THE LAW
of 18 March 2010
amending Act No. 326 / 2004 Coll., on Plant Health and amending certain related acts, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 626 / 2004 Coll., Act No. 444 / 2005 Coll., Act No. 131 / 2006 Coll., Act No. 189 / 2008 Coll., Act No. 249 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 281 / 2009 Coll., Act No. 291 / 2009 Coll. and Act No. 490 / 2009 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Commission Directive 92 / 70 / EEC of 30 July 1992 laying down rules for surveys to be carried out for the purpose of the recognition of protected zones in the Community. Commission Directive 92 / 90 / EEC of 3 November 1992 laying down the obligations of producers and importers of plants, plant products and other objects and laying down the details for their registration. Commission Directive 92 / 105 / EEC of 3 December 1992 laying down the degree of standardisation of plant passports used for the movement of certain plants, plant products or other objects within the Community and laying down detailed procedures for the issue of such plant passports and the conditions and detailed procedures for their replacement. Commission Directive 93 / 50 / EEC of 24 June 1993 specifying certain plants not listed in Annex V, Part A to Council Directive 77 / 93 / EEC whose producers or warehouses or dispatch centres in the production areas of those plants must be entered in an official register. Commission Directive 93 / 51 / EEC of 24 June 1993 laying down rules for the movement of certain plants, plant products and other objects through a protected zone and for the movement of such plants, plant products and other objects within the protected zone of origin. Commission Directive 94 / 3 / EC of 21 January 1994 laying down a procedure for the notification of the detention of consignments and harmful organisms from third countries posing an imminent phytosanitary threat. Commission Directive 98 / 22 / EC of 15 October 1998 laying down the minimum conditions required for carrying out plant health checks on plants, plant products and other objects originating in third countries for inspection posts other than destinations. Council Directive 2000 / 29 / EC of 8 May 2000 on protective measures against the introduction into and the spread within the Community of organisms harmful to plants or plant products. Council Directive 2002 / 89 / EC of 28 November 2002 amending Directive 2000 / 29 / EC on protective measures against the introduction into and the spread within the Community of organisms harmful to plants or plant products. Commission Directive 2004 / 103 / EC Commission Directive 2008 / 61 / EC of 17 June 2008 laying down the conditions under which certain harmful organisms, plants, plant products and other objects listed in Annexes I to V to Council Directive 2000 / 29 / EC may be imported into or moved in the Community or certain protected zones of the Community for experimental or scientific purposes and for the breeding of varieties (codified version). Council Directive 91 / 414 / EEC of 15 July 1991 concerning the placing of plant protection products on the market. Council Directive 97 / 57 / EC of 22 September 1997 establishing Annex VI to Directive 91 / 414 / EEC concerning the placing of plant protection products on the market. Council Directive 79 / 117 / EEC of 21 December 1978 concerning the prohibition of the placing on the market and use of plant protection products containing certain active substances. '
2. In Paragraph 8, the following paragraph 4 is inserted after paragraph 3:
"(4) Where a plant passport is issued for the movement of quarantine material from the Czech Republic to the territory of another Member State of the European Union, the plant health authority shall issue it on the basis of the information contained in the relevant authorisation issued by the responsible official plant protection authority of the Member State of the European Union and delivered by the plant health service. The quarantine isolation conditions shall be complied with when the material is moved. ';
Paragraph 4 shall become paragraph 5.
Efficacy
This Act shall take effect on the day of its publication.
