on the planning of thematic tasks
The Office for inventions and discoveries pursuant to Article 155 (1) (d) of Act No. 84 / 1972 Coll., on discoveries, inventions, improvements and designs (hereinafter referred to as "the Act '), in agreement with the participating central authorities and with the Central Council of Trade Unions, provides:
Organisation of thematic tasks planning
§ 1
(1) The Office for inventions and discoveries (hereinafter referred to as the Office), in cooperation with the Central Authorities of the Federation and Republics, with other Central Authorities and with the Central Board of Trade Unions, is methodically managing and controlling the planning of thematic tasks.
(2) The Office, together with the central government bodies of the federations and Republics and the competent authorities of the Revolutionary Trade Union Movement, and in cooperation with the Socialist Youth Union, the Czechoslovak Scientific and Technical Society and other social organisations, is preparing and announcing a thematic agenda to address socially important technological and economic problems from the national economic plans.
§ 2
The Central Government of the Federation and the Republics are obliged to draw up and announce, in their field of competence, in cooperation with the competent authorities of the Revolutionary Trade Union Movement, the ministerial plans for thematic tasks. The Socialist Youth Union, the Czechoslovak Scientific and Technical Society and other social organisations are involved in the compilation and announcement of ministerial plans for thematic tasks.
§ 3
Socialists' organisations (hereinafter referred to as "organisations') are obliged to effectively guide the creative activities of inventors and improvement workers by regularly compiling and announcing sectoral and corporate plans for thematic tasks. This activity is carried out primarily by organisations in cooperation with the authorities of the Revolutionary Trade Union Movement, the Socialist Youth Union, the Czechoslovak Scientific and Technical Society and, where appropriate, other social organisations. The institutions and organisations shall endeavour to participate in the selection of thematic tasks and their solutions in the widest possible range of improvements and inventors; to this end, they are obliged to organise collectibles to deal with thematic tasks and to create versatile conditions for their work.
§ 4
The thematic tasks plan shall include in particular:
(a) problems selected from the tasks set out in the national economic plans and from the comprehensive socialist rationalisation plans;
(b) other important tasks, e.g. tasks
- in the field of occupational safety and hygiene and the environment, the solution of which requires an urgent need for a national economy.
§ 5
When drawing up and announcing thematic tasks plans, institutions and organisations shall:
(a) be responsible for the fact that the tasks included in the plan are of relevance to the degree of declaration and that there will be no dual declaration of the same task within the scope of the field or a declaration of a task the solution of which is available by other means;
(b) they are obliged to familiarise themselves with the declared tasks of their subordinate organisations, to organise an exchange of thematic tasks and to cooperate in the popularisation and resolution of the declared tasks;
(c) are obliged to check how subordinate organisations perform their tasks in this field of activity.
§ 6
(1) The organisation shall submit proposals for thematic tasks for inclusion in the sectoral thematic tasks plan or thematic tasks plan announced by the Office to its directly superior body, in a manner specified by methodological guidance on the management of inventive and improvement activities. That authority shall examine the proposals submitted and, where appropriate, supplement them with its own proposals and submit them to the superior central authority.
(2) The Central Authorities of the Federation and the Republics shall submit to the Office their proposals for thematic tasks which they propose to include in the Thematic Tasks Plan announced by the Office.
Announcement of thematic tasks plans
§ 7
Thematic tasks plans shall be announced at the end of each year for the following year. During the year, the Thematic Tasks Plan can be supplemented and announced by thematic tasks if an urgent need for resolution of tasks is shown.
§ 8
The authorities and organisations announcing the thematic tasks plan must publish it appropriately and popularize it properly in such a way that the public is familiar with it, in particular the range of envisaged solvers.
§ 9
The amount of the special remuneration written shall be determined in such a way as to reflect the technical complexity of the problem and the expected social benefits of the use of the solution.
§ 10
(1) When launching the thematic tasks plan, the authorities and organisations are required to define and publish the competitive conditions for submission, discussion, evaluation and remuneration of solutions.
