been followed in the course of health care, or whether it has been harmed, (hereinafter referred to as the case).
1) § 77 of Act No. 20 / 1966 Coll., on the care of the health of the people, as amended by Act No. 548 / 1991 Coll. and Act No. 132 / 2000 Coll. § 67 of Act No. 129 / 2000 Coll., on the Counties (Regional Establishment). "
Footnote 1) shall be renumbered footnote 1a), including references to the footnote.
2. In Paragraph 2 (2), the words "Director of the selected hospital 'are replaced by the words" Regional Office'.
3. In Paragraph 2 (2), the words "listed in the Annex which forms part of this Order 'are replaced by the words" counties'.
4. In Paragraph 3 (1), the words "the Director of the selected hospital 'are replaced by the words" the Regional Office'.
5. in Article 3 (2) (a):
"(a) a physician
1. The Ministry of Health as regards the Central Expert Committee,
2. the Regional Office, as regards the Regional Expert Committee, '.
6. Paragraph 3 (4) reads as follows:
"(4) The Commission shall invite
(a) a lawyer with experience in the field of health and, if necessary, another health professional, 3)
(b) an expert in technical equipment, if technical equipment has been used in the course of health care and if it is suspected that there is a causal link between the case and the use of technical equipment;
(c) the person concerned by the case and, where appropriate, the person who initiated the case, if necessary, to consider the case. "
7. In Article 3 (5), the words "(a) and (b) 'shall be inserted after the words" paragraph 4'.
8. In Paragraph 4 (1), the first sentence is replaced by the following: "The activities of the Commission and its conduct shall be managed by the President, who shall be the physician referred to in § 3 (2) (a) (1) at the Central Panel and the doctor referred to in § 3 (2) (a) (2) at the Regional Expert Committee."
(9) Paragraph 4 (4), including footnote 8a, reads:
"(4) The basis for the Commission's work is mainly the data from the medical document8a) concerning the case.
8a) § 67b (10) (g) of Act No. 20 / 1966 Coll., as amended by Act No. 260 / 2001 Coll. '
10. in Article 4 (7), the words "the Director of the selected hospital" shall be replaced by "the Regional Office and a copy of the minutes to the Ministry of Health."
11. in Article 5, the following paragraph 1 is inserted:
"(1) The Regional Authority shall inform the Ministry of Health of what measures have been taken to correct the facts identified by the Regional Commission of Experts (Section 4 (6))."
The text of Article 5 is renumbered paragraph 2.
12. in Article 5, the words "chosen hospital" are replaced by the words "regional authority."
13. in Article 6, the words "the hospital selected shall be reimbursed from the contractor's contribution" shall be replaced by "the county budget."
14. The Annex to Decree No 221 / 1995 Coll. is deleted.
This decree shall take effect on the day of its publication.
