Czech Mining Office
of 20 May 1988
on the economical use of exclusive bearings, the authorisation and reporting of mining activities and the reporting of mining activities
The Czech Mining Authority provides for the protection and exploitation of mineral assets (the Mining Act) pursuant to § 30 (7), § 32 (5) of Act No. 44 / 1988 Coll., on the protection and exploitation of mineral assets (the Mining Act), and § 5 (4), § 9 (2), § 10 (8), § 11 (3) and § 13 (2) of the Czech National Council Act No. 61 / 1988 Coll., on mining activities, explosives and on state mining administration:
ECONOMIC USE OF EXEMPTIONS
Curvature, pollution and losses
(1) In the production of the exclusive bearing it is necessary to use such conquest methods that enable the balance sheet stocks of the exclusive bearing (1) with the greatest possible margin (in the case of solid minerals), or the excavability (in the case of liquid and gaseous minerals as well as in the case of leaching), with as few losses and as little pollution as possible, which are technically and economically justified.
(2) The organisation is required to design and justify the conquest method and the resulting excavation (excavation), pollution and losses in the plan to open, prepare and conquer the exclusive bearing or part thereof.
Recovery
The treatment and processing of minerals, if carried out in connection with their conquest, shall be carried out in such a way as to allow the most complete use of the minerals obtained with the greatest possible recovery of their components. The process of treatment and processing of recovered minerals and the resulting yield shall include in the plan the opening, preparation and extraction of the exclusive bearing.
Detection, registration and use of results
(1) The organisation is required to identify and register the quantities of substances stored on the cavities, dispensers and desulphurisers, and
(a) during the extraction of the sole bearing, the roughness, pollution and losses;
(b) the content of their commercial and harmful components at stake, in semi-products, in the final product of treatment and processing and in waste, in the treatment and processing of the minerals obtained.
(2) The organisation shall monitor and register for mining minerals and associated rocks within the necessary range of petrographic and mineralogical composition, the manner and form of occurrence and interaction, the content and chemical links of commercial and harmful constituents, and the physical- mechanical and chemi-technological properties.
(3) The organisation shall benefit from the results referred to in paragraphs 1 and 2 in the planning and management of the opening, preparation and extraction of the exclusive bearing, as well as the modification and refining of the acquired minerals.
(4) The organisation shall record the data needed to determine the level of remuneration from the reserved minerals and conquest areas.
AUTHORIZATION OF HORNIC ACTIVITIES
Types of mining permit
The authorisation of the Circular Mining Authority shall be required for the following mining activities:
(a) for the search and exploration of the exclusive bearing by mine parts, by vertical mine parts of a depth greater than 40 m, by horizontal or inclined mine parts of a length greater than 100 m, or by those mine parts of a shorter size, provided that other mine pieces, the length of which and those parts exceed 100 m are stamped; authorisation is also required for the provision and disposal of such mining works,
(b) for the opening, preparation and extraction of the exclusive bearing, as well as for the securing of mining and quarrying and the disposal of the main mining and quarrying works;
(c) for special interventions in the earth's crust, including searching and exploration carried out by mine parts for these purposes, provided that such works comply with the conditions set out in (a) in their scope;
(d) to ensure and dispose of old mining works, including their detection, where the survey is carried out by mining parts to the extent referred to in (a).
Application for authorisation of mining activities
(1) The application for authorisation of a mining activity (hereinafter referred to as the "application") contains:
(a) name (trade name), organisation identification number and registered office;
(b) the type of mining activity for which authorisation is sought;
(c) name and identification number of the cadastral territory, (3) name and code of the district, (4) details of the location of the activity, the parcustoms numbers of the parcels concerned by the planned mining activity;
(d) in the case of mining activities referred to in Article 5 (b), data on the determination and modification of protected bearing areas and conquest areas;
(e) in the case of mining activities referred to in Article 5 (c), the indication of the protected area for specific interference with the crust;
(f) planned start-up and closure or, where appropriate, interruption of mining activities;
(g) the name (trade name) and address of the processor of the plan and, where appropriate, the documentation and organisation to carry out certain mining activities for the organisation referred to in (a);
(h) the names (trade names) and addresses of the parties to the proceedings for authorisation of mining activities. 5)
(2) The organisation shall draw up and submit an application for:
(a) search and survey of the exclusive bearing with mining parts documentation according to Annex 1;
(b) securing and disposing of mining works in search and exploration of the exclusive bearing by mining parts of the documentation referred to in Annex 2;
c) Opening, preparation and extraction of the exclusive bearing
1. in a deep and superficial manner, a plan for opening, preparing and conquering as set out in Annex 3;
2. oil, flammable natural gas and technically usable natural gas, a plan for the extraction and extraction referred to in Annex 4;
3. by drilling from the surface, the plan for the preparation, opening and extraction of the puddle field referred to in Annex 5;
(d) securing mining and quarrying works and the disposal of main mining and quarrying works
1. in the case of deep and surface mining, a plan for securing mining and quarrying and the disposal of the main mining and quarrying works referred to in Annex 6;
2. in the case of the extraction of oil, flammable natural gas and technically usable natural gas, a plan for securing and disposing of wells and probes in accordance with Annex 7;
3. In the case of drilling by drilling from the surface, a plan for securing and disposing of the puddle field as set out in Annex 8;
(e) specific interference with the Earth's crust with the documentation referred to in Annexes 9, 10 and 12;
(f) the freezing and disposal of old mining works, the plan for the freezing and disposal of old mining works as set out in Annex 11.
