laying down implementing provisions for the Fisheries Act
The Ministry of Agriculture, Forestry and Water Management provides, in agreement with the participating central authorities of the state administration and after consultation with the Czechoslovak Fisheries Union pursuant to § 24 of Act No. 102 / 1963 Coll., on Fisheries (hereinafter referred to as "the Act"):

§ 8
Management as planned
(1) According to the state of the restocking and the ratio of individual fish species, and given the particular nature of the fishing area, the Ministry of Agriculture, Forestry and Aquaculture may provide for derogations from the period of defence and the general prohibition of fishing in the economic plan, as well as for allowable fishing rates; it may also impose an obligation on users of the fishing area to fish for weeds and overgrown fish for the market.
§ 11
Labelling of fishing areas
Users of fishing areas shall indicate the fishing area with a table naming the area; If there is a flow, this marking shall be placed on both ends of the field, on both sides of the flow.

§ 12
Fishing logbook
Fishing tickets shall be issued for the entire national territory for one calendar year or three consecutive calendar years by the district national committee in whose territory the applicant is resident. Foreigners who do not reside in the Czechoslovak Socialist Republic are issued a fishing ticket by a district national committee in whose district they are staying. The fishing ticket is issued on a form approved by the Ministry of Agriculture, Forestry and Water.
§ 13
Who can be denied a fishing ticket
(1) A fishing ticket may be withheld for important reasons; may in particular be denied to persons:
(a) deprived of jurisdiction;
(b) which are not yet 18 years old, except in the case of pupils of agricultural schools and vocational training in fisheries;
(c) have committed an offence in the last three years against regulations relating to fishing, water management or national conservation.
(2) Where the facts for the refusal of a fishing ticket provided for in paragraph 1 (a) and (c) are established only after its issue, the Regional National Committee may withdraw the fishing ticket.
§ 14
Fishing authorisation
(1) When fishing for fish, everyone shall carry a fishing permit, other than the fishing ticket.
(2) Fishing permits are issued by a fishing area user; They are co-signed by a fisherman. The fishing permit shall not be required by the fishing operator and his agent, as well as by persons who fish under the responsibility of the fishing operator for his or her needs. When the fishing area is divided into trout and non-trout, allowances shall be issued separately for each of these waters.
(3) Fishing permits are issued on the prescribed form. The forms of allowances shall be negotiable and shall be issued to the users of the fishing area by the Regional National Committee in whose district the user of the fishing area is based, in the number determined by the Ministry of Agriculture, Forestry and Water in the economic plan.
(4) The fisherman is responsible for issuing only the number of allowances provided for in the economic plan for the fishing area. The user of the fishing area shall keep a list of the persons to whom the fishing permits have been issued and submit that list to the authority which shall supervise the proper exercise of the fishing right (Section 23 (1) of the Law). Fishing permits not issued on the prescribed form shall be invalid.
(5) Users of fishing areas shall charge the allowance forms and return the unused or broken forms to the Regional National Committee.
(6) Fishing permits are issued for a period of one calendar year or shorter, as the case may be.
(7) Fishing permits are issued by a fishing area user, as a rule, for consideration. The Directive for the calculation of compensation for allowances is issued by the Ministry of Agriculture, Forestry and Water Management after consulting the Czechoslovak Fisheries Union.
Protected fish zones

§ 15
(1) The Regional National Committee may, after consultation with the users of the fishing areas, declare running water which is suitable for the spawning of fish or for the rearing of fish handles and generational fish or which is suitable for the overwintering of fish, or for the rearing of watermelons, as a protected fish area.
(2) Users of fishing areas shall indicate protected fish areas at both ends with a "Protected Fish Area 'sign on both sides of the table.
(3) The measures referred to in paragraphs 1 and 2 shall be without prejudice to navigating on navigable flows or to making it difficult to operate a definitively authorised waterworks.
§ 16
(1) Within the period laid down by the Regional National Committee, protected fish zones are prohibited:
(a) fish or other aquatic animals by any means;
(b) disturb, by any means, the friction of fish, the rearing of fish bodies or the overwintering of fish, in particular by using water and trough in such a way as to avoid the need for specific water use, such as the introduction of water poultry on water, the cleaning of the trough and the cutting of trees on coastal land and the cutting of water crops.
(2) The Regional National Committee may, on a proposal from the fishing industry user, authorise fishing for artificial swabs in the protected fish area or for serious reasons, exceptionally, for such fish and other aquatic animals which are harmful to the proper management of that area.

