DECLARATION
State Commission for Scientific, Technical and Investment Development
of 7 November 1985
on experimental verification under construction
The State Commission for Scientific, Technical and Investment Development provides, pursuant to § 53 (1) (e) of Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries, as amended by Act No. 115 / 1983 Coll. and § 143 (1) (d) of Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act):
INTRODUCTORY AND GENERAL PROVISIONS
Scope
(1) The Decree lays down the procedure and formalities for experimental verification under construction and the scope and procedure of the authorities and organisations in its security.
(2) The Decree does not apply to verifications which form part or separate stage of the task of developing science and technology. 1)
Experimental verification under construction
Experimental verification under construction ("experimental verification ') is a continuous and planned activity which, in accordance with state technical and investment policy, verifies new progressive construction solutions for re-construction applications through building experiments.
Construction experiment
(1) A building experiment means the verification of the social, operational and manufacturing requirements for the management of constructions and the results of technical development in the implementation or use of constructions or parts thereof capable of separate using2) (hereinafter referred to as "building use") in cases where they cannot be sufficiently verified in project solutions or laboratories.
(2) The results of construction experiments are the basis, in particular, for the development or modification of type materials and typology directives, 3) technical standards, building standards, or other regulations for the re-construction and development of material and production bases for the construction and progressive direction of construction.
(3) Construction experiments may be carried out on construction and changes to buildings, (4) whose investors are domestic socialist organisations. The construction on which a building experiment is conducted is referred to as an experimental building.
(4) Construction experiments included in experimental verification plans under construction are referred to as tasks of experimental verification. The work related to the development of experimental verification tasks shall mean:
(a) the multi-work related to the development of project or preparatory documents5) that part of the experimental building which is the subject of the building experiment and the multi-work related to the implementation of this part of the experimental building resulting from a new progressive solution compared to the one commonly used;
(b) work related to the performance and evaluation of the construction experiment;
(c) the removal of any defects and damage arising from the construction experiment.
Objects of construction experiments
(1) The objects of building experiments may be new progressive solutions
(a) building parts and construction systems, (6) for which technical, economic, utility and qualitative characteristics and parameters, performance and functions, reliability and durability and technology of the implementation of construction works are verified;
(b) building objectives7) and their spatial areas 8), structures and residential units, 9) where functional, operationally accessible, technical, technological, architectural and urban solutions are verified, technical-physical, technical-economic and functional properties and parameters, comfort of the environment and technology of building implementation.
(2) Building experiments must be limited to the extent necessary for their evaluation.
MANAGEMENT AND SECURITY OF EXPERIMENTAL VERIFICATION
Management of experimental verification
(1) Experimental verification is managed by the State Commission for Scientific, Technical and Investment Development, the Czech Commission for Scientific, Technical and Investment Development and the Slovak Commission for Scientific, Technical and Investment Development.
(2) State Commission for Scientific, Technical and Investment Development
(a) identify guidelines in the agreement with the safety authorities in the focus of the building experiments in accordance with the state technical and investment policy following the development of science and technology and apply them in the state design and characterisation work plan;
(b) it manages the planning of construction experiments in its scope and, in agreement with the Czech Commission for Scientific, Technical and Investment Development and the Slovak Commission for Scientific, Technical and Investment Development, it issues methodological guidelines for planning experimental verification in construction.
(3) Czech Commission for Scientific, Technical and Investment Development and Slovak Commission for Scientific, Technical and Investment Development
(a) propose guidelines in agreement with the Securing Authorities of the State Commission for Scientific, Technical and Investment Development in order to focus building experiments on the central authorities of the Republic;
(b) manage the planning of the building experiments of the central authorities of the Republic and apply guidelines in the direction of the building experiments established by the State Commission for Scientific, Technical and Investment Development.
SECURITY OF EXPERIMENTAL VERIFICATION
Security authorities and their responsibilities
(1) Experimental verification is provided by central government bodies or regional national committees, the National Committee of the City of Prague and the National Committee of the SSR of Bratislava (hereinafter the Regional National Committees).
(2) The authorities referred to in paragraph 1 (hereinafter referred to as the "safeguard authorities") provide experimental verification in the functions of central authorities
(a) suppliers (producers), if the object of the construction experiments is construction parts, construction systems or construction implementation technology;
(b) investors in other cases.
(3) The security of experimental verification includes:
(a) planning of building experiments;
(b) the designation (agreement) of the organisation responsible for ensuring the conduct of the construction experiment and its evaluation (hereinafter referred to as the responsible organisation);
(c) preparation and monitoring of construction experiments;
(d) approval of the final evaluation;
(e) the implementation of the results of construction experiments.
Responsible organisation and responsibilities
(1) According to the focus of the building experiment, the organisation may be an investor, supplier, project, research, development or a superior body of the central management.
