on the acquisition and loss of Czechoslovak citizenship by marriage.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
(1) The foreign citizen is married to a Czechoslovak citizen of his citizenship if the Ministry of the Interior, upon request, gives its consent. A request for consent may be submitted before and no later than three months after the marriage. Although consent was granted after marriage, the matter is viewed as if she had become a foreign citizen of Czechoslovakia on the day of marriage.
(2) The provisions of paragraph 1 apply mutatis mutandis if a divorced stranger restores a marriage community in force with his husband, a Czechoslovak national.
§ 2.
(1) A Czechoslovak citizen ceases to be a citizen by marriage to a foreigner, if he or she acquires the nationality of his or her spouse under the rule of law of his or her country, unless the Ministry of the Interior declares, at his or her request, either before or no later than three months after his or her marriage that he or she is left with Czechoslovak citizenship. Even if the post-marriage application has been handled favourably, it is considered that the loss of Czechoslovak citizenship has not occurred.
(2) The provisions of paragraph 1 shall apply mutatis mutandis if a divorced citizen of the Czechoslovak Community of Valid Marriage with her husband is renewed by a stranger.
§ 3.
Persons residing abroad may submit an application pursuant to § 1 or § 2 also to the competent Czechoslovak representative office.
§ 4.
The Ministry of the Interior may, by decree, transfer its jurisdiction under this Act to the Regional National Committees, in Slovakia, to the Internal Office.
§ 5.
In order to decide on applications under § § 1 and § 2, the directives issued by the Government on a proposal from the Minister for the Interior shall apply.
§ 6.
The existing provisions on the acquisition and withdrawal of Czechoslovak citizenship by marriage are hereby repealed.
§ 7.
This Act shall take effect on the day of its publication; It shall be implemented by the Home Secretary in agreement with the Ministers involved.
