amending and supplementing Decree No 14 / 1959 of the Ú. l issue basic conditions for the supply of heating gases
The Ministry of Fuel and Energy, in agreement with the participating ministries (central offices and authorities) and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides pursuant to Section 192 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Decree No 14 / 1959 of the Ú. l issuing the basic conditions for the supply of heating gases shall be amended as follows:
1. Paragraph 3 (2) reads as follows:
"(2) Delivery contracts shall be concluded, in principle, for the whole year, with a mandatory breakdown per quarter by type of heating gas and shall be supplemented by binding monthly or decade-based sampling diagrams with a breakdown of the quantities per day; where justified, sampling diagrams may be agreed for shorter periods. ';
2. In Paragraph 15, the following paragraph is inserted after paragraph 3:
"(4) For any breach of the obligation imposed on customers under paragraphs 1 to 3, the customer who collects heating gases in the wholesale range shall be obliged to pay the supplier a penalty of Kčs 50, - ';
3. Paragraph 37 (2) reads as follows:
"(2) If a customer who collects heating gases in the wholesale range does not withdraw the quantity of heating gases (§ 11 (2)) according to the sampling chart in the contracted delivery period at all, or if only a part of the contracted quantity of heating gases is taken, he is obliged to pay a penalty payment of 5% of the price of the unrecovered quantity of heating gases. However, periodic penalty payments shall not be made on the quantity of heating gases not taken for the duration of the regulatory or dispatching measures. ';
4. The following paragraph shall be inserted after Paragraph 37:
Failure to supply to the national pipeline network
(1) If the production undertaking (plant), which is obliged to deliver heating gases to the national gas pipeline network on the basis of a gesture, does not deliver the quantity of heating gases according to the sampling schedule in the agreed delivery period at all, or does not deliver part of the agreed quantity of heating gases, it is obliged to pay the Gas Association *) a penalty of 20% of the price of the undelivered quantity of heating gases.
(2) If the Gas Association does not withdraw the quantity of heating gases according to the sampling diagram in the agreed delivery period at all or if only part of the contracted quantity is taken, it is obliged, as an organisation performing the geses in the gas sector, to pay to the producer (plant), which is obliged, on the basis of the gesture, to make deliveries to the national gas pipeline network, a penalty of 20% of the price of the uncollected quantity of heating gases. '
5.
Excess of sample diagram
Where a customer who collects heating gases in the wholesale range, without prior agreement with the supplier for the sampling site, exceeds the quantity of heating gases agreed according to the sampling diagram or adjusted as a result of the implementation of the regulatory or dispatcher measures within the contracted delivery period, he shall pay the supplier for all such quantities of heating gases of a periodic penalty payment of Kès 0,50 per m3 of gas. ';
This Decree shall take effect on 1 November 1962.

*) According to Decree No. 168 / 1959 Ú. l, the association of gas plants operates on the management of the production, distribution and disposal of heating gases and the development of the gas industry, gesci in the gas sector.
