GOVERNMENT REGULATION
of 23 May 2018
amending Government Regulation No 481 / 2012 Coll., on the restriction of the use of certain hazardous substances in electrical and electronic equipment, as amended by Government Regulation No 391 / 2016 Coll.
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 205 / 2002 Coll. and Act No. 34 / 2011 Coll., ("the Act ') to implement Sections 2 (d) and 12 and 13 of the Act:
Government Regulation No. 481 / 2012 Coll., on the restriction of the use of certain hazardous substances in electrical and electronic equipment, as amended by Government Regulation No. 391 / 2016 Coll., is amended as follows:
1. At the end of footnote 1, the sentences are added to separate rows
"Commission Delegated Directive (EU) 2017 / 1009 of 13 March 2017 amending, for the purposes of adapting to technical progress, Annex III to Directive 2011 / 65 / EU of the European Parliament and of the Council as regards the exemption for the use of cadmium and lead in filter glass and glass used for reflectance ethalons. Commission Delegated Directive (EU) 2017 / 1010 Commission Delegated Directive (EU) 2017 / 1011 of 15 March 2017 amending, for the purposes of adapting to technical progress, Annex III to Directive 2011 / 65 / EU of the European Parliament and of the Council as regards an exemption for the use of lead in glass for optical purposes. ';
2. At the end of footnote 1, the sentence is added to the separate line:

"Directive (EU) 2017 / 2102 of the European Parliament and of the Council of 15 November 2017 amending Directive 2011 / 65 / EU on the restriction of the use of certain hazardous substances in electrical and electronic equipment. '.
4. In Article 2 (3), at the end of point (i), the word "a 'is deleted.
5. In Article 2, at the end of paragraph 3, the dot is replaced by "a 'and the following point (k) is added:
"(k) whistle organ."
6. In Article 3 (i), the words "or traction-powered machine powered from an external source 'are inserted after the words" energy source'.
7. In the first sentence of Article 4 (4), after the words "in vitro5) placed on the market from 22 July 2016," the word "a" is replaced by a comma and at the end of the text of the first sentence the words "and on electrical equipment as referred to in Article 2 (2) (j) placed on the market from 22 July 2019."
8. in Paragraph 4 (5), the word "a" shall be replaced by a comma at the end of point (e).
9. In Article 4, at the end of paragraph 5, the dot is replaced by "a 'and the following point (g) is added:
"(g) electrical equipment referred to in Article 2 (2) (j) placed on the market before 22 July 2019. '.
10.Paragraph 4 (6) reads as follows:
"(6) Paragraph 1 shall not apply to reused spare parts where re-use takes place within a controllable closed withdrawal system between undertakings and the consumer is informed of the re-use of the parts and those reused spare parts are obtained
(a) electrical equipment placed on the market before 1 July 2006 and used in electrical equipment placed on the market before 1 July 2016;
(b) medical devices or monitoring and control devices placed on the market before 22 July 2014 and used in electrical equipment placed on the market before 22 July 2024;
(c) in vitro diagnostic medical devices placed on the market before 22 July 2016 and used in electrical equipment placed on the market before 22 July 2026;
(d) industrial monitoring and control equipment placed on the market before 22 July 2017 and used in electrical equipment placed on the market before 22 July 2027; and
(e) electrical equipment referred to in Article 2 (2) (j) placed on the market before 22 July 2019 and used in electrical equipment placed on the market before 22 July 2029. ';
11. Article 15 shall be deleted, including the title.
12. The heading of Annex 2 reads as follows:
"List of uses of certain hazardous substances which may be used under specified conditions'.
13. in Annex 2, item 9 (b):
"9 (b) Lead in lead bearing pans and cases in compressors containing refrigerant in heating, ventilation, air conditioning and cooling systems Applies to electrical equipment pursuant to § 2 (2) (g), (h) and (j). The following point is inserted:
14. in Annex No 2, the following entry 9 (b) -I is inserted after entry 9 (b):
"9 (b) -ILead in lead bearing pans and casings in hermetic spiral compressors containing a refrigerant with a declared electrical input of 9 kW or lower in heating, ventilation, air conditioning and cooling systems (HVACR) refers to large household appliances. Article 2
15. in Annex 2, items 13 (a) and 13 (b) read:
"13 (a) Lead in glass for optical purposes It applies to all electrical equipment pursuant to § 2 (2) (a) to (j). Validity until: (a) 21 July 2023 for in vitro diagnostic medical devices pursuant to § 2 (2) (g), (b) 21 July 2024 for industrial monitoring and control equipment as referred to in § 2 (2) (h) and for electrical equipment as referred to in § 2 (2) (j), (c) 21 July 2021 for all other electrical equipment including subcategories 13 (b) Kadmium and lead in filter glass and glass used for reflectance ethalons Applies to electrical equipment pursuant to § 2 (2) (g), (h) and (j). The following point is inserted:
16. in Annex 2, the following entries 13 (b) to 13 (b) are inserted after entry 13 (b):
"13 (b) -Iol in filter glass coloured ion It applies to electrical equipment pursuant to § 2 (2) (a) to (f) and (i). (a) this Annex 13 (b) -IIIKadmium and lead in glazes used for reflectivity ethalons'.
17. in Annex 2, entry 39 is replaced by the following:
"39 (a) Cemented selenide in semiconductor nanocrystal quantum image points based on cadmium for the conversion of wavelength (" downshifting ") for use in visualisation systems (< 0,2 μg Cd per mm2 of screen area) applies to all electrical equipment according to § 2 (2) (a) to (j). Article 2
Efficacy
This Regulation shall be binding in its entirety and directly applicable in all Member States.
(a) points 2 and 17, which shall take effect on 21 November 2018; and
(b) points 3 to 11, which shall take effect on 12 June 2019.
