THE LAW
of 18 April 1990
on citizens' private business
The Federal Assembly of the Czechoslovak Federal Republic has decided on this law:
AGRICULTURAL PRODUCTS CARRIED OUT BY YOURSELF
(1) Agricultural production operated by an entrepreneur (hereinafter referred to as the "self-employed farmer") whose activity consists in the operation of agricultural production, including forest and water management (hereinafter referred to as "agricultural production"), is the activity of a natural person who personally or by other persons
(a) produce products of agricultural production in order to obtain a permanent source of income, in particular by selling them or, where appropriate, by selling them;
(b) make adjustments or other processing of their agricultural production; (a) if consent is required in accordance with specific regulations, only with that consent; or
(c) provide, on an occasional basis, work or performance in connection with agricultural production using means and equipment serving agricultural production, usually at a time when they are not fully used for such production, or conquer non-reserved minerals.
(2) A self-management farmer operates agricultural production in his own name, on his own account and responsibility.
(1) The competent authority of the Czech Republic or the Slovak republity9b) shall register the farmer-owning farmer on the basis of his declaration.
(2) The records referred to in paragraph 1 shall indicate the name and surname of the farmer, the place of his permanent residence, the birth number and, where applicable, the particulars of the specific authorisation or authorisation, where required for a particular type of activity under the special rules, (9a) and the date of registration.
(3) Within 15 days, the operator shall notify the competent authority of a change in the facts kept in the register and of the cessation of his agricultural production.
(1) The competent authority shall issue a certificate of registration to the farmer himself. At the same time, the competent tax authority, the competent insurance undertaking, the competent national statistics authority and the competent social security authority shall be notified; the same procedure shall be followed for the change and termination of the facts kept in the register and at the end of the agricultural production.
(2) On the basis of the notification referred to in paragraph 1, the competent authority of the national statistics shall assign to the farmer himself an identification number which shall be entered in the register by the authority referred to in Article 12b (1).
(1) An individual farmer kept so far in the register of municipal authorities (9b) pursuant to the existing regulations (c) shall be deemed to be a self-governing farmer with rights and obligations defined in this law.
(2) Farmers themselves buy products listed in a separate regulation for the sole use of their economy at prices excluding turnover tax. 9d)
A self-managing peasant kept in the register pursuant to § 12b may be entered in the company register. In such cases, the application for registration may be lodged at the beginning of the calendar year, no later than 15 February of the current year, and at the same time it shall inform the competent authority responsible for the registration.