§ 17
Defending periods
(1) From 1 September to 15 April, the following are defended:

§ 18
Periods of protection for certain aquatic animals
(1) Racies (Astacus astacus L., Astacus leptodactilus Esch.) are defended from 1 October to 30 April. However, the hunting of female birds, the difficult eggs and the scavenger fish (Astacus terrentium Schrank) is prohibited throughout the year.
(2) The river pearl, clams, frogs and petals are defended throughout the year.
§ 19
General prohibition on fishing
(1) In trout waters, fishing for all fish shall be prohibited from 1 September to 15 April except for eel fishing in traps and spines referred to in Article 23.
(2) Fishing for all fish from 16 March to 15 June in non-trout waters shall be prohibited except for eel fishing in traps and spines in accordance with Section 23.
(3) If the first or last day of the general prohibition on fishing for a day of work is reduced by that day.
§ 20
Protection at the time of defence and at the time of the general prohibition on fishing
(1) Fishing for fish and other aquatic animals for which protection is provided is not permitted during the period of protection.
(2) Fishing for fish and other aquatic animals of any kind and by any means shall not be permitted in the waters for which it has been issued during the general prohibition on fishing.
§ 21
Prohibition of the acquisition, sale and purchase of fish and crawfish of less than a certain minimum length
(1) It is prohibited to claim, sell and buy the following fish and crawfish which are below the length:

