Act on Christmas allowance for 1951 on National Insurance pensions and the provision of benefits for war victims

on the Christmas allowance for 1951 for national insurance pensions and the provision benefits of war victims.
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
(1) National insurance pensions to which entitlement is entitled in December 1951 shall be granted from national insurance funds for a Christmas allowance if the pension does not exceed the amount of 2000 CZK per month.
(2) National insurance education to which entitlement is entitled in December 1951 shall be granted from national insurance funds for a Christmas allowance if the pension does not exceed 4000 CZK per month.
(3) The pension referred to in paragraphs 1 and 2 shall mean the gross amount of the pension without education and without increasing the pension for helplessness, but together with any increase in the pension improvement of any kind.
(4) The Christmas supplement is:
1.k důchodům, které byly zvýšeny pro bezmocnost důchodce, vyjímaje důchody sirotků 750 Kčs;
2.k důchodům invalidnímu a starobnímu, k důchodu úrazovému, je-li výdělečná schopnost snížena úrazem alespoň o 50 %, k důchodu manželky, nežije-li ve společné domácnosti s manželem, dále k důchodům vdovy, vdovce a družky, jakož i k sociálnímu důchodu, vyjímaje sociální důchod sirotků 500 Kčs;
3.k důchodům oboustranných sirotků, rodičů a jiných pozůstalých a k sociálnímu důchodu sirotků,
a) které byly zvýšeny pro bezmocnost 450 Kčs;
b) v ostatních případech 300 Kčs;
4. k výchovnému a k důchodům jednostranných sirotků,
a) které byly zvýšeny pro bezmocnost 225 Kčs;
b) v ostatních případech 150 Kčs.
§ 2.
(1) The provision benefits paid under Act No. 164 / 1946 Coll., the care of military and war damages and war victims and the fascist persectation to which they are entitled in December 1951 shall be granted from the means intended for the care of those victims of the Christmas allowance, unless the provision benefits exceed 2000 CZK per month.
(2) In addition to the child supplements paid under Act No. 164 / 1946 Coll., to which they are entitled in December 1951, a Christmas allowance shall be granted if the provision benefits do not exceed 4000 CZK per month.
(3) The benefits provided for in paragraphs 1 and 2 shall be understood as the gross amount of the benefits granted to children without any child supplement and without a charge of nursing or blind persons.
(4) The Christmas supplement is:
1. k zaopatřovacím požitkům invalidy, jemuž byl přiznán ošetřovací nebo slepecký příplatek 750 Kčs;
2. k zaopatřovacím požitkům jiného invalidy, jehož výdělečná schopnost je podle zákona č. 164/1946 Sb. snížena alespoň o 45 %,
jakož i k zaopatřovacím požitkům vdovy, vdovce a družky
500 Kčs;
3. k zaopatřovacím požitkům oboustranných sirotků, rodičů a jiných pozůstalých 300 Kčs;
4. k příplatku na každé dítě a k zaopatřovacím požitkům jednostranných sirotků 150 Kčs.
§ 3.
(1) Christmas addition does not belong
1. pensioners entitled as apprentices to a Christmas allowance for 1951 and employed pensioners who are not entitled to the Christmas allowance because their average gross monthly wage (salary), without remuneration for overtime, exceeds 3.500 CZK per month in the last 6 months or because they have missed work for no reason;
2. persons who receive benefits abroad.
(2) If the beneficiary of the provision benefits under Act No 164 / 1946 Coll. also has a national insurance pension, he is entitled only to the Christmas allowance for the national insurance pension. In the run-up to several national insurance pensions, only the Christmas allowance is the highest; this also applies mutatis mutandis in the run-up of the provision benefits under Act No. 164 / 1946 Coll. with other similar provision salaries.
(3) If an employed pensioner receives only a reduced Christmas allowance from the employer because he has been employed for less than 5 months, he shall be granted, at his request, a part of the Christmas allowance equal to the difference.
§ 4.
Christmas allowances under this law are exempt from payroll tax.
§ 5.
Christmas allowances wrongly received may be deducted by their payer from other benefits to which the beneficiary is entitled.
§ 6.
This Law shall take effect on 1 December 1951; It shall be carried out by the Minister of Labour.