(2) The functions of the responsible organisation include:
(a) cooperation between construction participants in the preparation of materials for the construction experiment;
(b) evaluation of the course of the construction experiment;
(c) ensuring the necessary tests and measurements;
(d) participation in the surrender and acceptance of completed supplies of the building part concerning the construction experiment;
(e) a statement to the investor as to whether the experimental construction is fit for use or temporary use in terms of the construction experiment;
(f) processing of the final evaluation;
(g) archiving of evidence of the construction experiment for a period of 10 years from the approval of the final evaluation.
PREPARATION AND TRANSPORT OF THE BUILDING EXPERIMENT
Experimental assignment
(1) The experimental assignment defines the requirements for the construction experiment and lays down the conditions for its security; Contains
(a) identification data (name and location of the experimental building, name and address of the responsible organisation, investor, contractor of the construction part, or construction works, suppliers - producers whose supplies are subject to the construction experiment, and the general designer);
(b) the justification for the construction experiment, indicating links to the results of technical development and to the social, user, operational and manufacturing requirements for the management of the buildings;
(c) the definition of the subjects of the building experiment;
(d) an overview of the planned expenditure on the work referred to in Article 3 (4) (a) and (b);
(e) the requirement to perform the test operation to verify the results of the construction experiment10 (hereinafter referred to as "test operation");
(f) the time course of the construction experiment,
(g) proof of conformity granted pursuant to paragraph 4;
h) expected social benefits and expected use of results of the building experiment in repeated construction.
(2) The processing of the experimental assignment is ensured by the securing authority which also approves the experimental assignment. Before approval, the experimental assignment must be discussed with the investor, the contractor of the construction part or, where applicable, the works, the general designer and the suppliers - the producers whose supplies are covered by the construction experiment or future users.
(3) The experimental award provided by the Regional National Committee must also be discussed with the central government body managing the sector concerned.
(4) Experimental award may not be approved unless the investor, the designer general and the contractor of the construction part or, where appropriate, the works agree with it; in the cases referred to in paragraph 3, also the central government body managing the relevant sector.
(5) The approved experimental assignment is the basis for the inclusion of the construction experiment in the state design and characterisation work plan and in the experimental verification plan under construction.
The course of the building experiment
(1) A building experiment is generally carried out within the framework of:
(a) project or pre-project5) preparation;
(b) implementation,
(c) use, (11) interim 10) use of experimental construction.
(2) If the functional capability of the subjects of the building experiment for use needs to be verified, the test operation shall be performed on the delivered and taken over supplies. 10) The test operation shall be provided by the investor (operator) on the basis of a decision by the construction office on provisional use for the test operation.
(3) A final evaluation based on continuous evaluation of the building experiment is a necessary part of the construction experiment; the final evaluation shall be approved by the providing authority.
Final evaluation
(1) The final evaluation shall include:
(a) identification data;
(b) the definition of the subjects of the building experiment;
(c) an assessment of the results obtained by subject of the building experiment and their comparison with the requirements set out in the experimental assignment;
(d) an overview and evaluation of planned and actual expenditure on the construction experiment and the time course of the construction experiment;
(e) the social contribution of the building experiment and the proposal for measures to exploit its results;
(f) measures to remedy any defects and damage arising from the construction experiment;
(g) proof of discussion of the results of the construction experiment with the future user, if any.
(2) The responsible organisation submits a final evaluation of the construction experiment to the providing authority for approval
(a) no later than 3 months, unless the use of the construction or test operation is required to evaluate the construction experiment;
(b) within 15 months at the latest if the construction experiment is carried out even at the time of use of the construction or during testing operations
after completion of that part of the experimental building capable of independent use, the object of which is the building experiment. The extension of these time limits in exceptional cases shall be justified in an experimental award.
(3) The approved final evaluation is sent by the providing authority according to jurisdiction to the State Commission for Scientific, Technical and Investment Development, the Czech Commission for Scientific, Technical and Investment Development or the Slovak Commission for Scientific, Technical and Investment Development.
PROVISIONS COMMON, TRANSITIONAL AND FINAL
Common provisions
(1) Generally binding legislation applicable to investment construction shall apply to experimental constructions. Such rules may be derogated from only where necessary for the purpose pursued by the construction experiment and where the authorities authorised to authorise exemptions from the relevant regulations so permit after consultation and determination of the extent of the necessary tests and measures necessary to ensure the safety of human life and health, safety of work and technical equipment, fire protection and protection of things.
(2) The work related to the development of experimental verification tasks shall be financed under specific rules. 12)
Transitional provision
Construction experiments initiated before the date of application of this decree shall be carried out according to the regulations still in force, except for the final evaluation to be carried out under this decree.
Repeal
The Decree of the Federal Ministry of Technical and Investment Development No 79 / 1973 Coll., on experimental verification under construction is hereby repealed.
Efficacy
This Decree shall take effect on 1 January 1986.