(3) The organisation shall accompany the application:
(a) evidence of the resolution of conflicts of interest where mining activities are threatened by objects and interests protected under specific legislation, 6)
(b) a list of exemptions authorised by the competent authority for the planned mining activity of the organisation;
(c) assessing the impact of mining activity on the surface;
(d) final report on the results of the bearing survey, or proof of permit of work in case this survey has not been completed; 9)
(e) the result of the management of the stocks of the exclusive bearing, if it is a permit to secure mining works and quarrying or to dispose of major mining works and quarries;
(f) an opinion issued under a special legislation, 9a) if it is to be processed under that regulation;
(g) quantifying the expected costs of settling the expected mining damage affected by the mining of the exclusive bearing and proposing the creation of the necessary financial provisions, including the timing of their formation;
(h) quantifying the expected costs of the remediation and reclamation of land 9b) affected by the extraction of the exclusive bearing and proposing the creation of the necessary financial provisions, including the timing of their formation;
(i) an extract from the commercial register and a copy of the mining authorisation.
(4) The quantification of the estimated costs referred to in paragraph 3 (g) and (h) and the proposal for the creation of the necessary financial provisions is not submitted by the organisation if, subject to the conditions set out in law 9c, the aggregate amount of the funds for the recovery and reclamation and the aggregate amount of the funds for the settlement of the mining damage is not in line with the specific costs of the remediation and reclamation and the cost of the mining costs resulting from the expected level of mining and includes the mining activity for which authorisation is sought.
(5) The request shall be submitted in duplicate to the Regional Mining Office.
Plans and documentation concerning mining activities
(1) The plan and documentation for details must be adapted to local conditions. Graphic annexes shall be drawn up on a large scale to ensure the clarity of the data and facts displayed; it is possible to display different data and facts in a single graphic annex, while making it clear.
(2) A dossier, or part thereof, drawn up for other purposes in accordance with specific regulations, 10) may be submitted as a plan or, where appropriate, the documentation referred to in paragraph 1, to the extent required by this Decree.
(3) The plan and documentation are approved by the manager, at the mine of the racing mine, at the quarry of the racing quarry (hereinafter "racing"). 10a) The plan and the documentation and the parts thereof shall specify the date of completion, the names, signatures and functions of the processors, as well as the managers responsible for checking the accuracy and completeness of each part of the plan and the documentation.
Decision authorising mining activities and admissibility of changes in plans and documentation
(1) The District Mining Authority will review the mining activity authorisation procedure
(a) the completeness of the application;
(b) resolution of conflicts of interest protected under specific legislation, 6)
(c) compliance with the principles of mining technology while ensuring the economical use of the exclusive bearing.
(2) In the decision to authorise mining activities, the District Mining Office shall determine the terms and conditions of mining activities as appropriate and shall decide on the objections of the party concerned.
(3) The district mining office shall send the organisation, together with the decision to authorise mining activities, one certified copy of the plan and, where appropriate, documentation.
(4) Changes in plans and documentation which do not impair safety and health at work and safety of operations will be without prejudice to the objects and interests of legal and natural persons protected under specific legislation beyond the scope specified in the Decision authorising mining activities, the organisation will notify the Regional Mining Authority. The declaration shall indicate:
(a) name (trade name), organisation identification number and registered office;
(b) the description and reasons for the change, indicating them in the plan and the documentation.
NOTIFICATION OF HORNIC ACTIVITIES AND ACTIVITIES IMPLEMENTED BY HORNIC ELEMENTS
Subject matter of notification
(1) The organisation announces the commencement of mining activities and activities carried out in a mining manner (hereinafter referred to as "activity") and its interruption for more than 30 days to the Regional Mining Authority.
(2) The organisation shall not notify:
(a) exploration of mining parts during mining of the exclusive bearing, 11) if included in the plan of opening, preparing and conquering the exclusive bearing;
(b) drilling from mining works (underground drilling);
(c) geological work of mapping, laboratory and camera.
