Central management of the purchase of agricultural products
of 31 October 1962
adjusting the sale of surplus agricultural products
The central administration of the purchase of agricultural products, together with the Ministry of Internal Trade and the Ministry of Health and in agreement with other participating central authorities pursuant to Article 15 of Act No. 51 / 1959 Coll., on the Purchase of Agricultural Products, Section 6 of the statutory measure of the Bureau of the National Assembly No. 40 / 1962 Coll., on the establishment of the Central Administration of the Purchase of Agricultural Products, Sections 1 and 2 of Act No. 160 / 1949 Coll., on Internal Trade and Section 15 of Act No. 4 / 1952 Coll., on Hygiene and Anti-Epidemic Care:
In order to ensure compliance with the State plan for the purchase of agricultural products, to strengthen the authority of the contracts for the supply of agricultural products and to avoid speculation in the sale of agricultural products, the sale of surplus agricultural products shall be regulated as follows:
The single agricultural cooperatives, individual farmers and other producers (collectors) of agricultural products (hereinafter referred to as "agricultural establishments') shall also sell agricultural products and products thereof, provided that they do not consume them in the course of the operation of the agricultural plant or in their households, to purchasing organisations, unless otherwise provided for in this decree.
(1) Only honey, venison, rabbits, pigeons, forest fruits and mushrooms may be sold directly to consumers after any contractual supply tasks have been performed.
(2) Users of agricultural land with an area of up to 0,20 ha and livestock farmers not using agricultural land may sell eggs, milk, poultry, vegetables and fruit (not grapes and wine) directly to consumers other than the products referred to in paragraph 1 after any contractual supply tasks have been completed.
(3) Exceptionally, in remote municipalities, county national committees may authorise the direct sale to consumers of certain agricultural products in order to ensure the regular supply of the population of the municipality concerned, excluding meat, seeds and seed, malting barley, European vine grapes, wines, sheep's wool, stalk flax and hemp, tobacco, root peppers, onions and garlic.
(4) The central management of the purchase of agricultural products may allow derogations from the provisions of paragraphs 1 to 3.
(1) The sale of agricultural products directly to consumers, where exceptionally permitted under Article 2, is permitted only in agricultural establishments; is carried out at prices freely agreed, which may not exceed the level of State retail prices.
(2) When selling agricultural products directly to consumers, agricultural establishments shall at any time demonstrate at the request of the competent authority that they are properly performing their contractual or specified supply tasks.
(1) Purchasing organisations are obliged to purchase all agricultural products offered by agricultural establishments both in the framework of their supply tasks and after these tasks, if the products offered can be used for direct consumption or processing, even if they do not comply with national quality standards or quality conditions. These products shall be purchased at fixed buying prices and, if not fixed, at prices agreed between the purchasing organisation and the agricultural establishment. The agreed prices shall be proportionate to the quality difference in relation to the standard agricultural products purchased.
(2) Purchasing organisations are not obliged to purchase agricultural products grown for speculative reasons on oversized areas which are contrary to budgetary areas and tasks. Where a purchasing organisation refuses to take over such products and where there is a larger range of products, the district national committee shall decide, in agreement with the purchasing organisation, on their purchase or otherwise.
The members of the single agricultural cooperatives sell agricultural products from their fungi holdings to purchasing organisations in principle through the single agricultural cooperative.
The sale of agricultural products and the sale of foreign products (trafficking) are not permitted.
This decree does not apply to the sale of nurseries, seedlings, ornamental plants, goat's milk, table duck eggs and breeding and productive animals intended for further breeding.
(1) The agricultural markets are deleted; Consequently, the market rules issued by the Regional National Committees governing the way and conditions of sale on these markets are also repealed.
(2) The following shall be deleted:
(a) the provisions of Sections 34 (2), 47 to 52 and 5 (3) of the Annex to the Decree of the Ministry of Agriculture No 162 / 1959 Ú. l., on the purchase of agricultural products,
(b) Paragraph 3 of Decree No 202 / 1957 of the Ministry of Internal Trade on the arrangements for the supply and purchase of consumer goods;
(c) Directive of the Ministry of Health for Sanitary and Anti-Epidemic Measures on Agricultural Markets, No 17 / 1954 of the "Hygiene Regulations,"
(d) Directive No 283 / 1953 of the Ministry of Internal Trade on the participation of undertakings in State and cooperative trade in agricultural markets and on other market opportunities.
This decree shall take effect on the day of its publication.