This length shall be measured for fish from the front end of the head to the end of the tail fin, from the front end of the head to the end of the tail.
(2) The provisions of paragraph 1 shall not apply to trade in fish by catch, fish for scientific purposes and fish marketed from ponds or fishing areas (§ 8 (1)).
§ 22
Exceptions
The Regional National Committee may, on a case-by-case basis, in particular in the interests of artificial farming, the transfer of fish and aquatic animals to other waters, for scientific purposes, etc., allow exemptions from the provisions of Sections 17, 19 to 21 and the Ministry of Agriculture, Forestry and Water Management in agreement with the Ministry of Education and Culture from the provisions of Section 18.
§ 23
Eel fishing
(1) Fishing for eel is allowed throughout the year, even during the night. The traps shall be so constructed that the fish are not electrocuted and have holes in the width of at least 1,5 cm. The specific tip of the eel shall be such a hill with its mouth drawn down at least 2 cm, in a state not exceeding 5 cm in diameter, and whose holes (s), if wet, have a length and width of not less than 1,5 cm. Eels below the specified length to be caught in the trap, as well as other fish species, shall be introduced into the running water above the vessel.
(2) As a general rule, the seal on the eel will be operated by the user of the fishing area in which it is located. However, the Ministry of Agriculture, Forestry and Water Management may withdraw the licence to operate the trap in the fishing area and leave it to another organisational component of the Czechoslovak fishing union.
§ 24
Fishing with nets and tops
(1) Fishing with nets (and windnets) and tops is allowed only to the users of fishing areas at the time of permitted fishing in non-trout waters only. In the interest of proper fish farming, the Regional National Committee may limit fishing by all types of nets, lines and tops, excluding fishing in special peaks of eels and salmon nets, even at the time of permitted fishing, or prohibit fishing for fish all year round.
(2) In trout waters, fishing is prohibited for all types of nets, i.e. also with the hair and tops throughout the year, excluding fishing for special peaks of eel. Exemptions from this prohibition may be authorised by the Regional National Committee for scientific or economic purposes, in particular artificial fish farming and for the destruction of fish not defended in trout waters.
(3) The provisions of paragraphs 1 and 2 shall not apply to small hand-held breeches with a mesh area of not more than 1 m2, as well as to small bags with an arc circumference of not more than 1 m intended for catching trap fish (§ 28).
(4) If the fish are threatened (drying water, poisoning, etc.), the user of the fishing area may also take measures which do not comply with the provisions of paragraphs 1 and 2; such measures shall be notified immediately to the Regional National Committee.
§ 25
Fishing behaviour
(1) When fishing for fish, the fishers shall comply with a distance of at least 3 m if they are not measured over smaller distances. In the case of fishing with trains or a fly hook, at least 20 m shall be observed between each fishing distance. Hunting sites shall not be reserved in any way. When fishing for fish by means of a boat, the taxiing and landing of the boat shall be carried out in such a way that it does not unnecessarily disturb other shore-fishing and prevent public water transport.
(2) When fishing for a hook on a set, the fishing vessel shall be present at the pole so as to keep them in sight.
(3) The persons authorised to fish must support the control authorities.
§ 26
Ratio to water structures and installations
(1) Fishing for fish shall not be carried out:
(a) from ships which are loaded onto water structures, from residential ships, from public transport vessels and from floating facilities;
(b) in lock rooms,
(c) in the case of dams and stalls, which serve to sail or produce electricity, at a distance of 100 m from the dam body or from the weir and at the same distance also from the building of hydroelectric power stations, pumping stations, navigation, drainage and irrigation channels and locks, even if these water works are in construction;
(d) road and railway bridges.
(2) It is prohibited to damage in any way during the hunting of water structures (objects, irrigation and drainage channels, etc.) and shore fortifications, especially beds and tiles.
(3) The Regional National Committee may authorise the fishing of nets in the places referred to in points (a), (b) and (c) of paragraph 1 and, for the fishing distance referred to in paragraph 1 (c), to be shortened for fishing.
§ 27
Fishing for fish from boats
(1) The use of ships shall be governed by the applicable rules of navigation safety and the rules for Czechoslovak inland ports. In particular, the mooring of the boats in the fairway, in the dumpsters, in the vertebrae, in the port bridges, in the navigational channels and in the entrance to the lock and port is prohibited.
(2) Seats or sections of the fishing area where fishing from the boats is permitted are determined by the user of the fishing area.
(3) Those fishing for fish from a boat must not have any other rod set outside the boat and must come to shore if they have been called upon by the authorities competent to protect fishing.
(4) A ship shall not be allowed to land traps; the exemption may be authorised by the user of the fishing area.
§ 28
Feedfish
(1) Fish with no minimum length bound in the area may be used for traps. Those fish with the smallest length bound in the area may only be used as trap fish if they reach the lowest length prescribed. Salmonid fish and those species which, at the time when they are to be used as a trap, have a period of protection shall not be used under the trap.
(2) Feedfish not bound by the smallest length of [lumps, intestines, tadpoles, clover, hedgehog, bass, sun] may be caught by hand-held blades with a mesh area of not more than 1 m2 or by small bags with an arc circumference of not more than 1 m. The user of the fishing area may define the places where the hunting of the larch or small bags is allowed.
§ 29
Treatment of fish
(1) If the holder of the catch cannot keep the fish caught alive without abuse and damage, he shall be obliged to kill the fish with a sharp blow to the back of the head and to cut out the ribs completely. It shall be prohibited to store fish caught in nets that are closely attached to the fish's body, to put them on twigs, to bind them by putting the string under the goblins, etc., or to let them be frightened. It shall be prohibited to store fish for exchange for other fish caught.
(2) Fish caught must be kept in such a way that their meat is not degraded and that control of the catch is possible.
(3) Individuals may not sell or exchange catches.
§ 30
Treatment of fish and other aquatic animals caught at the time of defence and of fish which have not reached the smallest length
(1) Fish to be caught at the time of their defence or fish which do not reach the required minimum length must be immediately released into the water with due care even if they are injured in any way; The same applies to other aquatic animals. Anyone who hunts fish and crawfish shall have the measure necessary to determine their length. If the fish caught on the hook cannot be removed without damaging the hooks, it is required to cut the bait and release the fish gently back into the water with the hook.
(2) The user of the fishing area may provide that the fishing authorisations are to use appropriate tools to rescue fish, such as tweezers, peans, removers; can also save the use of underpants.
§ 31
Catch of branded fish
(1) If a fish authorised to fish is caught with a mark and is required to return to the water because it is defended or because it does not reach the smallest length, it shall record the number and shape of the mark, measure the length, estimate its approximate weight and allow it back into the water with due care. The catch shall be reported to the organisation which issued the fishing permit and shall indicate in the report the time and place where the fish was caught.
(2) If a fish authorised to fish is caught with a mark which may not be released back into the water, the species and its exact length and weight shall be identified. The catch shall be reported to the organisation which issued the fishing permit and shall at the same time indicate the time and place of catch of the fish in the report; the check shall be accompanied by a mark.
§ 32
Hunting
(1) In trout and out-of-trout waters, fishing in the headgear is permitted only by means of a glitter or dead fish and by a multistep system.
(2) In one calendar year, only one head may be retained by the authorised fishing officer, even if the heads are fished in several areas.
§ 33
Crayfish fishery
(1) The provisions of this decree also apply to the fishing of crawfish.
(2) Daily catch may not exceed 30 head.
(3) In the case of trawl fishing for exports, the Ministry of Agriculture, Forestry and Aquaculture may authorise exemptions from the general prohibition on fishing, the period of the crayfish protection and the maximum daily catch.