Content of the notification
(1) The notification shall include:
(a) the name, identification numbers and registered office of the organisation to carry out the activity;
(b) type of activity, 12)
(c) the purpose and scope of the activity planned;
(d) district, municipality and cadastral territory with a closer indication of the place of activity;
(e) the date of commencement, planned termination or, where appropriate, interruption;
(f) the type and type of technical equipment used;
(g) the method and scope of the tearing works, the details of their authorization,
(h) measures to ensure safety and health at work and safety of operations;
(i) the way in which the consequences of action are obliterated;
(j) evidence of the organisation's approval to carry out the activity subject to reporting;
(k) decisions authorising a mining activity under specific legislation.
(2) A map indicating the location and type of activity shall be attached to the notification.
Reporting deadlines
(1) The organisation is required to declare the commencement, interruption for a period of more than 30 days and termination of activity at least 8 days in advance; within the same time limit, the organisation shall report changes in plans and documentation pursuant to Article 8 (4). In the event of an interruption for more than six months, submit a reinsurance plan which must be processed mutatis mutandis in accordance with § 6 (2) (d) and (e).
(2) Changes in the content of the declaration shall be notified without delay by the organisation.
FINAL PROVISIONS
Repeal
They shall be deleted:
1. Decree 261 / 1957 of the Central Mining Authority of the Ú. l., which lays down more detailed provisions on the preparation and approval of plans for opening, preparing and quarrying, as well as plans for securing and disposing of major mining works and quarrying;
2. Decree No 264 / 1957 of the Central Mining Authority of the Ú. l., which provides for the notification of search and survey work to the State Mining Administration;
3. the Decree of the Central Mining Office of 10 July 1961 No 5026 / 1961 on the drawing up and approval of plans to open, prepare and conquer bearings and the plans to secure and dispose of the main coal mines of the Ostrava-Karvinsky region (Reg. in the amount of No. 43 / 1961 Coll.);
4. the Directives of the Central Geological Office and the Central Mining Office of 5 April 1963 No 2531 / 1963 supplementing the Directives and Guidelines of the Central Geological Office of 1 July 1962 No 9 / 1962 for the research and exploration of mineral deposits (reg. No. 22 / 1963 Coll.);
5. the Decree of the Central Mining Authority No. 800 / 1963 of 28 January 1963 on the development and approval of plans for oil and gas extraction and for the disposal or preservation of wells and probes (reg. No. 11 / 1963 Coll.);
6. the Central Mining Office Directive of 19 July 1960 No 1017-Z / 1960 for the drawing up and approval of plans for the opening, preparation and extraction of bearings and plans for the disposal of major mining works in the Central Research and Mining Department of radioactive raw materials.
Efficacy
This Decree shall take effect on 1 July 1988.

RESEARCH DOCUMENTATION AND EXAMINATION OF EXPOSURES
1. Objective of search and survey: description, purpose, scope and arrangement of mining works.
2. Security of operation of energy, water, mechanical means and material; method and system of mining transport.
3. Basic measures to ensure safety and health at work and safety of operations, measures in connection with old mine parts, surrounding mines and quarries, in particular with regard to the occurrence of explosive gases and dust, self-ignition, rock, coal and gas bursts, water and mud drains and other dangerous phenomena.
4. Mining water management.
5. The method of ensuring the requirements resulting from decisions of the institutions and agreements with the institutions and organisations to which the protection of objects and interests falls under specific rules.

9. Maps and sections with a clear indication of the facts needed to assess the data of points 1, 2, 3, 4 and 7.

PLAN OF RELATED, PREPARATED AND ENFORCEMENT OF EXPLANATORY LINES BY PULL AND SUPERVISORY ELEMENTS
1. Text Part
1.1 Geology and management of sole bearing reserves.
1.1.1 Brief geological, stratigraphic, petrographic and hydrogeological characteristics of the exclusive bearing.
1.1.2 Stocks of the exclusive bearing in the plan of the part concerned, reported in the stock register according to the latest state of exploration.
1.1.3 Planned changes in stocks of the exclusive bearing:

1.2.1 Ensuring that the conditions set out in the decisions establishing the protected bearing area and the conquest area are met.
1.2.2 Planned further survey.
1.2.3. Method of opening, preparing and capturing, their breakdown, both temporal and substantive continuity of work; ensuring the advance of exploration, opening and preparation before conquest, in the case of quarries in advance of hiding, the procedure for restocking.
1.2.4 Conquest methods, information on their approval, justification for their use; specific measures to implement new mining methods.
1.2.5. General slopes of the hiding, refraction and parameters of the hiding and mining cuts; the location and time sequence of the operation of the drains, their design capacity and service life; the general slopes of the droplets, the parameters of the droplets; measures against landslides.
1.2.6 Measures to conduct work at the border of the conquest area; data on mining works or planned works in the adjacent contiguous contiguous area, if work could influence each other and the necessary measures.