(2) The conditions of competition referred to in paragraph 1 shall include in particular:
(a) a description of the existing situation and shortcomings of known solutions;
(b) a precise definition of the problem to be addressed, specifying in detail the technical and economic requirements to be met by the expected solution;
(c) information on the state of the art, indicating the documentation materials; the body and organisations announcing the thematic task shall be obliged to enable interested parties to directly acquaint themselves with this material;
(d) the deadline for submitting draft solutions; the duration of the period shall be determined taking into account the difficulty of the problem and the timing of the follow-up to the economic plans and may be extended where justified;
(e) special remuneration for solving the thematic task;
(f) an analysis of the envisaged technical and economic efficiency, the possibility and extent of the specific application of the required solution in the national economy, the data on organisations benefiting from the production or operation solutions and the time when the required solution will be applied to the national economy;
(g) an indication of who and until when the candidates for the solution may apply for technical advice or advice;
(h) the address to which the solution is to be sent;
(i) the date by which all proposals will be evaluated and the remuneration paid;
(j) an indication of who is unable to participate in a thematic task.
§ 11
Any person may participate in a solution to the declared thematic task, except those persons who have approved the thematic task of announcing and who have been entrusted with the functions of the chairman or member of the evaluation committee and who are conducting a benefit survey or otherwise come into contact with proposals for solutions; However, if they have decided to draw up and submit a proposal for a solution and to draw attention to that fact before they have been aware of the content of the other applications applied for, they may participate in such a solution while being relieved.
§ 12
The thematic task can only be withdrawn for serious reasons. The appeal shall be carried out in the manner in which a thematic task has been declared or in other equally effective manner, not later than 30 days before the time limit laid down to resolve the task. When dismissing a thematic task, the announcing authority or organisation shall be required to deal adequately with the solvers who have fulfilled its conditions in whole or in part prior to dismissing the thematic task. This right shall be brought to the attention of the investigator by the announcing authorities or organisations when recalling the thematic task.
Evaluation of thematic tasks
§ 13
(1) Evaluation of draft solutions shall be carried out in the evaluation committee, which shall be established in advance by the competent authority or organisation for this purpose; The Commission must also be represented by an organisation which will benefit from the solution.
(2) Where necessary, the Commission may request opinions from experts who are not members of the Commission.
(3) Evaluation of draft solutions shall be carried out no later than two months after the deadline for submission of draft solutions.
(4) If the solver has solved the thematic task under competitive conditions and the solution has been assessed to be the best, the announcing authority or organisation shall be obliged to pay him the special reward he has been awarded.
(5) The rights and obligations of the declared thematic task, such as cash performance, must be settled no later than four months after the deadline set for the submission of the solution. That period may be extended in the light of the nature of the thematic task and in other justified cases.
(6) The designating authority or organisation shall inform without delay the outcome of the evaluation of all solvers and shall publish the result in the same or other equally effective manner as the publication of the thematic task.
§ 14
(1) After the evaluation has been carried out, all proposals for solutions to thematic tasks shall be discussed as applications for improvement proposals with the right of priority when this solution has taken place; However, they are not hindered by the fact that the investigator did not exceed the work task resulting from his job description, from the work order in question, or from the conditions and indicators set out in the assignment. The entitlement to remuneration for the use of such an improvement proposal shall not be affected by the payment of the special remuneration for the thematic task.
(2) If it is assumed that the solution is an invention at the same time, the promoter recommends the solver to apply for the invention and the organisation is obliged to provide assistance to the author within the scope of § 49 of the Act.
§ 15
(1) The evaluation proposals for solutions are required to be used and informed immediately by the authorities or organisations in accordance with the responsibility assumed in the announcement of thematic tasks.
(2) In the case where the use of the production solution requires its development or testing or exceptional means which cannot be provided during the current planning period, the authority or organisation shall include the use of the solution in the relevant part of the implementation economic plan for the earliest period.
(3) It shall immediately notify the competent authority of the use of the evaluation proposals for the organisation's solutions; for thematic tasks declared by the Office, the organisation shall also be required to notify the Office.
§ 16
This Decree shall take effect on 1 January 1973.
