on the verification of the professional competence of workers for mining and mining activities
The Czech Mining Office according to § 5 paragraph 3 of the Act of the Czech National Council No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, provides:
(1) Professional competence under this Decree means knowledge of the regulations, where they regulate the protection and use of mineral deposits, working conditions, fire protection in the ground, safety and health at work, safety of technical equipment and safety of operations in mining and mining activities, security of protected objects and interests against the effects of mining activities, use of explosives for blasting and fireworks, as well as other regulations governing safety and health at work and safety of technical equipment. 1)
(2) This Decree is without prejudice to the verification of competence under the Specific Regulation.2)
(3) The competence of personnel of organisations carrying out mining or mining activities shall be verified by examination.
(1) The District Mining Office shall verify the competence of the management organisation, its representatives, the organisation's management units and their representatives, the mines and quarries, the mine meters, the labour safety authorities and, where appropriate, the competent personnel assigned to carry out the tasks of safety and health at work and safety at work.
(2) The Czech Mining Office may reserve cases in which it itself shall verify the competence of the staff referred to in paragraph 1.
(3) The professional competence of other workers carrying out mining or mining activities shall be verified by the organisation in respect of which they are employed. The organisation shall proceed mutatis mutandis in the verification of competence under this Decree.
(1) The organisation shall register the worker referred to in Paragraph 2 (1) for the exam at the Circuit Mining Office at the latest on the day of his taking up his duties and inform the worker of this fact.
(2) The district mining office shall notify the worker of the date and place of the examination no later than 15 days before it takes place.
(3) The examination shall take place before a panel appointed by the Chairman of the Circular Mining Office. In the cases referred to in § 2 (2), the examination shall take place before a commission appointed by the President of the Czech Mining Office.
(4) The test result shall be assessed as passed or failed. An alert shall be made on the course of the test, indicating the questions, the evaluation of the response and the result of the test.
(5) The test result shall be notified to the worker and to the organisation; the management organisation shall also be notified to the central authority of which the organisation belongs.
(6) The organisation shall record the test result.
If the worker fails to pass the test, the test may be repeated within the period specified by the peripheral mining office. If the worker does not show up for the test or fail to pass the re-test, the district mining office shall notify the organisation.
The proficiency check of the worker shall be repeated within three years of the last examination. The period for staff referred to in Article 2 (1) shall be suspended by submitting an application for examination.

This Decree shall take effect on 1 January 1990.
