THE LAW
of 8 March 2017
amending Act No. 165 / 2012 Coll., on Supported Energy Sources and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
In Article 11 of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll., paragraph 10 is added:
"(10) The renewable electricity plant using water power of up to 10 MW is considered to have been put into service on the date of completion of the reconstruction or upgrading of the technological part, which increases the technical and environmental level of the existing electricity plant to a level comparable to that of the newly established electricity generation plants. ';
Transitional provisions
1. If the conditions laid down in § 11 (10) of Act No. 165 / 2012 Coll., as effective from the date of entry into force of this Act, the market operator shall pay the manufacturer:
(a) for the period from 1 January 2016 to 30 September 2016, aid of an amount fixed by the Energy Regulatory Authority according to the year in which the reconstruction or modernisation was completed corresponding to the green electricity bonus under the scheme chosen by the manufacturer for the quantity of electricity produced during that period; if the manufacturer has chosen the aid in the form of a purchase price, the market operator shall pay the aid to the manufacturer for the annual green electricity bonus; and
(b) for the period from 1 October 2016 to the date of entry into force of this Act, the difference between the amount of aid fixed by the Energy Regulatory Authority in accordance with the year in which the reconstruction or modernisation was completed and the amount of aid granted under the price decision effective during that period.
2. The market operator shall pay the aid referred to in point 1 within 30 days from the date of entry into force of this Law or within 30 days from the date on which it received the value of the electricity produced, if this is later.
Efficacy
This Act shall take effect on the day of its publication.
