Ministry of Chemical Industry
of 24 October 1962
on the economical use of cardboard transport packages
The Ministry of Chemical Industry, in agreement with the participating central authorities and authorities and with the Councils of the Regional National Committees, provides for a government resolution of 25 July 1962 No 690 on the economical use of cardboard transport packaging, pursuant to § 3 of Decree No. 109 / 1945 Coll., on production management, § 26 of Act No. 165 / 1960 Coll., on the Third Five-Year Plan for the Development of the National Economy of the Czechoslovak Socialist Republic, and Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Scope
(1) The Decree applies to the following transport packaging and its components ("cardboard packaging"):
(a) cardboard packaging included in the price of the goods or invoiced by the supplier in agreement with the customer separately and which the customer is not obliged to return to the supplier, *)
(b) cardboard packaging in which foreign goods have been imported and the importing foreign trade undertaking has not refunded them;
(c) cardboard packaging which the customer is not obliged to return to the supplier in accordance with the relevant rules on the management of packaging in the course of the circulation of the goods;
(d) cardboard packaging repayable (backed-up), *) which has been so degraded by use that they are unfit for circulation and other cardboard packaging ineligible for recirculation.
(2) The Order shall not apply to cardboard packaging which, for medical or other reasons, are not fit for re-use or reprocessing.
Obligation to tender
(1) Organisations holding cardboard packaging (hereinafter referred to as "the holders of cardboard packaging") are obliged to offer them without undue delay after they have been emptied to the nearest repair plant of the sales association of the paper industry responsible for the exclusive purchase of such packaging.
(2) The sales association of the paper industry shall be obliged to comment on the offer within 21 days of its receipt; If they do not do so, the holder of the cardboard packaging shall be entitled to sell it to another interested party or to hand over to Collective raw materials n.p.
(3) The obligation to tender referred to in paragraph 1 shall not apply to:
(a) cardboard packaging which the holder himself continues to use effectively and economically exclusively for packaging purposes;
(b) cardboard packaging in which, as usual, the goods are issued directly to the consumer.
Purchase and renovation
(1) The sales association of the paper industry buys and renovates the packaging offered.
(2) All organisations involved in the circulation of cardboard packaging are required to send packaging to a designated place on the basis of agreed agreements with the Sales Association of the paper industry.
(3) The renovation of cardboard packaging consists of repair, modification or processing to ensure the highest possible use for the transport of goods and the maximum use of matter.
(4) Unprocessed waste from cardboard packaging resulting from renovation will be supplied directly by the Sales Association of the paper industry to the production plants of the paper industry.
Recruitment and contractual terms
The sales association of the paper industry shall negotiate with the holders of cardboard packaging the acceptance conditions and conclude agreements with them on the closer terms of purchase, sorting, dispatch, etc.
Purchase prices
(1) The purchase prices of cardboard packaging shall be determined by agreement between the Sales Association of the paper industry and the holder of cardboard packaging by type of paperboard and sorted quality at least Kčs 0,41 per kg and maximum Kčs 0,70 per kg of packaging weight. This price shall be understood as the franko wagon of the loading station or other means of transport.
(2) If the agreement referred to in paragraph 1 is not reached, the purchase price shall be determined by the Ministry of Chemical Industry in agreement with the superior body of the holder of the cardboard packaging.
Prices of renovated packaging
The price list shall apply to the prices of renovated cardboard packaging. *)
Management with cardboard packaging
(1) The sales association of the paper industry, by means of its commercial technical services in cooperation with the holders of cardboard packaging, finds incorrect or inappropriate use and storage of cardboard packaging, finds ways to improve its use and proposes measures to reduce the consumption of cardboard packaging.
(2) Holders of cardboard packaging are required to ensure the maximum turnover of cardboard packaging and to implement the agreed measures to increase the economy with them.
(3) Where appropriate, the sales association of the paper industry will adjust the balance of both new and repaired cardboard packaging on the basis of the maximum economy demonstrated when justifying the need for the requirements submitted.
Transitional and final provisions
Holders of cardboard packaging which have obtained them before the date of application of this Order and do not use them exclusively for packaging purposes shall be obliged to offer them for purchase in accordance with Article 2 of this Order within 30 days of the date of its effectiveness.
Paragraph 18 of Decree No 335 / 1953 of the Ú. l., on the collection and purchase of raw materials in respect of cardboard packaging, is deleted.
This Decree shall take effect on 1 November 1962.