Oddíl III

Provisions for non-trout waters
§ 34
Fishing gear, hunting techniques and traps
(1) Those fishing with smoked fish in non-trout waters may use a maximum of two nets (udic), each of a maximum of two lines with simple hooks. If it is caught on a double or triple, on a live fish or a dead fish, it may have only one bait.
(2) Live fish shall only be caught from 16 June to 31 December.
(3) In the case of a fishing with a flint or artificial or dead fish, it shall not be carried while walking (scouting) or drag the trap behind a moving boat, except for a deep-sea train on the valleys. In the case of a train it is permitted to fish with only one pole (hook), the next pole (line) must not be set or ready for fishing. The train is allowed from 1 September to 31 December. On the valley tanks the train is allowed from 16 June to 31 December. The user of the fishing area may define certain sections for the train.
(4) The fly-fishing is only allowed with one rod. Artificial flies, live and dead insects or its artificial imitations in numbers 1 to 3 may be used at the set. The same applies to fishing for "on a shaker '. Flakes with moulds, beads, etc., are considered to be glitter.
(5) In addition to the prohibited fishing methods referred to in Section 10 of the Act, the following shall be prohibited in non-trout waters:
(a) use as a risk of blood, strangles, milk sludges and ant eggs,
(b) enchant (young) with blood, meat and any prepared mixtures of meat, white worms, crows, dairy centrifuge sludges and ant eggs.
§ 35
Daily fishing times in non-trout waters
Daily fishing times in non-trout waters shall be as follows:
in the months of November, December, January and February from 7 am to 17 pm,
in the months of March, April, September and October from 5 a.m. to 20 p.m.
in the months of May, June, July and August from 3 a.m. to 23 p.m.
These fishing times are not binding in cases where, under the law [Paragraph 10 (1) (c)], fishing is permitted even at night.
§ 36
List of catches
The fishing authorisation in non-trout waters shall include, in addition to the fishing ticket and fishing permits for non-trout waters, the "Catch Overview 'issued by the fishing vessel user in accordance with a model approved by the Ministry of Agriculture, Forestry and Aquaculture.
§ 37
Number and quantity of catches and their records
(1) In one day of hunting, the authorised fishing vessel may retain a maximum of 7 kg of all species of fish, even if fishing on several areas. In this catch there may be no more than 1 carp and 1 pike or 1 carp and 1 candate or 1 pike and 1 candate or 2 pieces of one of these fish species. When weighing one fish caught in any species over 7 kg, the daily catch shall be limited to that one. However, if this piece has been caught following a previous catch of fish lighter, the catch shall end on a daily basis; authorised to fish may also retain previously caught fish.
(2) If salmon fish are also present in non-trout waters, only 3 salmon fish may be retained in addition to the catch permitted under paragraph 1 if the total weight of the catch per day does not exceed 7 kg.
(3) The number and weight of fish caught is required to be entered in the catch list before leaving the water, even if any interruption in the catch or several visits to the water during the day. The truthfully completed catch list shall be submitted to the fishing vessel user who issued the fishing permit by 15 January of the following year, even if the authorised person did not fish during the year or if he did not have any catches, which shall be explicitly stated in the catch list. Any person who does not submit a true summary of the catches within that time limit shall not be allowed to issue a fishing permit to that person next year.
(4) Paragraph 1 does not apply to catches by users of fishing areas.
(5) For bottom tanks, the Regional National Committee may, at the reasoned request of a fishing area user, allow exemptions from paragraph 1 or daily catches to be further restricted.
